CONSIDERATION OF APPROVAL OF A RESOLUTION AUTHORIZING FUNDING OF $500,000 FROM STATE WATER POLLUTION CLEANUP AND ABATEMENT ACCOUNT FOR MONITORING TO ASSESS EFFECTS ON HUMAN HEALTH AND THE AQUATIC ENVIRONMENT FROM DISCHARGE OF AQUATIC PESTICIDES

DISCUSSION

On July 19, 2001, the State Water Resources Control Board (SWRCB) adopted the Statewide General National Pollutant Discharge Elimination System Permit for Discharges of Aquatic Pesticides to Surface Waters of the United States (General Permit). When the General Permit was adopted, the SWRCB directed staff to identify funding mechanisms to conduct monitoring of aquatic pesticides. SWRCB staff presented a status report of these efforts to the SWRCB at its September 5, 2001 Workshop Session.

Staff has identified two immediate activities that require funding to implement a monitoring program:

1.  Development of a Monitoring Program Plan by the San Francisco Estuary Institute—The U.S. Environmental Protection Agency (USEPA) has tentatively identified $115,000 that will be awarded by means of a Clean Water Act (CWA) section104(b)(3) grant to the SWRCB for this purpose.

2.  Implementation of the initial stage of aquatic pesticide monitoring—SWRCB staff recommends that the SWRCB authorize the use of $500,000 from the State Water Pollution Cleanup and Abatement Account (CAA) for this initial effort.

POLICY ISSUE

Should the SWRCB:

1.  Approve the recommended funding in the amount of $500,000 from the CAA to initiate monitoring activities for the purpose of assessing the effects on human health and the aquatic environment from discharge of aquatic pesticides?

2.  Authorize the Executive Director or designee to apply for and accept a Fiscal Year (FY)2001-02 CWA section 104(b)(3) Water Pollution Control Program grant and to negotiate, approve, and/or amend the grant and its workplan.

3.  Authorize the Executive Director or designee to negotiate, execute, and amend contracts funded by CAA and/or a USEPA CWA section 104(b)(3) grants to develop the Monitoring Program Plan and implement the aquatic pesticides monitoring program?

That the SWRCB:

2.  Authorizes the Executive Director or designee to apply for and accept a Fiscal Year (FY)2001-02 CWA section 104(b)(3) Water Pollution Control Program grant and to negotiate, approve, and/or amend the grant and its workplan.

REQUESTING FUNDING OF $500,000 FROM STATE WATER POLLUTION CLEANUP AND ABATEMENT ACCOUNT (CAA) FOR MONITORING

TO ASSESS EFFECTS ON HUMAN HEALTH AND THE AQUATIC

ENVIRONMENT FROM DISCHARGE OF AQUATIC PESTICIDES

WHEREAS:

1.  Aquatic pesticides are discharged into numerous water bodies in the State of California to control nuisance vegetation and pests.

2.  The discharge of aquatic pesticides could impact beneficial uses of waters of the State.

3.  Users of waters that have received the discharge of aquatic pesticides could be exposed to potential health risks.

4.  Waters receiving discharge of aquatic pesticides have not been adequately monitored to assess the effects of the discharge upon human health and the aquatic environment.

5.  The State Water Resources Control Board (SWRCB) and the nine Regional Water Quality Control Boards are responsible for ensuring that the surface waters of the State are safe for drinking, fishing, swimming and supporting healthy ecosystems and other beneficial uses.

THEREFORE BE IT RESOLVED THAT:

The SWRCB:

1.  Approves the recommended funding in the amount of $500,000 from the CAA to initiate monitoring activities for the purpose of assessing the effects on human health and the aquatic environment from discharge of aquatic pesticides.

2.  Authorizes the Executive Director or designee to apply for and accept a Fiscal Year
(FY)2001-02 Clean Water Act (CWA) section 104(b)(3) Water Pollution Control Program grant and to negotiate, approve, and/or amend the grant and its workplan.
