PLAINTIFF’S WRITTEN TESTIMONY

Before me, the undersigned Commissioner/Notary Public, in and for said County and State, personally appeared ______, who is known to me and who, after being first duly sworn, does depose and say as follows:

My name is ______. On or about the ______day of ______, ______, I married ______in ______, County, in the State of ______. Both of us are over the age of nineteen years. I am a resident of the State of Alabama and had been such for more than six months immediately preceding the filing of my Complaint for Divorce. The Defendant is a resident of the State of ______. In the month of ______and year of ______, the Defendant and I separated in ______County, in the State of ______, and we have not lived together as husband and wife since that date.

There are no children of this marriage, and none are expected.

I would like the Court to award me, as my fair share of the property of our marriage, all personal property currently in my possession.

Neither the Defendant nor I own any real property.

I would like the Court to order each party to be responsible only for those debts incurred in each’s individual name, and that the responsible party indemnify and hold the other harmless from any such debts.

The Defendant and I are incompatible to such an extent that it is impossible for us to live together as husband and wife. Our tastes, likes, dislikes, natures, and views about marriage are too widely divergent. There is no possibility of a reconciliation between us, and a happy marital state can no longer exist.

The Defendant and I agree that it would be appropriate for the wife to resume the use of her maiden name.
