(1)The Hospice invites tenders for the funfair at The Party in the Park event being held on the 4th July 2015.

(2)Tenders must be in writing and completed on this form and be delivered to the Seller at the address or email address below before Friday22ndMay.

(3)The Hospice shall notify the acceptance of a successful tender to the successful party as soon as practicable.

(4)By participating in this tender you are indicating your acceptance to be bound by the terms and conditions attached to the Tender Form.

(5)As part of the tender process the Hospice makes no obligations in any way to:

  1. pay any Stallholder (as defined on the Tender Form) for any response to the tender; or
  2. to award the contract to the lowest or any bidder; or
  3. accept any information received from any Stallholder; or
  4. include any Stallholders responding to this tender, in any future invitations; or
  5. any other commitment to the Stallholders whatsoever.

(6)The Hospice reserves the right to accept the whole or such part of any tender as the Hospice thinks fit.

Event Information

  • Set up time will be agreed by both parties
  • The Event starts at 12 noon.
  • The event will finish at 5pm weather permitting.
  • Any stallholders leaving their pitch untidy will be charged a £25 tidying fee.

TERMS & CONDITIONS

Note: The definitions in these terms and conditions shall be the definitions used on the Tender Form attached.

  1. The Stallholder agrees to enter into a Contract with the Hospice in accordance with these terms and conditions. The Contract made between the Hospice and the Stallholder shall not exist until the Stallholder confirms their acceptance by executing a copy of these terms and conditions and returning it to the Hospice.
  1. Set up time on the date of the Event shall be confirmed by both parties and has to be set up by 11.30am.
  1. The Event shall start at 12pm and will finish at approximately 5pm or earlier dependent on the weather. The Pitch can only be taken down half an hour before the finishing time.
  1. The stallholder is to provide all their own equipment. The Hospice will not be providing any equipment unless previously discussed
  1. If the Pitch areas are left untidy by the Stallholders then the Hospice reserves the right to charge £25 for cleaning up the area.
  1. The Stallholder warrants that it shall have in place one or more insurance policies to cover all liabilities that may arise from the Stallholder providing the necessary Services on the day of the Event. The Stallholder shall provide a copy of such insurance schedule certificates and risk assessment by Friday 19th June 2015.
  1. Payment for the Pitch shall be paid before the Stallholder is permitted to set up and any amounts donated shall be paid during or at the end of the Event. Cheques must also be cleared at the bank before set up.
  1. The Stallholder shall indemnify the Hospice from and against all demands, claims, proceedings, penalties, fines , damages, legal costs and other expenses of any nature whatsoever arising out of the Stallholder providing the said Pitch and Services as detailed in the Tender Form attached to these terms and conditions.
  1. The Hospice shall have the ability to terminate any engagement of the Stallholder at any time on written notice to the Stallholder and the Hospice shall not be liable for any loss or expenses including legal costs or expenses that the Stallholder may have incurred.

  1. The Stallholder warrants that it has all necessary licenses, permissions and consents and permits and authorities (public and private) required for carrying out the Services at the Pitch and shall indemnify the Hospice and keep the Hospice fully indemnified against all actions, claims, proceedings, costs and damages (including any damages paid by the Hospice on the advice of its legal advisors) and all legal costs and other expenses arising out of any breach of this condition or out of any claim by a third party based on any facts which if substantiated would constitute such a breach. The Stallholder shall provide a copy of such Licences or permissions if requested by the Hospice.
  1. The Hospice shall not incur any liability or in connection with or deemed to be in breach of any agreement with the Stallholder by reason of any delays in, revisions to, or failures in carrying out the Event as a result from circumstances beyond the reasonable control of the Hospice.
