FRANK J. KELLY

Frank J. Kelly was born September 13, 1913, and was killed while serving as2nd Lieutenant, 182nd Infantry in the Battle of Bougainville, Solomon Islands, October 2, 1944. He enlisted in the Pennsylvania State Police, October 1, 1936, and was assigned to Troop “A”, Greensburg, Pennsylvania. He was granted Military Leave August 16, 1942.He was the only member of Troop “A” who was killed in action while serving his country during World War II.Lodge No. 62, which was named in his honor, was organized and chartered on March 1, 1951.

PREAMBLE

WHEREAS:

We, members of Troop “A”, Pennsylvania State Police, are convinced that it is the best interest of all members of this Troop to unite under the name of the Frank J. Kelly Memorial Lodge of the Fraternal Order of Police, and submit to and be guided by the Constitution and the By-Laws of the PennsylvaniaState and National Lodges of the Fraternal Order of Police, and believing that intelligence, industry and normal worth are the standards of greatness do hereby pledge ourselves to use all honorable means to gain better recognition of our profession and greater sociability and fraternity among ourselves and other police.

The Frank J Kelly Memorial Lodge Fraternal Order of Police is not and cannot bedirectly affiliated with any Labor Organization.

This section shall not prohibit cooperative efforts by the Frank J. Kelly Memorial Lodge of the Fraternal Order of Police with labor organizations for their common good.

BY-LAWS

ARTICLE I - NAME

SECTION 1. This organization shall be known as the Frank J. Kelly Memorial Lodge No. 62, of the Fraternal Order of Police, and shall consist of such members as are admitted to membership and conforms to its rules and regulations.

ARTICLE II - CHARACTER

SECTION 1. The Frank J. Kelly Memorial Lodge No. 62 of the Fraternal Order of Police is an organizationof active (Enlisted)and retired Members of the Pennsylvania State Police, and any Member who transfers to another State Police Troop and express’s a desire to remain a member of this lodge.

SECTION 2. The Frank J. Kelly Memorial Lodge No. 62 of the Fraternal Order of Police is a fraternal organization composed of Pennsylvania State troopers who have joined together for their common good. In no event shall we join or be controlled by any other labor organization, provided,however, that this section shall not prohibit cooperative efforts with labor organizations for our common good.

(a) Frank J. Kelly Memorial Lodge 62 may establish a PAC (political action committee) for the betterment of the membership.

SECTION 3. The Frank J. Kelly Memorial Lodge No. 62 of the Fraternal Order of Police shall not strike or by concerted action, cause any cessation of the performance of police duties, or induce others to do so, unless in conjunction with Labor/Management negotiations. The penalty of such action by any Member shall be immediate expulsion from the Lodge.

SECTION 4. The State and National By-Laws shall be the fundamental law of the Lodge, together with these By-Laws enacted in conformance with it,andshall govern the conduct of the Frank J. Kelly Memorial Lodge and all itsmembers.

(a)Where silent, Robert Rules will guide the members and the Lodge.

ARTICLE III – MEMBERSHIP

SECTION 1. There shall be 2 two classes of membership; ACTIVE and HONORARY.

(a)ACTIVE

  1. Shall include enlisted and retired members of the Pennsylvania State Police being in good standing with the Lodge
  2. Only active members of the Lodge, as herein defined, shall a have a voice and vote

(b)HONORARY

  1. Shall be comprised of individuals recognized by the Frank J. Kelly Memorial Lodge 62 for exceptional service or contribution to the nation, the state, or political subdivision, the law enforcement community or the Fraternal Order of Police.

SECTION 2. No person shall be denied membership on account of race, creed, or Sex.

SECTION 3. Any applicant who has been rejected shall not be permitted to submit a subsequentapplication for membership to the Lodge for a period of six (6) months after the date of rejection.

SECTION 4. Any Member dismissed from service of the Pennsylvania StatePolice on sustained charges of commission of a felony, or misdemeanor, or a duly Retired Member convicted of any felony or misdemeanor shall at the discretion of the Executive Board be disciplined or automatically forfeit his/her membership.

SECTION 5. Any Member in arrears of payment of dues or assessments more than thirty (30) days, shall be deemed to be delinquent.

(a) A late fee of five ($5.00) dollars per month will be applied to the amount owed after August 1st. If dues are not paid by August 31st action will be taken to suspend the member in accordance with section 10of this Article.

SECTION6. Any Member delinquent or suspended as provided in Section 4 of this Article, may be reinstated and restored in good standing by the payment of all amounts due and in addition thereto the payment of dues for the whole of the current year in which reinstatement is made.

SECTION 7. Any Member not in good standing or who is suspended from any F.O.P. Lodge, shall not be permitted to attend any regular/special meetings or social function of the Frank J. Kelly Memorial Lodge No. 62.

SECTION 8.

(a) Any member who makes statements or takes actions detrimental to the F.O.P., to any member in said member’s capacity as a brother in the F.O.P., without first pursuing the Lodge’s established methods and ways, shall be suspended from the Lodge, at the discretion of the Executive Board.

(b) No member shall coerce, punish, threaten punishment or cause to be punished, by another member because of said member’s stand on any issue under consideration by the Frank J. Kelly Memorial Lodge 62, Fraternal Order of Police Lodge,norshall any member in any way stop or hinder another member from actively participating in F.O.P. activities. Penalty for violation of these provisions shall be suspension or expulsion from the Lodge, at the discretion of the Executive Board.

SECTION 9. Any member of the Pennsylvania State Police who “LEAVES” from the force with less than “TEN (10)” years of service, automatically forfeits, “ON RESIGNATION DATE” his/her membership in the Fraternal Order of Police, excluding disability

SECTION 10. Any suspension is subject to the member having been sent acertified or registered letter, giving the member an opportunity to return to good standing.

(a) The Certified or registered letter shall be sent to the last known address on file.

(b) The member shall have 15 days to return to good standing after being sent aCertified or Registered letter.

(c) $10.00(Ten Dollar) administration fee shall be assessed the delinquent member in addition to any other cost.

ARTICLE IV - MEETINGS

SECTION 1. The Frank J. Kelly Memorial Lodge of the Fraternal Order of Police, shall have its headquarters in (or in close proximity to) Greensburg, Pennsylvania or in whatever town Headquarters of Troop “A”, Pennsylvania State Police, shall be located.

SECTION 2. The Frank J. Kelly Memorial Lodge shall meet at a time and place determined by the Executive Board.

SECTION 3. Ten (10) members 3 shall be officers, in good standing shall constitute a quorum.

SECTION 4. Partaking of alcohol shall be held off, until adjournment of the meeting or at the discretion of the membership.

SECTION 5. The Frank J. Kelly Memorial Lodge may holdSocial Events forits Active,Honorary and Associate members and may extend invitations to F.O.P. members of other lodges, or any special guest or speakers invited by thepresident or Executive Board.

ARTICLE V - OFFICERS

SECTION 1. The officers of the Frank J. Kelly Memorial Lodge shall consist of a President, Immediate Past President, 1st Vice President, Recording Secretary, Financial Secretary, Treasurer, Sergeant at Arms, Second Vice President and five (5) Trustees.

SECTION 2. The officers of the Frank J. Kelly Memorial Lodge No. 62 shall be nominated at the proceeding meeting to the December meeting of the even year. Candidates shall be listed, as nominated, on printed ballots furnished by the Lodge and the voting to take place at the December meeting. Elected office shall be for two (2) years and any officer may succeed himself to the same office.

SECTION 3. Any officer leaving active duty with Troop “A”, Pennsylvania State Police, with ten (10) years or more service shall not forfeit his office, if going onpension, unless in violation of State Lodge By-Laws Article XXI, Section 3 (a) (1).

SECTION 4. To be eligible to run for office or be a delegate to a convention, a member must have attended at least eight (8) out of the twelve (12) previous meetings to the nominations, or the meeting to be elected as a delegate.

(a) A member who is a transferee into the Troop must also have attended the same number of meetings at his or her previous Lodge.

(b) Exceptions: If working, ill, death or illness in the family, and the member has notified any member of the Executive Board.

(c) The member wishing to be nominated must be present at the nomination meeting, except for exclusion in Sub-Section (b).

(d) Delegates will be elected to the function for each activity of the Pennsylvania Lodge and the Frank J. Kelly Memorial Lodge as required when notification is received. The President and the Secretary of the Lodge are automatically delegates to all F.O.P. functions.

(e) A member may only seek one (1) office position, except Delegate.

(f) Any Officer who misses 3 unexcused consecutive meetings shall forfeit his/her office.

ARTICLE VI - EXECUTIVE BOARD

SECTION 1. The Executive Board shall be composed of the President, Immediate past President, 1st Vice-President, Recording Secretary, Financial Secretary, Treasurer, SECOND VICE PRESIDENT AND SERGEANT AT ARMS. They shall exercise all administrative powers of the Lodge. Any vacancy in any office between elections shall be filled by a vote of the majority of the Executive Board.

SECTION 2. Any officer who leaves active duty, if going on pension, with ten (10) years or more service, as a member of the Pennsylvania State Police, SHALL NOT forfeit their office as a member of the Executive Board unless in violation of Article XXI, Section 3 (a) (1) of the State Lodge By-Laws.

SECTION 3. Any officer may resign their office at any time by submitting a resignation to the Executive Board, in writing. If his accounts are found to be true and correct, the Board may accept the resignation, and if no charges are existing against the officer.

ARTICLE VII - PRESIDENT

SECTION 1. President

(a) Shall be the chief executive of the Lodge. Shall preside at each regular meeting and at special meetings of the Executive Board. Shall have general management of the business of the Lodge and see that all resolutions and order are carried out.

(b) Shall be an ex-officio member of all committees.

(c) Shall have the authority to call special meetings when deemed necessary, or upon petition of the majority of the Executive Board, but shall give ten

(10) days’ notice to such meeting.

(d) Shall convey to the successor all unfinished business of the Lodge.

(e) Together with the Treasurer, shall attest all warrants and vouchers for disbursement from any fund of the Lodge.

(f) Shall appoint Home Association Chairman, in year of election.

(g) Shall have the power, with the advice and consent of the Board of

Directors, to appoint a majority of a committee to inquire into any affair or matter affecting or concerning the Order.

(h) Shall appoint a Chaplin, asan Honorary member.

(I) shall be the voice of the lodge.

ARTICLE VIII - FIRST VICE PRESIDENT

SECTION 1 Shall preside at meetings of the Executive Board in the absence of the President. Shall otherwise generally perform the duties of the President during absences, and shall appoint the minority member(s) of all committees.

ARTICLE IX - IMMEDIATE PAST PRESIDENT

SECTION 1. Shall advise and assist the President and Board of Directors in the performance of their respective duties and shall execute such assignments as may be ordered by either of them.

ARTICLE X - SECRETARY

SECTION 1.Secretary

(a)Shall have custody of all books, records, documents, the seal of the Frank J. Kelly Memorial Lodge, office equipment, and paraphernalia under the general authority of the President and the Executive Board.

(1) Shall purge records as per directions of the Executive Board.

(b) Shall take and transcribe the minutes of a meeting and submit them for approval, correction, or rejection at the next succeeding meeting. The approved minutes shall be in a book of minutes.

(c) Shall attest, under the seal of the Lodge, all duly authorized contracts.

(d) Shall conduct the general correspondence of the Lodge.

(e) Shall be custodian of the constitution and By-Laws of the Lodge and any amendments thereto, as authenticated by the Lodge Seal and the signature of the President in a book of records.

(f) Shall have general charge of all rosters of the membership, membership cards, and the information relative there to, and maintain them, in conjunction with the Financial Secretary in article XVI. Shall give the Financial Secretary the necessary information and tools to maintain the status of the members and the collection of the proper dues and assessments.

(g) Shall within ten (10) days following the term of office, transfer all books, records, documents, paraphernalia, equipment, and the Lodge Seal to the successor.

(h) May use electronic media to communicate Lodge business.

ARTICLE XI - TREASURER

SECTION 1. TREASURER

(a)Together with the President shall attest all warrants and vouchers for disbursement from any fund of the Frank J. Kelly Memorial Lodge

(b) Shall purge records as per directions of the Executive Board.

(c). Shall maintain a book of records listing all items of income and expenditures, and maintain a copy of all vouchers pertaining thereto.

(d). Shall submit a full and complete report, in writing, of official receipts and expenditures made subsequent to each monthly meeting.

(e). Shall present all vouchers and books of record to an accountant for review at the end of each fiscal year and at the end of term of office

(f). Shall deposit all monies belonging to the Frank J. Kelly Memorial Lodge to the credit of the Lodge.

(g). Shall deliver the record book, and all other related papers, to a successor on completion of the review at the end of office term or not later than ten (10) days thereafter.

(h) May use electronic media to communicate Lodge business.

(i) All monies obtained in any manner shall be placed in a fund to be known as the General Fund, in the name of the Frank J. Kelly Memorial Lodge No. 62, Fraternal Order of Police, except legal fund monies.

ARTICLE XII SECOND VICE PRESIDENT

SECTION 1.SECOND VICE PRESIDENT

(a)Shall examine all persons at meetings to determine that they are members in good standing, take up the password, and make a report to the President.

ARTICLE XIII –SERGEANT AT ARMS

SECTION 1. SERGEANT AT ARMS

(a)Shall have charge of the meeting place. Shall permit

only qualifiedpersons toenter or remain and help control the decorum at the meeting.

ARTICLE XIV - CHAPLAIN

SECTION 1. To be appointed by the President as an Honorary Member.

SECTION 2. Shall be responsible for all spiritual activity of the Lodge.

SECTION 3. Shall lead in all prayers, as indicated for usage by the Ritual.

ARTICLE XV - TRUSTEES

SECTION 1. TRUSTEES

(a)Shall have charge and be responsible for all property of the Frank J. Kelly Memorial Lodge, except property as defined ARTICLE X SECRETARY.

(b) Maintain a complete and itemized inventory of all properties and its location.

(c)Recommend amount of bond required by the Treasurer.

ARTICLE XVI - FINANCIAL SECRETARY

SECTION 1. FINANCIAL SECRETARY

(a) Shall have the duty of notifying active, retired, and associate members of all dues or assessments due. Shall have the authority to appoint members of Frank J. Kelly Lodge 62 to assist in the notifying and collecting of any dues or assessments, with the approval of the President.

(b). Shall maintain the active, and associate membership list in conjunction with the recording secretary as per Article X.

(c). Shall collect all dues or assessments due and forward the funds to the treasurer for recording and depositing.

(d). Shall notify members that are delinquent in the payment of dues or assessment as per Article III.

(e) May use electronic media to communicate Lodge business.

ARTICLE XVII - DUES AND ASSESSMENTS

SECTION 1. All activemembers of Frank J. Kelly Memorial Lodge#62 shall pay ayearly due as set forth by the membership in addition to any per capita assessment by the National or State Lodge. The dues and assessment shall be due by July 1st of each year.

SECTION 2. Any new member assigned to the Frank J. Kelly F.O.P. Lodge 62 Area, may make application for membership by submitting an application for membership and pay the yearly dues as set by the membership and the per capita assessment by the National and State Lodge.

SECTION 3. A member transferring from another F.O.P. Lodge to the Frank J. Kelly F.O.P. Lodge #62 shall pay yearly dues as set forth by the membership of Lodge #62 and the per capita assessment by the National and State Lodge, unless the member had paid the current year’s dues to the previous Lodge.
