SECTION 1OVERVIEW

A.Purpose

TheEmploymentDevelopmentDepartment(EDD)WorkforceServicesBranch(WSB)announcestheavailabilityofWagner-Peyser(WP)10PercentGovernor’sDiscretionaryFundsof$2,250,000. Thepurposeofthesefundsistoprovideemploymentandtrainingservicestoindividualsthataredeaforhardofhearing(DHH). ThesefundswillalsoensurethatservicesprovidedtoDHHindividualsareatleastequaltoservicesreceivedbynon-deafandnon-hardofhearing persons.

This programprovidesDHHindividualswithenhancedservices andtraining inselectAmerica’sJobCenterofCaliforniaSM(AJCC)locationsthroughoutCalifornia. Theprogramwillensureeffectivecommunication, increased service opportunities for DHH individuals by providing specialized counseling, interpretive services, job placement, follow-up services, and advocacy,andspecializedtrainingtoassisttheminbecomingjob-ready. Theprogramisalsodesignedtoassistjob-readyDHHindividualsinobtainingandretainingunsubsidizedemployment. TheprogramalsointendsthatinterpretiveservicesbeprovidedtoenabletheseindividualstoreceiveotherEDDrelatedservices.

B.Target Population

ProposalsmusttargetDHHindividualsthatareavailableforandseekingemployment. Thesejobseekersmayalsoneedadditionalskillenhancementtrainingtobecomejob-readyindividuals.

C.Eligible Applicants

Proposalswillbeacceptedfrompublicagenciesorprivatenon-profitcorporations. Individualsarenoteligibletoapply. Applicantsmustclearlydemonstratetheirabilitytoprovideservicestothetargetedpopulation. Applicantsmaysubmitproposalstoprovideservicesforoneormultiplesites. Applicantsmayalsosubmitoneproposaltoprovideservices atmultiple siteswithina targetedgeographicalarea.

D.Program Location(s)

PursuanttotheCaliforniaUnemploymentInsuranceCode (CUIC),Section

11004,theEDDmustdeterminethenumberandlocationofitsofficeswithinthestateprovidingemploymentservicestothedeafandhearingimpairedandshalldecidewhichofficesshallbeservedbygrantees. TheCUICalsostatesthattheEDDshallgiveprioritytoofficeswheresubgrants(contracts)arenecessaryinordertoprevent or minimize the disruption or thediscontinuanceofemploymentservices to thedeafandhearingimpairedthathavebeenprovidedinconjunctionwith the EDDprior to July 1, 1984. In keepingwiththisrequirement,theEDD has identifiedgeographical areas where high concentrations of deaf and hearing-impairedindividualsreside. TheEDDcurrentlyfundsservicesinthegeographicalareaslistedbelowandwill giveprioritytoprogramsandservicesintheselocalestopreventand/orminimizedisruptionin services.

Forthissolicitation,thegranteewillberequiredtoworkamongotherEDDstafflocatedinadesignatedAJCCnetwork. Itisrecommendedthataminimumoftwostaffpersonsbeassignedforthespecifiedcontractedhours. Granteesprovidingareducedstaffinglevelmustprovidewrittenjustificationforthereduction. RefertoAppendixC foralisting ofcurrentsitesand their locations.

Ifanapplicantproposestoserveageographicalareanotlistedabove,theproposalmustclearlyidentifytheDHHpopulationandtheneedforservicesinthatlocaleanddemonstratewhythoseneedsarenotcurrentlybeing met.

E.Funding

ApplicantsmaysubmitoneproposalforonegeographicalareaorformultipleareasinCalifornia. Theapplicationmustfollowtheproposalinstructions. The totalprogramfundingavailable,fortheperiodJuly1,2015throughJune30,2016,willbe$2,250,000.

F.Allowable Use of Funds

TheuseoffundsawardedinthisSFPisgovernedbyWP10PercentGovernor’sDiscretionaryFundguidelines,Stateandfederaldirectives,andtheapplicableuniformadministrativerequirements,costprinciples,andaudit requirementsincludedintheappropriatecircularsorrulesoftheOfficeofManagementandBudget(WIOASection 184[a][2]and [3]).

FundsawardedunderthisSFPcannotbeusedtopurchaserealpropertyortoconstructbuildings.

G.Administrative Cost Limits

Amaximumoftenpercentofthetotalprojectbudgetwillbeallowedforadministrativecosts. Forpurposesofdevelopingabudget,thedefinitionofadministrativecosts isprovidedinAppendixA. AdministrativeCostDefinitions.

H.Length of Project

Thegrantperiodforthisawardis12months,fromJuly1,2015throughJune30,2016. Noobligationorcommitmentoffundswillbeallowedpriortoorbeyondthegrantperiod. Attheendofthegrantperiod,theEDDmayrenegotiatethetermseachgrantinaccordancewithallowableincreasesordecreasesinthegrantee’scostsandgrantee’sdemonstratedabilitytoprovidethespecifiedservices. Anygrantfundsnotexpendedduring agrantperiodmustbereturnedto thestate.

SECTION 2GRANTEEREQUIREMENTS

A.GranteeCriteria

AsrequiredunderSection11003oftheCUIC,thecriteriaforchoosinggranteesshallinclude,butnotbelimitedto the following:

  • Theabilitytoprovideservicesinadeafandhearing-impairedindividual’spreferred mode ofcommunication.
  • Theabilitytosecurecommunitysupport,includingwrittenendorsementsoflocalofficials,employers,LocalWorkforceInvestmentAreasandorganizationsofandforthe deaf and hearing impaired.
  • Theexistence offunding from oneormore public or privatesources.
  • Participationofdeafandhearingimpairedpersonsonthepotentialgrantee'semploymentservicesstaff,andinthecaseofaprivatenonprofitcorporation,onthe board ofdirectors.
  • Acommitmenttothedevelopmentandmaintenanceofself-determinationfordeafandhearing impairedpersons.

B.Staffing Qualifications

ThegranteeshouldprovideaminimumoftwostaffindesignatedAJCC’sforthespecifiedcontractedhours. Granteesprovidingareducedstaffinglevelmustprovidewrittenjustificationforthereduction. Onestaffmustbeaqualifiedsignlanguageinterpreterforthedeaf. Acopyofthestaff’svalidandcurrentComprehensiveSkillsCertificationissuedbytheNationalRegistryofInterpretersfortheDeaf(RID),orequivalentCaliforniaAssociationoftheDeaf(CAD)certificationorothercertificationapprovedbytheEDD,mustbeprovidedtotheAJCCsitemanager. Otherstaffmembersmusthaveademonstrableabilitytocommunicateinsignlanguage.

Thegranteemustprovideservicesduringnormalofficehoursof8:00a.m.through5:00p.m.,MondaythroughFriday,excludingSaturdays,Sundaysandstateholidays. HoursanddaysofservicemustbeonaconsistentscheduleapprovedbytheAJCCsitemanager. Servicesbeyondtheapprovedhoursmustbeapprovedbeforebeingprovided. Overtimepayforsalarieswillnotbeapproved. Onoccasion,however,itmaybenecessaryforstafftoprovidecommunityservicesoutsideoftheoffice. Intheeventofaplannedabsencefromtheoffice,theAJCCsitemanagerordesigneemustreceiveadvancenotificationandrenderapproval. Intheeventofunplannedabsences,thegranteemustnotifytheAJCCsitemanagerwithinonehourofthescheduledworktime. Scheduledhoursofworkandabsencesfromthedesignatedofficearesubjecttothe AJCCsite manager’sapproval.

C.Required Services

As required under Section 11002 of the CUIC, employment services for the deaf andhearing impairedshallinclude,butare notlimitedto,the following:

  • Complete communication services for all preparatory, job placement, and follow- up activities. The communication services shall include interpreter services by a professional interpreter for the deaf and hard of hearing possessing the comprehensive skills certification of the National Registry of Interpreters for the Deaf, or the equivalent, telecommunications, and, when necessary, training in communication skills.
  • Advocacy to assure that DHH individuals receive equal access to public and private employment services.
  • Job development and job placement.
  • Employment counseling, including peer counseling by deaf or hearing impaired individuals.
  • Follow-up counseling and problem solving after placement.

Therankedscoreswillserveastheprimarybasisformakingrecommendationsforfundinginconjunctionwithotherfactorssuchasgeographicdistributionoffunds,uniqueness,andinnovativeaspectsoftheproposal. OnlythoseproposalsdeemedtobemeritoriousandinthebestinterestsoftheEDDwillberecommendedforfunding. TheEDDreservestherighttoconducton-sitereviewsofawardees’businessfacilityprior tomakingfinalfunding recommendations.

B.Notificationof Funding

Followingtheselectionofproposalstobefunded,notificationwillbeplacedontheEDDWebsite. Onlyselectedawardeeswillbenotifiedofthefundingdecisions. TheEDDexpectsthatthefundingawardswillbeannouncednolaterthanJune9,2015.

C.Contracting

TheEDDstaffwillcontacttheawardeestofinalizecontractdetails. Insomecases,EDDmayrequestthatthecontractincorporatechangestotheoriginalprojectproposals. Afterthenegotiations,ifany,theEDDwillmailthesubgrantagreement(contract)totheawardeesforsignature. TheEDDexpectsthecontractnegotiationstobeginimmediatelyfollowingawardsannouncementintimetoallowforaprojectstartdate ofJuly1,2015.

Awardeesareadvisedtoconsiderwhetherofficialactionbyacountyboardofsupervisors,citycouncil,orothersimilardecisionmakingbodywillbenecessarybeforeagreeingtoacceptfundsawardedunderthisSFP. Thetimeneededforsuchofficialactionwill affectthegrantees’abilitytomeetthe projectstartdate.

AllawardeesorgranteesmustcomplywiththesubgrantGeneralProvisionsandStandardsofConduct.

SECTION 8APPEALPROCESS

Aproposalwillbedisqualifiedfornotmeetingtheminimumrequirementsandanappealofthatdisqualificationdecisionmaybefiled. Thereisnoappealprocessfornotmeetingtheproposalsubmissiondeadline. Finalfundingdecisionscannotbeappealed. Theminimumrequirements,whicharelistedinSection6,PartAofthisSFP,arethoseconditionsthatmustbemetinorder fortheproposaltobeforwardedfor evaluationandscoring. SECTION 9ADMINISTRATIVEREQUIREMENTS

A.MonitoringandAudits

Granteeswillbemonitoredand/orauditedbytheEDD,inaccordancewithexistingpolicies,procedures,andrequirementsgoverningtheuseofWPfunds. Granteesareexpectedtoberesponsivetoallreviewers’requests,providereasonableandtimelyaccesstorecordsandstaff,facilitateaccesstosubcontractors,andcommunicatewithreviewersinatimelyandaccurate manner.

Granteesthatareunitsoflocalgovernment,ornon-profitentitiesmustensurethatauditsrequired underOMBguidelinesareperformed andsubmitted whendue.

B.RecordKeeping

Granteeswillberequiredtomaintainprojectandfiscalrecordssufficienttoallowfederal,State,andlocalreviewerstoevaluatetheprojecteffectivenessandproperuseoffunds. Therecordkeepingsystemmustincludebothoriginalandsummary(e.g., computergenerated)datasources. Granteeswillretainallrecordspertinenttothissubgrant(contract)foraperiodofthreeyearsfromthedateoffinalpaymentonthesubgrant.

C.Reporting

GranteesmusthavethecapabilitytoreportexpendituresandoutcomedatatotheEDD,inamanner thatistimely,thorough,andaccurate. Grantees will be required tosubmitoneoriginalandthree(3)copiesofthemonthlyexpenditurereports(invoice)andonemonthlyactivityreportforreimbursement. Thesereportsmustbesubmittedbythe 15thofthe following monthinwhichexpendituresand activitiesoccurred.

  • EXPENDITUREREPORT(INVOICE)

Granteesmustsubmitoneoriginalandthree(3)copiesofthemonthlyexpenditurereportwhichdetailsallexpensesrelatedtooperatingtheDHHProgram,alongwithsourcedocumentationfortheseexpenditures. ThiswillincludeaScheduleforSalaryandWages(ExhibitC),detailedtimerecordsandreceipts. Theoriginalexpenditurereportmustbesignedinblueinkandincludethree(3)additionalcopies.

  • MONTHLYACTIVITYREPORT

GranteesmustsubmitonemonthlyactivityreportwhichdetailstheoutcomedataandperformancerelatedtooperatingtheDHHProgram(PleaserefertoAppendixD)

Thereisanadministrativecostlimitoftenpercentofthetotalfundsawardedunderthiscontract.

Alllocalgrantrecipientsandlowertiersubrecipientsmustfollowthefederalallowablecostprinciplesthatapplytotheirtypeoforganization. TheDepartmentofLabor(DOL)regulationsat29CFR95.27and29CFR97.22identifiesthefederalprinciplesfordetermining allowablecosts thatmustbefollowed.

Althoughadministrativeinnature,costsofinformationtechnologycomputerhardwareandsoftwareneededfortrackingandmonitoringoftheWPprogram,participant,orperformancerequirements;orforcollecting,storinganddisseminatinginformation,are excluded fromthe administrativecost limitcalculation.

InformationmaintainedbytheEDDisclassifiedconfidentialorsensitive.Confidentialinformationisinformationthatidentifiesanindividualoranemployingunit.Sensitiveinformationmaybefinancialoroperationalinformationthatrequiresthemaintenanceofitsintegrity andassuranceofitsaccuracyandcompleteness.Confidentialandsensitiveinformationarenotopentothepublicandrequirespecialprecautionstoprotectitfromlossandunauthorizeduse,disclosure,modification,ordestruction.TheconfidentialinformationobtainedunderthisagreementremainsthepropertyoftheEDD.Subgranteeagreesto the following securityandconfidentialityrequirements:

ADMINISTRATIVESAFEGUARDS

A.AdoptpoliciesandprocedurestoensurethatinformationobtainedfromtheEDDisusedsolelyas provided for in thisagreement.

B.Warrant by executionofthisagreement,that nopersonorsellingagency hasbeenemployedorretainedtosolicitorsecurethisagreementuponagreementorunderstandingforacommission,percentage,brokerage,orcontingentfee.Forbreachorviolationofthiswarranty,theEDDshall,inadditiontootherremediesprovidedbylaw,havetheright to annulthisagreementwithoutliability.

C.Warrantandcertifythatintheperformanceofthisagreement,subgranteewillcomplywithallapplicablestatutes,rules,and/orregulations.AgreetoindemnifytheEDDagainstanyloss,cost,damageorliabilityresultingfromsubgranteeviolationsofthisprovision,includingbutnotlimitedtoconfidentialityrequirementsoutlinedintheCaliforniaUnemploymentInsuranceCode(CUIC)§1094andtheCaliforniaCivilCode§1798et.seq.

F.NotifytheEDDimmediatelyupondiscoverythattheremayhavebeenabreachinsecuritywhichhasormayhavecompromisedtheconfidentialinformation.Forpurposesofthissection,immediatelyisdefinedwithin24hoursofdiscovery.Thenotificationmustdescribetheincidentindetailandidentifyresponsiblestaff(name,title andcontactinformation).

G.AssignsecurityandconfidentialityresponsibilitiesfortheEDD’sinformationtotheassignedstaff.ImmediatelynotifyEDDinwriting ofanydesigneechanges.

USAGE,DUPLICATION,ANDREDISCLOSURESAFEGUARDS

A.Usetheconfidentialinformationonlyfor purposesspecificallyauthorizedunder thisagreement.PursuanttoCUIC§1094(b),useofEDD’sconfidentialinformationasevidenceinanylegalcourtproceeding,fortaxation,orenforcementpurposesisprohibited. PursuanttoCUIC,§1095(t),useofEDD’sconfidentialinformationbyprivatecollection agenciesisstrictlyprohibited.

B.Useand/or extractionoftheEDDinformation foranypurposeoutsidethepurposesstatedinthisagreementisstrictlyprohibited.Theinformationobtainedunderthisagreementshallnotbereproduced,published,soldorreleasedinoriginaloranyotherform.MakingpaperorelectroniccopiesoftheinformationprovidedbytheEDDislimitedtouseswithintheEDDofficespecificallyrelatedtothepurposesofthisagreement.

C.AdisclosureofanyindividuallyidentifiableEDDinformationtoanypersonoutsidethesubgrantee’sstaffisstrictlyprohibited.Exceptasauthorizedorrequiredbylaw,subgranteeshallnotrevealordivulgetoanypersonorentityanyoftheconfidentialinformationprovided bytheEDDduring the termofthisagreement.

PHYSICALSAFEGUARDS

A.StoreEDDinformationinaplacephysicallysecurefromaccessbyunauthorizedpersons.Informationinelectronicformat,suchas magnetictapesor discs,shallbestoredandprocessedinsuchawaythatunauthorizedpersonscannotretrievetheinformation bymeansofcomputer,remote terminal orother means.

B.Secureandmaintainanycomputersystems(hardwareandsoftwareapplications)thatwillbeusedintheperformanceofthisagreement.Thisincludesensuringthatallsecuritypatches,upgrades,andanti-virusupdatesareappliedas appropriatetosecuredatathatmaybe used,transmittedorstoredonsuchsystemsintheperformanceofthisagreement.

C.AvoidsavingtheEDD’sdatatoasharedcomputerharddriveoranyothersharedinformationsystem.Ifthedataissavedtoalocalserveritmustbeencrypted,andshould bestoredin aseparatedirectoryfrom otherdata maintained bysubgrantee

D.Accesstothisdirectory mustberestrictedtoauthorizedstaffassignedtoworkwiththeEDDdata.Ifrecordedonmagneticmediawithotherdata,itshouldbeprotectedas ifitwereinitsentiretyEDDdata.However, suchcommingling ofdataresourcesshould be avoided,ifpracticable.

E.AtnotimewilltheEDDconfidentialdatabeplacedonanindividualdesktoporlaptopor storagemediaof anykind unlessthedataisfullyencrypted.

F.MaintainarecordofauthorizedusersandauthorizationlevelofaccessgrantedtoEDD’s data,based onjob function.

G.DirectallpersonnelpermittedtousetheEDD’sdatatoavoidleavingthedatadisplayedontheircomputerscreenswhereunauthorizedusersmay view it.UsersshouldretrievecomputerprintoutsassoonastheyaregeneratedsothattheEDDdata isnotleftunattendedinprinterswhereunauthorizedusersmayaccess them.

H.DestroyallindividuallyidentifiableEDDinformationwhenitsuseendsutilizinganapprovedmethodofconfidentialdestruction,whichincludeselectronicdeletion(followingDepartmentofDefensespecifications)shredding,burning,orcertifiedorwitnesseddestruction.
