THE CORPORATION OF THE TOWNSHIP OF NORWICH

BY-LAW NUMBER 102-2007

TO AUTHORIZE EXECUTION OF A PRESERVICING AGREEMENT BETWEEN THE CORPORATION OF THE TOWNSHIP OF NORWICH, THE CORPORATION OF THE COUNTY OF OXFORD , RICHARD ALBERT BELL AND LINDA DIANNE BELL

WHEREAS the Municipal Act, 2001, S.O. 2001 as amended, Chapter 25, Section 5(3) states that “A municipal power, including a municipality’s capacity, rights, powers and privileges under section 8, shall be exercised by by-law unless the municipality is specifically authorized to do otherwise”;

AND WHEREAS the Municipal Act, 2001, S.O. 2001, as amended, Chapter 25, Section 8 states that “A municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act”;

AND WHEREAS it is deemed expedient to execute a Preservicing Agreement between The Corporation of The Township of Norwich, The Corporation of the County of Oxford, Richard Albert Bell and Linda Dianne Bell;

NOW THEREFORE the Council of The Corporation of The Township of Norwich hereby enacts as follows:

1.  That the Mayor and Clerk are authorized to execute on behalf of the municipality, a Preservicing Agreement between The Corporation of The Township of Norwich, The Corporation of the County of Oxford, Richard Albert Bell and Linda Dianne Bell, Lots 9, 10, 11 and 12 east of Water Street, Lots 4 and 4¾ south of Son’s Street, Part of Lot 3, and all of Lots 4 and 5 north of Temperance Street, part of Temperance, Son’s and Water Street, Registered Plan 32 (Village of Springford), Part of Lot 21, Concession 9, geographic township of South Norwich, now in the Township of Norwich, County of Oxford, File 32T-06004.

2. That this by-law shall be effective upon the passing thereof.
