Amending O. Reg. 667/98

(TRAPPING)

1.Section 13 of Ontario Regulation 667/98 is amended by adding the following subsection:

(3.1)Despite subsection (3), if a trapping licence authorizes the licence holder to trap a species in two or more areas with different open seasons, the licence holder shall complete the information required under paragraph 1 of subsection (2) within 24 hours of the close of the open season that closes the latest in the year and record the date the record was made, verified by the licence holder’s initials.

2.Section 18 of the Regulation is revoked and the following substituted:

18.(1)If a species is listed in Column 2 of Schedule 1 or in Column 2 of Schedule 2, a person shall not use a trap for trapping the species unless,

(a)the trap that is used is set out in Column 3 of the relevant Schedule opposite the species; and

(b)the trap is used in accordance with any conditions set out in section 18.1.

(2)Despite subsection (1),

(a)muskrat may be trapped using traps known as funnel traps if they are set under the surface of the water;

(b)lynx may be trapped using a suspended snare in accordance with this Regulation.

18.1 (1)A person mayset a trap set out in Column 3 of Schedule 1 to trap beaver onlyon land or under water, subject to subsection (2).

(2)A person shall not use a body-gripping trap with a jaw spread greater than 22 centimetres in wildlife management units 60 to 95 except as part of an underwater set used in the trapping of beaver and otter.

(3)The following conditions apply to a person using a trap set out in Column 3 of Schedule 1 or 2 to trap muskrat:

1.If the person is using a jaw-type killing trap or a jaw-type leg-hold trap, the trap must exert clamping force on the animal and be set as a submersion set in a manner consistent with clause 19 (2) (c) or subsection 19 (3).

2.If the person is using any other type of certified killing trap set out for trapping muskrat in Column 3 of Schedule 1, the trap must be set on land.

(4)The following conditions apply to a person using certain traps set out in Column 3 of Schedule 2 to trap lynx:

1.In the case of a person using a trap known as the Oneida Victor #3 Soft Catch, the trap must be equipped with either two coil springs or four coil springs.

2.In the case of a person using a trap known as the Oneida Victor #3, the trap must be equipped with a minimum of 8 mm thick, non-offset steel jaws, four coil springs and an anchoring swivel centre mounted on a base plate.

3.Subsection 19 (4) of the Regulation is amended by striking out “or a species of weasel”.

4.Section 21 of the Regulation is revoked and the following substituted:

21.(1)A person shall release any black bear cub or female black bear accompanied by a cub that the person traps during any part of an open season for bear specified in Table 2 of Ontario Regulation 670/98 that falls within May or June of any year.

(2)In this section,

“cub” means a bear born in the year of the hunt.

5.Subsection 26 (4)of the Regulationis revoked and the following substituted:

(4)Despite clause (1) (a) and subject to subsection (3) and section 17.1, a person permitted under clause 22 (2) (a), (b) or (c) of the Act to use a body-gripping trap may use a relaxing cable restraint to trap wolf or coyote,but shall not do so in an areaduring an open season for deer during which aperson may use or be accompanied by a dog while hunting deer in the area.

6.Schedules 1 and 2 to the Regulation are revoked and the following substituted:
