Notice Inviting Tender

No. 6-1(10) Taxi Service/Gen-2012

Sealed tenders are invited from the reputed firms for providing the services of Vehicles (Indigo/Swift/Dzire/Etios) for Fuel Testing Laboratory, Nodia on monthly basis, 1500 km/month (mostly during week days, Monday to Friday) vehicle should not be older than 2010 model. Interested Agencies situated preferably in Noida, may send their quotations (including tax, wages, petrol/diesel etc) for providing above-mentioned services with monthly rates and terms & conditions. In case the taxi runs beyond 1500 km in month the rates for extra kms be also provided. The concerned Agencies dealing with Central Govt. & State Govt. Offices should submit certificate of Income Tax/Service Tax for the last 03 years and annual turnover for the last 02 years alongwith the quotation. The tender papers can be obtained on all working days from General Section, IIP, Dehradun on payment of Tender Fee (non-refundable) of Rs. 200/ in cash between 31.07.2012 to 13.08.2012 during 10.00 a.m. to 3.00 p.m. The agencies have to deposit Earnest Money (Refundable) amounting Rs. 5,000/- only by means of DD drawn in favour of The Director, IIP, payable at Dehradun. Sealed Quotation will be received on or before 13.08.2012 (upto 2.30 p.m.) and opened on the same day at 3.00 p.m. in the presence of Tenders or their authorised representatives. Tenders received without Earnest Money and or requisite documents will not be entertained.

The Director, IIP, Dehradun reserves the right to accept/reject any/all the tenders without assigning any reason thereof. For more details please log on our website www.iip.res.in. The Tender Document can be downloaded from our website also.

CONTROLLER OF ADMINISTRATION

TERMS AND CONDITIONS

1. The Contractor will provide Indigo/Swift/Dzire/Etios up to model 2010 at FTL, Noida (inclusive of Service Tax etc.) per month for 1500 kilometer. Taxi will be provided mostly during week days and as and when required on Saturday and Sunday also. Details rate may be quoted in Annexure ‘A’

2. The cost of petrol Diesel, lubricants, Drivers salary and allowances, depreciation will be borne by the contractor.

3. The vehicle to be provided should have All India permit to undertake journey throughout India, as and when required.

4. The Driver should have a valid license and be medically fit for driving the vehicle and must carry/possess a cell phone.

5. The vehicle should be provided immediately after receipt of written/telephonic intimation with sufficient fuel and sufficient pocket money available with the Driver.

6. Payment will be made on monthly basis on submission of the bill duly certified by the user. As for as possible bills may be submitted during the same months for payment. In case no bill(s) is /are received with in 03 month of the performance of journey it will be presumed that no bills are pending and therefore no payment shall be released.

7. No escalation will be allowed over and above negotiated rates during the tenure of contract.

8. The Driver should be courteous to users, maintain discipline, decorum and well dressed.

9. Records regarding kilometers reading and time start from the residence/place of duty of touring officer to destination and vice versa will be maintained.

10. When this Institute engage vehicles, all liabilities in respect of the Vehicle and drivers including the accident to the vehicle, injury to driver and the passengers traveling in vehicle or to pedestrians and other passing vehicles shall rest with the Contractor. The Institute will not accept any liabilities in this regards.

VALIDITY PERIOD

1. This contract shall be valid initially for a period of one year from the date of entering into agreement but can be extended further by mutual consent. Either party can terminate the contract earlier after giving two months (Sixty days) notice in writing to the other parts without assigning any reason. However, the Director, IIP, Dehradun reserves the right to award the contract for less period also, if circumstances so warrant.

REPONSIBILITY

i)  The contractor will provide Indigo/Swift/Dzire/Etios up to model 2010 at FTL, Noida on the negotiated rates.

ii)  In case it is found that the vehicles supplied are of old model or substandard or spurious, the firm will be liable to be back-listed besides other appropriate legal action to be taken in this regard.

iii)  In case of failure or refusal on the part of the Contractor to supply the vehicles to the FTL/IIP, the contract is liable to be cancelled at the risk and cost of the second party. Any extra cost involved in arranging supply of vehicles from alternative source will be recovered from the contractor.

SECURITY DEPOSIT

The contractor shall deposit Rs. 10000/- as security deposit. The FTL/IIP shall have the right to recover/adjust the Security Deposit towards any loss/damage suffered by the Laboratory due to negligence/non-performance/delay in performance etc, of the Contractor or his representative during the currency of the aforesaid amount due to recovery/adjustment of the losses suffered by the Laboratory during the currency of the Contract, the Contractor shall immediately on demand or the same may be recovered from the Contractor’s pending Bill with the Laboratory.

PAYMENT

The payment will normally be arranged within 04 weeks from the date of presentations of bills. However, no claim shall be made by the contractor against the 1st party in respect of interest or damages in case of payment in delayed for any reason whatsoever beyond 04weeks. The payment will be made through e-payment mode only.

FAULSE CLASUSE

During the currency of the contract, charges for supply of vehicles to any other Central/State Govt. Public Sector Undertaking, etc; should not be at rates lower that the price offered to the Institute of should there be any reduction in charges during this period, the prices charged to the FTL/ IIP shall correspondingly be reduced.

FORCE MAJEURE

Neither the Contractor nor the FTL/IIP shall be liable to the other, for any delay in or failure of, their respective obligations under the control caused by occurrences beyond the control of either party because of fire, floods, acts of God, acts of public enemy, wards, insurrections, riots, strikes lockout, sabotage, any law, statue or ordinance, order, actions or regulations of the Government or any compliance therein similar to the above.

Either party shall promptly notify to the other of the commencement and cessation of such contingency and prove that such in beyond his controls and effects the implementation of this contract adversely.

11. The FTL/IIP shall have absolutely no responsibility to pay any compensation for any accident occurred to any person/representative of the Contractor during his/their to and fro journey and or while attending to the services of the FTL/IIP and not other charges whatsoever shall be payable by the 1st party to the Contractor (2nd Party).

12. The 1st party shall have the liberty to enter into similar contract with any other party(s) engaged in Vehicle Service parallel without making any reference.

TERMINATION OF CONTRACT

The Director, IIP(D) reserves the right to terminate the contract if the Vehicle Service rendered by the Contractor is not found to be satisfactory at an time during the tenure of the contract.

ARBITRATION CLAUSE

i)  In the event of any question, dispute/difference arising under the agreement or in connection herewith (except as to matters the decision of which is provided under this agreement) the same shall be referred to the sole arbitration to DG, CSIR or his nominee.

ii)  The award of the arbitration shall be final and binding on both the parties. In the event of such arbitrator to whom the matter is originally referred is being transferred or vacating his office or resigning or refusing to work or neglecting his work or being unable to act for any reason whatsoever, the Director-General, CSIR shall appoint another person to act as arbitrator in place of the outgoing arbitrator in accordance with the terms of this agreement and the person so appointed shall be entitled to proceed with the reference from the stage at which it was left by his predecessor.

iii)  The Arbitrator may give interim award(s) and /or directions, as may be required.

iv)  Subjected to the aforesaid provisions, the Arbitrator & Conciliation Act, 1996 and the rules made hereunder and any modification thereof from time to time being in force shall be deemed to apply to arbitration proceedings under this clause.
