Responses to Written Questions

Q1)  In regards to the Exhibit B, can the usage be provided?

A1)  Please see the Exhibit B (REVISED 2/24/11) at the end of this Addendum.

Responses to Verbal Questions

Q2)  Can a vendor offer alternate low cost products besides the ones listed on the Exhibit B?

A2)  No. A prequalification process was conducted to determine the quality of products to be supplied. The County will not accept bids on alternate products.

Q3)  Could a documented carbon neutral production affidavit be an alternative to using a recycled paper? What if the manufacturer were to use virgin cellulose sources such as Acacia? Has the County, been approached about Solaris paper? Will the County consider these products in the future?

A3)  Alameda County has a mandate under voter-approved Measure D to encourage markets for recycled-content products through our purchasing. Other environmental criteria were evaluated in addition to post-consumer recycled content as part of the RFI/PQ process. Only bids on the products specified will be considered.

Q4)  Is the County required to use green products for this RFQ?

A4)  The County has chosen to use green products to fulfill its paper need. All of the items for this RFQ have been prequalified and meet a minimum requirement for post consumer content.

Q5)  What is the advantage of a SLEB bidding as a prime contractor?

A5)  A SLEB prime contractor receives a 10% bid evaluation preference, 5% for being local and 5% for being either a Small or Emerging business. If a prime contractor is not a certified SLEB but is a local vendor, it will receive a 5% local preference, only.

Q6)  Does a certified SLEB vendor need to complete Exhibit E - East Bay Interagency Alliance Application in the bid proposal?

A6)  No. The Exhibit E – East Bay Interagency Alliance application is for new certifications and re-certifications.

Q7)  What is the difference between a small or emerging and a big business for this contract?

A7)  Page 22 of the RFQ, Paragraph V (COUNTY PROVISIONS), Item 2, states:

A small business for purposes of this RFQ is defined by the United States Small Business Administration and must be certified by the County for the following NAICS Code(s): 322121 as having no more than 750 employees and 322291, 423930, 423840 and 424130 as having no more than 500 employees over the last three (3) years. An emerging business, as defined by the County, is one that has less than one-half (1/2) of the preceding amount and has been in business less than five (5) years.

Q8)  How many copies of the bid response are required for this RFQ?

A8)  Page 16 of the RFQ, Paragraph K (SUBMITTAL OF BIDS), Item 3, states:

Bidders are to submit original plus three (3) copies. An electronic copy of the bid must also be enclosed with the sealed bid copies of their proposal. The electronic copy may come in a disk or thumb-drive and must be in MS Word and MS Excel format.

RFQ No. 900683, Addendum No.1 for Janitorial Coarse Paper

The County of Alameda is soliciting bids from qualified vendors to furnish its requirements per the specifications, terms and conditions contained in the above referenced RFQ number. This Bid Acknowledgement must be completed, signed by a responsible officer or employee, dated and submitted with the bid response. Obligations assumed by such signature must be fulfilled.

1.  Preparation of bids: (a) All prices and notations must be printed in ink or typewritten. No erasures permitted. Errors may be crossed out and corrections printed in ink or typewritten adjacent and must be initialed in ink by person signing bid. (b) Quote price as specified in RFQ. No alterations or changes or any kind shall be permitted to Exhibit B, Bid Form. Responses that do not comply shall be subject to rejection in total.

2.  Failure to bid: If you are not submitting a bid but want to remain on the mailing list and receive future bids, complete, sign and return this Bid Acknowledgement and state the reason you are not bidding.

3.  Taxes and freight charges: (a) Unless otherwise required and specified in the RFQ, the prices quoted herein do not include Sales, Use or other taxes. (b) No charge for delivery, drayage, express, parcel post packing, cartage, insurance, license fees, permits, costs of bonds, or for any other purpose, except taxes legally payable by County, will be paid by the County unless expressly included and itemized in the bid. (c) Amount paid for transportation of property to the County of Alameda is exempt from Federal Transportation Tax. An exemption certificate is not required where the shipping papers show the consignee as Alameda County, as such papers may be accepted by the carrier as proof of the exempt character of the shipment. (d) Articles sold to the County of Alameda are exempt from certain Federal excise taxes. The County will furnish an exemption certificate.

4.  Award: (a) Unless otherwise specified by the bidder or the RFQ gives notice of an all-or-none award, the County may accept any item or group of items of any bid. (b) Bids are subject to acceptance at any time within one hundred eighty (180) days of opening, unless otherwise specified in the RFQ. (c) A valid, written purchase order mailed, or otherwise furnished, to the successful bidder within the time for acceptance specified results in a binding contract without further action by either party. The contract shall be interpreted, construed and given effect in all respects according to the laws of the State of California.

5.  Patent indemnity: Vendors who do business with the County shall hold the County of Alameda, its officers, agents and employees, harmless from liability of an nature or kind, including cost and expenses, for infringement or use of any patent, copyright or other proprietary right, secret process, patented or unpatented invention, article or appliance furnished or used in connection with the contract or purchase order.
