……………………………………………………………………………….., and I/We have applied for construction of building permission of for proposed Ground, First & Second Floors Residential building and whereas the …………………… Municipal Corporation has provisionally approved the sanctioned plan in respect of premises bearing Municipal B.A.No………………..…whereas, as required under Hyderabad revised building rules issued vide G.O.MA. 179, Dt. 19.05.2011. I / We execute and submit an undertaking affidavit in favour of the commissioner, Municipal Corporation of ………………………….. authorizing initiate appropriate action asper the said G.O. and I am agreeing to abide by the terms and conditions of the said G.O.

And whereas, I/We hereby authorize the Commissioner, MUNICIPAL CORPORATION OF ...... to enforce the terms and conditions of G.O.Ms.No.179 M.A., dt 19.05.2011 incase of violation of the terms and conditions of the sanctioned plan granted / permitted vide permit B.A.No……………Dt………………..to initiate summary demolition proceedings in respect of the violated portion.

And Whereas in compliance of the Hyderabad revised building rules read with G.O.M.S.No.179 M.A., Dt 19.05.2011. I/We do hereby hand over the10%of the total built up area Admeasuring……… Sqmin proposed Second floor (as per schedule given below) to the commissioner, Nellore Municipal Corporation by way this undertaking, in case we violate the terms and conditions of the sanctioned plan.

We hereby authorize the commissioner, MUNICIPAL CORPORATION OF ………………………… to dispose of the 10% of the total built up area Admeasuring.………….. Sqm in the Second floor as the case may be by way of sale after duly removing the violated / deviated portions and if any such action is initiated by the commissioner, MUNICIPAL CORPORATION OF ...... for the violations committed by me/ us, I / We have no objection of what so ever nature.

And whereas we do hereby undertake that as per the sanctioned plan we will leave the prescribed setbacks or open space and the areas left for the road widening and in case of failing to complete those conditions we do hereby authorize the commissioner, MUNICIPAL CORPORATION OF ...... to remove the same at our cost.

And whereas, in compliance soft G.O.Ms.No.179 M.A.,. Dt 19.05.2011. we have obtained a comprehensive building insurance policy as stipulated under the said G.O. and in case of failure in obtaining said policy the commissioner, MUNICIPAL CORPORATION OF ...... is hereby authorize to initiated appropriate action for the violation of said terms and conditions.

As whereas we do hereby undertake that we shall not deliver the position of any part of built up area of the proposed building to constructed by virtue of the provisional sanctioned plan granted by the commissioner, MUNICIPAL CORPORATION OF ……………………… at the site by way of sale/lease unless and until the occupancy certificate is by the commissioner, MUNICIPAL CORPORATION OF ……………………… in case of any violation of said conditions we do hereby authorize the commissioner, MUNICIPAL CORPORATION OF ……………………… initiate proceeding for violation of said conditions accordance with the G.O.Ms.No-179 M.A., Dt 19.05.2011.

We do hereby further undertake that we will comply all those terms and conditions imposed by the commissioner, MUNICIPAL CORPORATION OF ……………………… pursuant to the building application for the proposed sanctioned plan granted to us.

We do hereby solemnly affirm certify that we have executed this affidavit with free will and violation on our own and without there being any duress are undue influence of coercion on the day, month and year herein above mentioned.

Ms. No. 179, Municipal Administration & Urban Development Department dt. 19.05.2011 in the above reference ordered that the owner Builder of the Apartment/ Building is required to hand over 10% i.e. ……………. Sqm in proposed second floor constructed area to sanctioning authority by way of notarized affidavit shall be enters in watching register of registration department as per Para no. ‘C’ in the mentioned G.O.179.

So, I requested the Sub-Registrar, …………………… to enter the notarized affidavit in watch register of your department in favor of Municipal Corporation of ……………………. The said G.O was already communicated to the Commissioner & Inspector of General of Registration and Stamps, Andhra Pradesh, Hyderabad.
