Subject: - Limited Tender for running of Canteen services at Sushruta Trauma Centre, for the period 01/05/2008 to 30/04/2009.

Sir,

Sealed quotations are hereby invited for the annual contract for providing canteen services at this hospital at following terms & conditions.

Instruction, terms & conditions in respect to the tender are as under:-

  1. Sealed quotations in prescribed form (Annexure-1) duly filled in must be submitted to The Medical Superintendent, Sushruta Trauma Centre, Delhi, along with Bank Draft/ Pay Order/FDR in favour of D.D.O., Sushruta Trauma Centre, Delhi as EMD for providing canteen services at this hospital latest by 15thApril 2008 at 02.30 P.M At the Office of The Medical Superintendent Sushruta Trauma Centre 9, Metcalf Road, Delhi-54.
  1. The tender form will be Opened on 3rd April 2008 at 10.00 A.M At The Office of The Medical Superintendent Sushruta Trauma Centre 9, Metcalf Road, Delhi-54 by a tender opening committee constituted for this purpose in presence of the tenderers who are present
  1. The tender form should be filled in legible handwriting or typed without any cutting/ over-writing/ erasing.
  1. The tenderers required to be prepared in two respective sealed envelopes as detailed below.

A). Envelope A - (Technical Bid): The envelope should be subscribed as “Technical Bid for Limited Tender for Canteen services” and should contain

  1. Original tender form/downloaded form duly filled and signed on each page.
  2. EMD of Rs.10,000/- (Rupees Ten Thousand only) in the form of Pay Order/Bank Draft / FDR in favour of The D.D.O. Sushruta Trauma Centre. EMD in the form of Post dated Cheque or in any other form will not be acceptable.
  3. UNDERTAKING on a Stamp Paper of Rs. 10/ as per ANNEXURE -2
  4. A copy of the TIN (VAT) registration Number of GNCT of Delhi, if any.
  5. PAN (Permanent Account Number of Income Tax) and Self attested photocopy of last financial year income tax return as a proof.
  6. Details of hospitals/departments where such services have been/are being provided in the last one year and a certificate of satisfactory performance from respective hospital/department issued by competent authority (if any).

B). Envelope B - (Price Bid) – The envelope should be subscribed as “Price Bid for Limited Tender for Canteen services” and should contain

  1. Monthly rates quoted for canteen services in original ANNEXURE -3.
  2. It should also contain the rate list as proposed by the caterer duly signed by him with agency stamp.

Technical Bid, Price Bid envelope & Duplicate Price Bid envelope prepared as above must be kept in a single envelope, subscribed as“Limited Tender for Canteen services at STC”, date of opening, name and address of the tenderer.

  1. Tender will be opened in two phases i.e. Technical Bid & Price Bid. Tenderer who become successful in Technical Bid will only be considered for the Price Bid and the forms of unsuccessful tenderers in technical bid will be summarily rejected.
  1. Tenders not confronting to these requirements will be rejected and no correspondence thereof shall be entertained whatsoever.
  1. The contract shall be awarded initially for the period of One Year (01/05/2008 to 30/04/2009).
  1. The area offered for Canteen services is approx. 100 Sq. ft. in First Floor of Ward block and one Kiosk (Khokha) of approx. 30 sq. ft. at main gate in Sushruta Trauma Centre. The tenderer are advised to visit the site, where canteen site is ready, before participating in the tender. The license fee offered should be quoted in Rupees per month, written in words as well as in figures.
  1. The applicant should possess at least one year experience in Catering/Canteen services. The experience certificate must be attached with the tender.
  1. The tenderer shall submit EMD of Rs. 10,000/- (Rupees Ten Thousand only), in the form of Pay Order/Bank Draft/FDR, pledged in favour of D.D.O. Sushruta Trauma Centre. Any tender without EMD will be summarily rejected.
  1. The tenderer will abide by the Minimum Wages Act and the Contract Labour Act etc. as applicable from time to time for the workers employed by him. Bonus, Gratuity, PF and ESI if applicable will have to be borne by the tenderer.
  1. The price charged for packaged/ ready-made food items, soft drinks etc. should not exceed MRP printed on the items.
  1. The price list of all available cooked items should be displayed, on a Board conspicuously.
  1. There will be separate rate list for staff of STC, which can be quoted 20-30% less then the general tender rates. Item with printed MRP will be exempt from this clause.
  1. THE RATES SHALL REMAIN FIXED FOR THE PUBLIC AND THE STAFF DURING THE ENTIRE PERIOD OF CONTRACT AND SHALL BEEN AS MENTIONED IN THIS TERM & CONDITION FOR CALLING OF TENDER.
  1. The Canteen will PROVIDE ROUND THE CLOCK services with specified Timings for Breakfast, Lunch and Dinner. Tea/ Coffee and snacks etc should be available round the clock. It is the responsibility of the Tenderer to obtain the necessary license from the Competent Authority for running canteen for 24 hours.
  1. The caterer must use commercial L.P.G. for cooking. Contractor will have to arrange L.P.G at his own cost. The cooking on stoves fueled with kerosene oil will not be permitted. Use of Electricity for cooking purpose is strictly prohibited.
  1. All furniture, utensils and Canteen equipments etc. will be arranged by the tenderer.
  1. The tenderer should assess the volume of business by himself. The Hospital will not guarantee any minimum/ maximum business.
  1. Any dues against the customers will be at the risk of the contractor and the GovernmentHospital authorities will not be responsible in any case.
  1. Only sale of cooked/ready-made food items and soft drinks will be allowed. Sale & Service of Alcoholic drinks & Tobacco products are strictly prohibited.
  1. At Kiosk near the parking lot sale of only packed item, cold drinks, samosa etc (not prepared at kiosk) is allowed. The tenderer can prepare tea and parantha only in the kiosk, no other cooking what so ever will be allowed in the kiosk
  1. The Contractor will arrange soap, towel etc. at the washbasin at his own cost.
  1. There is no separate Electricity meter for canteen & Kiosk, the Electricity charges will be paid by the contractor according to the load calculation by Asst Engineer, PWD (Electrical). It will be binding on contractor to pay as per load calculated by Asst Engineer PWD (Electrical). Any damage to Hospital property/ fixtures will have to be rectified/ replaced by the Contractor.
  1. The licensee/contractor will have to present himself before the Medical Superintendent as and when required.
  1. The number of persons employed should be adequate to provide quick, clean and efficient service. The contractor will be responsible for health and injury caused to the workers while working in the canteen.
  1. The dealing of Caterer and his staff with the customers shall be very polite. The contractor will also be responsible for the behavior & conduct of the workers.
  1. All the workers/ employees will have to be medically examined initially at the time of appointment and at the interval of every six months. Only medically fit personnel shall be allowed to work in the canteen. All the workers will wear clean uniforms, to be provided by the Contractor.
  1. The premises of the Canteen shall not be used for any other purpose except canteen services.
  1. The Tenderer/Caterer will keep the said room clean and shall not damage it or allow anything to be done herein which may endanger the room of adjacent building to be damaged by fire and will hand over the said room in good order to Govt. on termination of this contract.
  1. The successful tenderer shall submit security deposit of 10% of the tender amount or Rs. 25,000/- (Rupees Twenty Five Thousand only) (whichever is higher) only in the form of FDR for one year, pledged in favour of D.D.O. Sushruta Trauma Centre.
  1. The security money has to be deposited within seven days of award of the contract otherwise it will be presumed that awardee is not interested in the contract and his EMD will be forfeited and his contract will be terminated. In case of rejection due to failure to deposit Security money the next successful bidder will be offered the contract.
  1. The licensee/ contractor shall deposit the licensee fee in advance for each month on or before the 10th day of each month by way of Bank Draft or Cash in favour of D.D.O., Sushruta Trauma Centre, Delhi-54. After 10th day late payment will be charged @ Rs. 100/- (Rs. One Hundred only) per day. In case, license fee, damages, compensation including any other arrear assessed, not paid within 30 days from the due time, the Medical Superintendent, licensor shall have the right to terminate the license deed without giving any further opportunity. Licensor shall have the right to receive such arrears of revenue under the Public Premises Act.
  1. For any breach of the terms & conditions on the part of the Contractor, the Medical Superintendent will be fully empowered to impose penalty to the extent of Rs. 2000/- (Rs. Two Thousand only) and forfeit the Security money besides termination of the Contract.
  1. The licensee shall abide by the rules/ regulations and orders issued by the Medical Superintendent Sushruta Trauma Centre, Delhi-54.
  1. The Tenderer/ Caterer shall, while the contract is in force, keep a complaint book in a conspicuous place in the said room in which the complaint may be recorded and which shall be open to inspection by persons duly authorized by the Medical Superintendent of SushrutaTraumaCenter, New Delhi
  1. The Security deposit shall be refunded sixty days after the date of completion of the contract only on production of no dues certificate.
  1. The licensee shall not bring or cook/ sale anything which may hurt the religious feelings of any community.
  1. Sub-letting of any kind in any form is not permissible. If found, action will be taken as deemed fit including forfeiting of Security Deposit and termination of the Contract.
  1. Medical Superintendent or any person authorized by him will have the power to inspect the foodstuffs at any time, and if not found worth eating the same shall be discarded and the same would be sent to PFA Laboratory etc. for testing.
  1. The licensee will abide by the Municipal Laws and other laws pertaining to sale of food and other eatables. Necessary license, if required, will have to be obtained by the Contractor. The Tenderer/Caterer shall comply with all the instruction issued to him from time to time by the Govt. of NCT of Delhi/MCD or any other Govt. agency.
  1. A Committees constituted by Hospital authorities will periodically monitor quality of food, Hygienic conditions & medical status of workers in Canteen & any violation of Terms & Conditions of canteen. The licensee/ caterer will have to maintain the standards up to satisfaction of committee and prescribed norms.
  1. The tenderer submitting a tender would be presumed to have considered and accepted all the terms and conditions under the P.F.A. Act and Rules etc. No enquiry verbal or written in r/o acceptance/ rejection of the tender shall be entertained.
  1. Attested photocopies of PAN number/ latest Income Tax clearance Certificate should be attached in the Pre-qualification Bid.
  1. A passport size photograph of tenderer duly attested must be submitted with application. Documents as proof of identity and residence must be submitted along with.
  1. Tenders not supported by all the documents as asked will be rejected.
  1. Amount of License fee quoted per month should be written in words and figures neatly. No cutting or erasing or overwriting would be accepted and in that case tender can be rejected.
  1. The Tenderer/Caterer shall allow the representatives of the Public Works Department (PWD) to enter the premises in order to inspect and execute any structural addition, repairs to the building, Electric, Water and sanitary installation or redecoration which may be found necessary from time to time. The time and date for this purpose will be fixed by the representative of Govt. with due regard to the convenience of the contractor.
  1. After allotment of the contract the successful tenderer before starting of canteen services has to submit within seven working days an under taking on an Stamp Paper of Rs 100/- that he shall abide by all the terms and condition of the agreement and the food /eatables served would be of good quality only.
  1. Name of all the employee working in the canteen shall be provided or by the contactor/Caterer to the hospital and keep it updated.
  1. The contractor shall deploy his own manpower at his cost for providing the canteen services and maintaining the cleanliness of the premises. The hospital shall not provide any manpower/staff for the same.
  1. The contractor shall hire employee of good moral character and get there police verification done on his own. Any complaint regarding behavior of his employees shall be responsibility of the firm. The hospital has the right to ask the contractor for removal of any of his employee if not found competent, orderly or disciplined.
  1. Any person who is in Government service or an employee of this hospital shall not be made partner to the contract by the contractor directly or in the manner whatsoever.
  1. The contractor shall indemnify the hospital against all other damages/charges and expenses for which the government hospital may be held liable or pay on account of negligence of the contractor, of his staff or any other person under his control whether in respect of food poisoning etc, injury to the person or damage to the property of any member of the public or any person or to the equipments and items provided by the hospital or in executing the work or otherwise and against all claims and demand thereof. The hospital shall not be responsible financially or otherwise for any injury to the person deployed by the contractor.
  1. The contractor shall be allowed to commence services only after the security deposit has been deposited, agreement on a stamp paper of Rs. 100/- (Rupees One Hundred only) has been submitted and the undertaking to the effect has been submitted by the contractor. However for all practical & financial purpose the date of starting of contract shall be 01/05/2008.
  1. The contract awarded can be terminated by the hospital at any time without assigning any reason thereof and no compensation shall be payable to the contractor on this account. The hospital shall also have the right to call the next successful bidder from the tender for canteen submitted for financial year 2008-2009 to run the services without undergoing again the process of fresh tendering for the financial year 2008-2009. The decision of The Medical Superintendent shall be final and binding in this regard.
  1. The Medical Superintendent reserves the right to reject any/all tender/ quotations at any time without assigning any reason there of.
  1. On the expiry or earlier termination of this contract the said room/canteen shall be vacated peacefully by the contractor.
  1. The quotations in a sealed envelope subscribed as “ Limited Tender for Canteen services at STC” with separately sealed Technical Bid, Price Bid envelope & Duplicate Price Bid envelopes, should reach the office of Medical Superintendent, Sushruta Trauma Centre Delhi-54 on or before 02:30 PM on 15/04/2008.
  1. The quotation received after scheduled time will not be accepted. The quotation will be opened on 15/04/2008 at 03:00 PM in presence of committee of this hospital and representative of the quoted firms who are available at that time.
  1. The firm quoting the highest license fee and abiding by the terms and conditions of the tender shall be awarded the contract.
  1. In case of any dispute of difference, the award of the Arbitrator appointed by the Lt. Governor of Delhi will be final and binding on both parties and the courts at Delhi/ New Delhi shall only have the jurisdiction over the same.
