AN ACT TO AMEND ARTICLE 9, CHAPTER 1, TITLE 1, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO STATE EMBLEMS, PLEDGE TO THE STATE FLAG, AND OFFICIAL OBSERVANCES, BY ADDING SECTION 11707 SO AS TO PROVIDE THAT THE SOUTH CAROLINA HALL OF FAME LOCATED IN MYRTLE BEACH IS THE OFFICIAL STATE HALL OF FAME, TO PROVIDE THAT THIS OFFICIAL DESIGNATION IS AN HONORARY DESIGNATION THAT DOES NOT BIND THE STATE IN ANY WAY, CREATE A NEW STATE AGENCY OR EDUCATIONAL INSTITUTION, QUALIFY THE SOUTH CAROLINA HALL OF FAME FOR STATE FUNDS, CONFER ANY LIABILITY UPON THE STATE, OR SANCTION BY THE STATE ANY ACTIVITY, PHILOSOPHY, OR COURSE OF ACTION CONDUCTED, PUBLISHED, OR UNDERTAKEN BY THE STATE HALL OF FAME; TO AMEND SECTION 232520, AS AMENDED, RELATING TO THE CREATION OF THE SOUTH CAROLINA LAW ENFORCEMENT OFFICERS HALL OF FAME, SO AS TO PROVIDE THAT THE NAME OF THE LAW ENFORCEMENT OFFICERS HALL OF FAME ADMINISTERED AS AN OFFICE OF THE DEPARTMENT OF PUBLIC SAFETY IS THE “SOUTH CAROLINA LAW ENFORCEMENT OFFICERS HALL OF FAME” RATHER THAN THE “SOUTH CAROLINA HALL OF FAME”; TO PROVIDE THAT CERTAIN REFERENCES TO “SOUTH CAROLINA LAW ENFORCEMENT HALL OF FAME”, “HALL OF FAME”, OR “HALL” SHALL BE CONSTRUED TO MEAN THE “SOUTH CAROLINA LAW ENFORCEMENT OFFICERS HALL OF FAME” ADMINISTERED BY THE DEPARTMENT OF PUBLIC SAFETY, AND TO PROVIDE THAT THE CODE COMMISSIONER IS DIRECTED TO CORRECT ALL REFERENCES IN THE CODE OF LAWS TO CORRECTLY REFLECT THIS NAME; AND TO AMEND SECTION 233460, AS AMENDED, RELATING TO ANNUAL REGISTRATION OF CERTAIN OFFENDERS ON THE STATE’S SEX OFFENDER REGISTRY, SO AS TO PROVIDE THAT THE TERM “ANNUALLY” MEANS EACH YEAR WITHIN THIRTY DAYS AFTER THE ANNIVERSARY DATE OF THE OFFENDER’S FIRST REGISTRATION.

Be it enacted by the General Assembly of the State of South Carolina:

South Carolina Hall of Fame

SECTION 1. Article 9, Chapter 1, Title 1 of the 1976 Code is amended by adding:

“Section 11707. (A) The South Carolina Hall of Fame located in the Myrtle Beach Convention Center, operated by South Carolina Hall of Fame, Inc., an eleemosynary corporation certified by the Secretary of State on June 1, 1963, is the official state Hall of Fame. The official designation is an honorary designation and does not bind the State in any way.

(B) The official designation does not create a new state agency or educational institution or qualify the South Carolina Hall of Fame for state funds.

(C) The official designation does not confer any liability upon the State.

(D) The official designation does not sanction by the State any activity, philosophy, or course of action conducted, published, or undertaken by the Hall of Fame.”

South Carolina Law Enforcement Officers Hall of Fame

SECTION 2. Section 232520(A) of the 1976 Code, as last amended by Act 459 of 1996, is further amended to read:

“(A) The South Carolina Law Enforcement Officers Hall of Fame shall hereafter be administered as an office of the Department of Public Safety.”

References corrected

SECTION 3. References to the “South Carolina Law Enforcement Hall of Fame”, “Hall of Fame”, or “Hall”, as contained in Chapter 25 of Title 23, Section 13090, and Sections 141206, 141207, and 141208 shall be construed to mean the “South Carolina Law Enforcement Officers Hall of Fame” administered by the Department of Public Safety, and the Code Commissioner is directed to correct all references therein to correctly reflect this name.

Definition

SECTION. 4. Section 233460 of the 1976 Code, as last amended by Act 384 of 1998, is further amended to read:

“Section 233460. A person required to register under this article shall be required to register annually for life. For purposes of this article, ‘annually’ means each year within thirty days after the anniversary date of the offender’s first registration. The offender must register at the sheriff’s department in the county where he resides. A person determined by a court to be a sexually violent predator pursuant to state law is required to verify registration and be photographed every ninety days by the sheriff’s department in the county in which he resides unless the person is committed to the custody of the State, whereby verification shall be held in abeyance until his release.

If a person required to register under this article changes his address within the same county, the person must send written notice of the change of address to the county sheriff within ten days of establishing the new residence.

If a person required to register under this article changes his address into another county in South Carolina, the person must register with the county sheriff in the new county within ten days of establishing the new residence. The person must also provide written notice within ten days of the change of address in the previous county to the county sheriff with whom the person last registered.

If a person required to register under this article moves outside of South Carolina, the person must provide written notice within ten days of the change of address to a new state to the county sheriff with whom the person last registered.

A person required to register under this article who moves to South Carolina from another state and is not under the jurisdiction of the Department of Corrections, the Department of Probation, Parole and Pardon Services, or the Department of Juvenile Justice at the time of moving to South Carolina must register within ten days of establishing residence in this State.

The sheriff of the county in which the person resides must forward all changes to any information provided by a person required to register under this article to SLED within five business days.

The South Carolina Department of Public Safety, Division of Motor Vehicles, shall inform, in writing, a new resident who applies for a driver’s license, chauffeur’s license, vehicle tag, or state identification card of the obligation of sex offenders to register. The department also shall inform, in writing, a person renewing a driver’s license, chauffeur’s license, vehicle tag, or state identification card of the requirement for sex offenders to register.”

Time effective

SECTION 5. This act takes effect upon approval by the Governor.
