1. General:
This document provides regional guidance for the development of project Plans & Specifications and associated Bidding Documents. While it is the intent of this guidance to identify and consolidate all required Federal laws, regulations, provisions and executive orders, this guidance should not be construed as being all inclusive of such Federal requirements.
The sponsor shall note that this guidance is intended to assist the Sponsor in the development of Contract documents and does not establish or mandate new requirements. The authority to mandate the Federal requirements provided within resides with the implementing regulation, law, enactment or executive order as established by the legal implementing authority. In the event amendments to existing laws and regulations or enactment, the Sponsor shall adhere to the requirements of the amended regulation or new enactment.
While the Sponsor is permitted to make modifications, additions and variations to the plans, specifications and contract documents, all required Federal clauses, regulations and provisions must be incorporated into the contract documents.
The sponsor shall submit the plans and specifications to the Missouri Department of Transportation’s (MoDOT) Aviation Section for review and concurrence. Typically, we ask that two (2) sets of the 100% package and one (1) set of the “as-bid” package be forwarded to our office. Unique project circumstances or MoDOT’s preferences may dictate that additional sets or information be submitted. At the time of submittal for the “as-bid” package, an executed “Sponsor certification for Plans & Specifications” should be included with the transmittal.

PROJECT PLAN REQUIREMENTS
General -- Use of AC 150/5370-10, Standards for Specifying Construction of Airports, in preparation of plans and specifications is mandatory (Ref: Federal Aviation Regulations - FAR Part 152.11) along with the latest edition of Central Region's revisions to AC 150/5370-10. Several of these specifications have been modified by the MoDOT Aviation Section to require the use of state materials. They are as follows: P-152, P-209, P-401, P-501, P-602, P-603, P-610 and P-701. These specifications are available on the MoDOT Aviation Website at “www.modot.state.mo.us/trans/trans.htm”.
Submittal -- Two sets of the 100% plans and specifications shall be submitted for the initial review. Consult MoDOT Aviation Section for the quantity of sets required for final submittal.
MoDOT Review -- The sponsor shall allow for sufficient time for MoDOT review. In the event of fixed time constraints, the MoDOT aviation section may conditionally approve the package. Such an action is generally appropriate when only minor corrections are required before the project plans are considered complete.

Plans and specifications and wage rate decision may be obtained from the City Clerk of the city of {CITY NAME}, or from the Consulting Engineer upon deposit of $100.00, $50.00 of which will be refunded upon return of plans and specifications, in good condition, within ten days after receipt of bids.

Bid Bond. Guarantee will be required with each bid as a certified check on a solvent bank or a bid bond in the amount of five (5) percent of the total amount of the bid, made payable to the city of {CITY NAME}.
Performance & Payment Bond . The successful bidder will be required to furnish separate performance and payment bonds each in an amount equal to 100% of the contract price.

Section 515 Airport and Airway Improvement Act of 1982. In accordance with the Davis-Bacon Act, as amended, the Contractor will be required to comply with the wage and labor requirements and to pay minimum wages in accordance with the schedule of wage rates established by the United States Department of Labor and attached as a Special Provision, Part A -Federal and State Requirements.
State Wage Requirements. The contractor will be required to comply with the wage and labor requirements and pay minimum wages in accordance with the schedule of wage rates established by the Missouri Division of Labor Standards and attached as a Special Provision, Part A-Federal and State Requirements. The highest rate between the two (Federal and State) for each job classification shall be considered the prevailing wage.

Notice to prospective contractors and subcontractors of nonsegregated facilities. The successful bidder will be required to submit a certification of Nonsegregated Facilities (included in the proposal form) and to notify prospective subcontractors of the requirement for such a certification where the subcontract exceeds $10,000. See Special Provisions 16 & 17 of the Required Federal and State Clauses.

Compliance Reports - Executive Order 11246 as amended. Within 30 days after award of this contract, the Contractor/Subcontractor shall file a compliance report (Standard Form 100) if s/he has not submitted a complete compliance report within 12 months proceeding the date of award. This report is required if the Contractor/Subcontractor meets all of the following conditions:
1. Contractors/Subcontractors are not exempt based on 41 CFR 601,5.
2. Has 50 or more employees.
3. Is a prime contractor or first tier subcontractor.
4. There is a contract, subcontract, or purchase order amounting to $50,000 or more.

Notice of Requirement for Affirmative Action to Ensure Equal Employment Opportunity (Executive Order 11246, as amended). The Offer’s or Bidders attention is called to the “Equal Opportunity Clause” and the “Standard Federal Equal Employment Opportunity Construction Contract Specifications” set forth herein. See Special Provision 15 of the required Federal and State Clauses.

Pre-award Compliance Review. Upon the request of the Department of Labor, a sponsor will not enter into contracts or approve the entry into contracts or subcontracts with any bidder, prospective prime contractor, or proposed subcontractor named by the Department of Labor until a pre-award compliance review has been conducted and approved with a determination that the bidder, prospective prime contractor or proposed subcontractor will be able to comply with the provisions of the Equal Opportunity Clause.

Nonprocurement List. The "Nonprocurement List" is that portion of the "List of Parties Excluded from Federal Procurement and Nonprocurement Programs" compiled, maintained, and distributed by GSA which contains the names and other information about persons or companies who have been debarred, suspended, or voluntarily excluded from participation in Federal programs. An individual or company named in the "Nonprocurement List" may not be awarded a grant, a contract, or a subcontract except as provided in 49 CFR Part 29. Sponsors are encouraged to subscribe to the List through the Government Printing Office (GPO).

Certification Regarding Disbarment, Suspension, Ineligibility, and Voluntary Exclusion. The bidder/offeror certifies, by submission of this proposal or acceptance of this contract, that neither it nor its principals is presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participation in this transaction by any Federal department or agency. See Special Provision 8 of the required Federal and State Clauses
DBE Requirement. The requirements of 49 CFR Part 26, Regulations of the U.S. Department of Transportation, apply to this contract. It is the policy of MoDOT and the city to practice nondiscrimination based on race, color, sex or national origin in the award or performance of this contract. All firms qualifying under this solicitation are encouraged to submit bids/proposals. Awards of this contract will be conditioned upon satisfying the requirements of this section. These requirements apply to all bidders/offerors, including those who qualify as a DBE. A DBE contract goal of (DBE PERCENTAGE) percent has been established for this contract. The non-DBE bidder/offeror shall make good faith efforts, as defined in Appendix A CFR Part 26, to subcontract (DBE PERCENTAGE) of the dollar value of the prime contract to disadvantaged business enterprises (DBE), as defined in 49 CFR Part 26. The bidder/offeror and any subcontractor, who qualifies as a DBE who subcontracts work to another non-DBE firm, must subtract the amount of the non-DBE contract from the total DBE work counted toward the goal, as defined in 49 CFR Part 26.55.
The apparent successful competitor will be required to submit the following information: (1) the names and addresses of DBE firms that will participate in the contract; (2) a description of the work that each DBE firm will perform; (3) the dollar amount of the participation of each DBE firm participating; (4) written documentation of the bidder/offeror’s commitment to use a DBE subcontractor whose participation it submits to meet the contract goal; (5) written confirmation from the DBE that it is participating in the contract as provided in the commitment made under (4); and (6) if the contract goal is not met, evidence of good faith efforts, as described in 49 CFR Part 26.

Foreign Trade Restrictions. The Offeror’s or Bidder’s attention is called to the “Trade Restriction Clause - 49 CFR Part 30 as set forth herein. See Special Provision 7 of the required Federal and State Clauses.
[ Aviation Safety and Capacity Expansion Act of 1990]
Buy American Certificate (Jan. 1991). By submitting a bid/proposal under this solicitation, except for those items listed by the offeror below or on a separate and clearly identified attachment to this bid/proposal, the offeror certifies that steel and each manufactured product, are produced in the United States, as defined in the clause Buy American - Steel and Manufactured Products for Construction Contracts) and that components of unknown origin are considered to have been produced or manufactured outside the United States.
