NOTICE OF HEARING ON PETITION FOR ANNEXATION

OF TERRITORY IN THE TOWN OF MILO

TO THE VILLAGE OF PENN YAN

NOTICE IS HEREBY GIVEN, that a Petition,pursuant to Article 17 of the General Municipal Law, by the McFetridge Irrevocable Family Trust, in regard to premises situate on the easterly side of NYS Route 14A in the Town of Milo (part of tax map parcel no. 61.02-1-6), has been received by the Town Board of the Town of Milo, Yates County, New York and the Board of Trustees of the Village of Penn Yan, Yates County, New York for the Annexation of the following described premises situated in the Town of Milo to the Village of Penn Yan, and is more particularly described in Schedule “A”, that is attached hereto and made a part hereof.

PLEASE TAKE FURTHER NOTICE that a Joint Public Hearing will be held on said Petition, during a Special Meeting heldby the Board of Trustees of the Village of Penn Yan and the Town Board of the Town of Milo onJuly 18, 2017at6:00 p.m. at the Village of Penn Yan Hall, 111 Elm Street, Penn Yan, New York, at which time all persons interested in the matter maybe heard. Objection(s) based on any of the grounds set forth in Paragraphs a, b, c or d of subdivision one of Section 705 of the General Municipal Law shall, in addition to oral testimony thereon, be submitted in writing. Any oral testimony presented at such hearing relating to the grounds set forth in Paragraph e of subdivision one of General Municipal Law Section 705 shall be reduced to writing and shall be a part of the record of such hearing.

PLEASE TAKE FURTHER NOTICE that the environmental significance of said proposed Annexation will be reviewed by the Town Board of the Town of Milo and the Board of Trustees of the Village of Penn Yan incident to and as a part of said public hearing.

The Petition and supporting documentation of the premises proposed to be annexed to the Village of Penn Yan, is available at the Town of Milo Office, 137 Main Street, Penn Yan, New York for inspection, during regular business hours, by interested parties prior to the hearing.

ALL THAT CERTAIN PIECE OR PARCEL OF LAND situate in the Town of Milo, County of Yates, State of New York, known and distinguished as part of Lot No. 30 in said Town and being more particularly bounded and described as follows:

Beginning at a point on the easterly highway boundary of New York State Route 14A (Dundee-Penn Yan S.H. No. 5324) as shown on New York State Department of Transportation of Appropriation Map 15 as Parcel 18 at its intersection with the division line between the lands now or formerly of The McFetridge Irrevocable Family Trust as described in Deed Instrument No. 20Q7-00001628 on the south and the lands now or formerly of Yates County Industrial Development Agency as described in Liber 397 of Deeds at Page 795 on the north, said line also being the division line between the Town of Milo on the south and the Village of Penn Yan on the north; thence North 88 deg. 22 min. 32 sec. East along the said Town/Village line and the division line between the said lands of The McFetridge Irrevocable Family Trust on the south and the said lands of Yates County Industrial Development Agency & the lands now or formerly of Coach & Equipment Manufacturing Corp. as described in Deed Instrument No. 2010-00001615 in part by each, on the north, a distance of 588.56 feet to a point; thence through the said lands of The McFetridge Irrevocable Family Trust, the following two (2) courses and distances: 1.) South 29 deg. 19 min. 18 sec. East a distance of 236.58 feet; and 2.) South 58 deg. 40 min. 50 sec. West a distance of 503.02 feet to a point on the said easterly highway boundary of New York State Route 14A (Dundee-Penn Yan S.H. No. 5324); thence North 31 deg. 19 min. 10 sec.
