ORDER:-

In the reference 1st cited the seniority list of ACTOs of Zone-IV for the period from 1975-76 to 1999-2000 was finalized and published. Basing on the ACTOs seniority list, the DCTOs seniority list for the period from 1975-76 to 1996-97 was finalized and published in the reference 2nd cited. As per the instructions issued by the Government vide Memo No.39069/CT.I(2)/2010, dated 04-01-2012, the seniority list of ACTOs of Zone-IV for the period from 1975-76 to 1999-2000 was revised and finalizedin the reference 4th cited. Basing on the said revised seniority list of ACTOs, a show cause notice was issued for revising the seniority list in the cadre of DCTOs of Zone-IV for the period from 1975-76 to 1996-97 vide reference 5th cited.

While preparing the regular panels of DCTOs for the period from 1975-76 to 1996-97 vide reference 2nd cited, the name of Sri C.R.Rajendra, was not included, due to fact that the individual was dismissed from service in ACB case.

The individual, while working as ACTO at Tirupati, was involved in ACB case and a criminal case no. 10/ACBTPT/1994 was registered against him. Subsequently he was convicted under PC Act, 1988 by the Spl. Judge for SPE & ACB Cases, Nellore in C.C. No.12/1994, dated 12-01-2005. The DC (CT), Chittoor vide Rc. No.B1/1440/2003, dated 23-07-2005 dismissed the individual from Government service.

Sri C.R.Rajendra, filed appeal before the Hon’ble High Court of A.P. against the orders of Spl. Judge for SPE & ACB Cases, Nellore. The Hon’ble High Court of A.P. in its judgment dated 03-03-2011, set aside the orders of the Spl.Judge for SPE & ACB Cases, Nellore and acquitted him of the criminal charges.

As per the instructions of the Government vide Memo No. 13247/Vig.I(2)/2004-10, dated 27-05-2011, the individual was reinstated into Government service and joined duty on 10-06-2011 as ACTO. The DC (CT), Chittoor vide Rc. No.B1/261/2011, dated 13-04-2012, treated the suspension period from 27-09-1994 to 08-02-2000 and the dismissal period from 23-07-2005 to 09-06-2011 of the individual as duty period under FR 54-A(3) for all purpose.

In the reference 3rdcited, Sri C.R.Rajendran, Assistant Commercial Tax Officer of Zone-IV has requested to promote him as DCTO on par with his junior and include his name at appropriate place in the DCTO’s seniority list of Zone-IV.

The matter has been placed before the Review Departmental Promotion Committee on 24-11-2012 and the DPC has recommends his name for promotion to the post of Deputy Commercial Tax Officer and accordingly, he was promoted as Deputy Commercial Tax Officer vide CCT’s Ref.DZ(2)/336/2012, dated 26-11-2012. Further, the DPC opined that the name of Sri C.R.Rajendra in the panel year 1993-94 on par with his immediate junior was included on the ground that the individual would have been promoted against the said panel year, but for the criminal proceedings, pending against him as on such date and now disposed of in his favour.

In view of the above, it is proposed to include the name of Sri C.R.Rajendran, in the panel year 1993-94 below the name of Sri C.Damodaram and above the name of Sri P.Pullanna, DCTO (Retired) in the show cause notice, wherein the seniority in the cadre of DCTO’s of Zone-IV was proposedto be revised for the years from 1975-76 to 1996-97 vide in the reference 5th cited.

Therefore, the persons who are likely to be affected (appended as in ANNEXURE) by the said inclusion in the cadre of DCTOs of Zone-IV, may file their written statement of objections, if any, against the above proposed inclusion within 15 days from the date of publication of the notice in Gazette, failing which it would be construed that they have no objection to the proposed revision/inclusions and orders will be passed as deemed fit.
