12.50.010 Membership

The Planning Commission shall consist of up to[C1] seven (7) members, five voting members and two alternate members.The first alternate will have voting privileges only if needed to make up a quorum.The second alternate will also have voting privileges after the first and will be used as a voting member only if needed to make up a quorum.A City official or a member of the City staff will be an ex-officio member and will serve as secretary, having no vote.The five (5) voting members and up to two (2) alternate members will be appointed by the Mayorfrom the duly qualified electors of Hyde Park City with the consent of the City Council.The term of office of each member will generally be for five (5) years, with one term expiring at the end of each year.Each member of the Planning Commission shall serve until the expiration of the term for which appointed, if possible, and until a successor is appointed and qualified.Any vacancy that occurs during the term of any member of the Planning Commission by reason of death, resignation, removal, or disqualification shall be promptly filled by the Mayor and City Council for the unexpired portion of the term.The members of the Planning CommissionMayorwith advice and consent of the City Council shall select from their own members a chairperson and such other officers as deemed necessary. They chairperson will serve a one (1) year terms and may be reselected with no term limits.

12.50.011 Terms of Office

The term of each voting member will generally be for five (5) years, with one term expiring at the end of each year. The term of each alternate member will generally be for four (4) years, with one term expiring every two (2) years. Both voting and alternate members of the Planning Commission shall serve until the expiration of the term for which they were appointed, if possible, and until a successor is appointed and qualified. Standing members may be reappointed, however, no member may serve more than two consecutive terms.[C2]

12.50.020 RemovalFor Cause

The City Council may remove any member of the Planning Commission for cause, after a public hearing upon written charges.if one is requested by the member. The Planning Commission may also recommend to the City Council that a member of the commission be removed from office for failure to attend 3 consecutive meetings without notice during a calendar year.

12.50.021 Vacancy

Any vacancy created by the alternate moving into voting member position shall promptly [C3]be filled in the same manner as the original appointment for the remainder of the alternate’s term.

12.50.030 Members Serve With Compensation

Members of the Planning Commission shall serve with compensation for each meeting attended, the amount set from time to time by the City Council. They may also be reimbursed for reasonable expenses incurred, with the approval of the City Council.

12.50.031 Meetings

During the first meeting of each year the Planning Commission shall adopt a meeting schedule for upcoming year.

12.50.040 Contracts And Employees

The Planning Commission may recommend to the Mayor and City Council such employees, staff, city planners and other consultants as it may deem necessary for its work.The expenditures of the Planning Commission shall be within the amounts appropriated for that purpose by the City Council.

12.50.050 Powers And Duties

The Planning Commission of Hyde Park shall have such powers and functions and shall perform such duties as are prescribed by Utah Code, as amended annually by the Utah State Legislature.Such powers and duties shall include, but shall not be limited to, the submission to the City Council recommendations concerning all proposed changes in ordinances pertaining to zoning as provided in General Provisions (Section 1-4) of theZoning Ordinances of Hyde Park, Utah.The Planning Commission shall have such other powers and duties as prescribed by law.

12.50.060 Record Of Proceedings

A record of proceedings shall be recorded as required by state law.

12.050.070 Rules And Regulations

The Planning Commission shall adopt rules and regulations subject to the provisions of the laws of the State of Utah and theZoning Ordinances of Hyde Park, Utah,and may amend such rules and regulations from time to time.All such rules and all amendments thereof shall be filed with the City Recorder.

12.060.080 Land Use Authority Designations[C4]

The Land Use Designations may be changed from time to time by resolution of the City Council.

[C1]The PZ currently operates with only one alternate. Who decides to fill or leave empty? How long do they have to choose? We have been serving with 6 for some time.
