A JOINT RESOLUTION

TO APPROVE REGULATIONS OF THE DEPARTMENT OF LABOR, LICENSING AND REGULATION, BOARD OF EXAMINERS IN OPTICIANRY, RELATING TO CONTINUING EDUCATION, LICENSURE, APPRENTICESHIPS, EXAMINATIONS, DESIGNATED AS REGULATION DOCUMENT NUMBER 2354, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The regulations of the Department of Labor, Licensing and Regulation, Board of Examiners in Opticianry, relating to continuing education, licensure, apprenticeships, examinations, designated as Regulation Document Number 2354, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.

SECTION 2. This joint resolution takes effect upon approval by the Governor.

SUMMARY AS SUBMITTED

BY PROMULGATING AGENCY.

The Board of Examiners in Opticianry is drafting proposed regulations to conform with the changes in the statute. The proposed regulations add definitions of “continuing education” and “one continuing education hour” and address the issues of the election of officers of the board and the frequency of board meetings. The proposed regulations also establish requirements for licensure, apprenticeships, examinations, and reinstatements of lapsed licenses and apprenticeships. Further requirements of four hours of continuing education for opticians and apprentices and one additional hour in contact lens study for contact lens dispensing opticians which were set in the new statute are adopted and clarified in the regulation. Finally, fees are established and standards of practice are adopted for recordkeeping, advertising, and registration of optical businesses.
