Ordinance No. 06-02

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEVADA, TEXAS, REQUIRING STREET ADDRESSES ON ALL RESIDENCE AND BUISNESSES; PRESCRIBING STREET ADDRESS NUMBERS, SIZES AND LOCATIONS; AND PROVIDING AN EFFECTIVE DATE

WHEREAS, the City Council of the City of Nevada, Texas, have determined that to ensure the continued health and safety of the general public, a set of rules are required for prescribing street address numbering locations and number size; and

WHEREAS, the City Council of the City of Nevada, Texas, have received concerns from Police, Fire and Emergency Medical Services that it is difficult to locate some residences or businesses in the City because there is no street address numbers or, if present, are incorrect or, are inadequate for identification; and

WHEREAS, in order for emergency personnel to properly identify property within the City where emergency Police, Fire or Medical Services are necessary it is vital that all residence and businesses within the City be identified with a street address.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEVADA, TEXAS:

Section 1, PURPOSE:

The purpose of this Ordinance is to enhance the easy and rapid location of properties for the delivery of public safety, emergency services, postal delivery and business delivery.

Section 2, ADMINISTRATION:

The City of Nevada who shall assign numbers to all properties, both on existing and proposed roads, shall administer this Ordinance.

Section 3, NUMBERING SYSTEM:

a. Address numbers shall be even on only one side of a road and odd on the other side.

b.  Addresses shall be whole numbers only, in consistent sequence along the entire road, with approximately 100 numbers allowed per 528 feet or 1/10 mile (one number per 10 feet), or sequential numbers for lots of 1 acre or less in subdivisions.

c.  Addresses shall NOT include alphabetic designations for individual structures.

Section 4, COMPLIANCE:

All owners of structures shall, on or before the effective date of this Ordinance display and maintain assigned numbers in the following manner:

a.  NUMBER ON THE STRUCTURE or residence. Where the residence or structure is within 50 (fifty) feet of the edge of the road right-of-way, the assigned number shall be displayed on the front of the residence or structure in the vicinity of the front door or entry.

b.  Number AT THE STREET LINE. Where the residence or structure is over 50 (fifty) feet from the edge of the road right-of-way, the assigned number shall be displayed on a post, fence wall, mail box, or on some other structure approved for use by the city at the property line adjacent to the walk or access drive to the residence or structure.

c.  SIZE AND COLOR OF NUMBER, numbers shall be displayed in a, color and size approved for use by the city and shall be located as to be visible from the road. Numbers should be at least 4 (four) inches high and constructed of a durable, bright material or painted on a permanent structure and of a color, which provides a contrast to the background.

d.  Every person whose duty it is to display the assigned number shall remove any different number that might be mistaken for, or confused with the number assigned in conformance with this Ordinance.

Section 5, Penalties:

Violating any provisions of this Ordinance is an offense punishable in Municipal Court by a fine of not more than $200 per day.

Section 6, Enforcement:

Failure to enforce a provision of this Ordinance shall in no event be deemed a waiver of the right to thereafter enforce the same.

a.  Upon Notice of violation, the City of Nevada Code Enforcement will send an initial letter to the offending party, advising of the violation. Said letter shall be sent by certified mail with return receipt to ensure delivery.

b.  The violator(s) will be allowed 10 (ten) days from the receipt of the notice in which to correct the violation(s).

c.  The City of Nevada Code Enforcement may then, at their discretion, serve a second notice.

d.  If the violation is not corrected to the satisfaction of the City of Nevada Code Enforcement within the 10 (ten) day period, and after expiration or waiver of the subsequent second notice, a citation will be issued.

Section 7, NEW DEVELOPMENTS AND SUBDIVISIONS:

All new developments and subdivisions shall be named and numbered in accordance with the provisions of this Ordinance as follows:

a.  NEW DEVELOPMENTS. Whenever any residence or other structure is constructed or developed, it shall be the duty of the new owner to procure an assigned number from the city. This shall be done at the time of the issuance of the building permit.

b.  NEW SUBDIVISIONS. Any prospective sub-divider shall provide a proposed plat on the pre-application submission to the City. Approval by the City shall constitute the assignment of road names and numbers to the lots in the sub-division on the final plan showing proposed roads. The applicant shall mark on the plan, lines or dots, in the center of the streets every 10 (ten) feet so as to aid in assignment of numbers to structures subsequently constructed.

Section 8, EFFECTIVE DATE

This ordinance shall be in full force and effect from and after its passage and publication as required by law and it is so ordained.
