MARKET & PRODUCT RULES
Read the Rules carefully. Violation of Market or Product Rules is cause for suspension or expulsion from the Market. When in doubt, please ask the Manager for clarification.
1. Producer-only. The Producer must raise, grow, produce, catch, or bake everything sold and attend the Market. Producers may not sell items on behalf of, or bought from, any other farm or supplier. The term Producer includes the Primary Applicant’s family and employees when they are directly involved in methods of production.
2. Regional Producers. All goods must be raised, made, grown, produced, caught, or baked in Pennsylvania, Delaware, Maryland, Virginia, West Virginia, or Washington, D.C. (the Region).
3. Producer Types
a) Primary Producer. Produces raw ingredients such as pork, tomatoes, or fish. May make value-added foods (e.g. sausage, tomato sauce, smoked fish) with own major ingredients. Other ingredients (typically produce) must be regional.
b) Secondary Producer. Produces preserves and other products from regional ingredients.
c) Baker. Makes sweet and savory baked goods from scratch. Meat, poultry, dairy products (except butter), eggs, and produce must be regional.
4. Permitted Products. You may sell produce, herbs, eggs, fish and shellfish, meat, game, poultry, dairy products, honey and bee products, beverages, preserves, baked goods, flowers, and plants.
5. Farmstead Milk and Dairy Products. Milk, cream, butter, cheese, yogurt, ice cream, and other dairy products must be made by the Producer wholly from milk raised by the Producer. Meat, eggs, and produce used in dairy products (e.g. quiche) must come from the Region. Farm sources of purchased ingredients must be displayed at Market. Minor ingredients such as spices may be purchased from outside the Region. Grazing animals must have regular access to pasture. You may not use hormones.
6. Farmstead Meat and Meat Products. The Producer must raise animals for meat and meat products. Pigs may be bought in as weaners. Half of the Producer’s lamb and beef must be born on the Producer’s farm. Lamb or beef not born on the Producer’s farm must spend half its life on the Producer’s farm. Dairy products (except butter), eggs, and produce used in prepared meat products (e.g. beef stew) must come from the Region. Farm sources of purchased ingredients must be displayed at Market. Minor ingredients (e.g. spices) may be purchased from outside the Region. Grazing animals must have regular access to pasture. You may not use antibiotics or hormones.
7. Poultry and Eggs. The Producer must raise poultry for meat from day-olds. Laying hens may be bought as pullets. Poultry must have adequate room and light indoors, and access to pasture. You may not use antibiotics.
8. Fish and Shellfish. The Producer must raise or legally catch fish and shellfish and hold the appropriate license. Prepared foods (e.g. fish pie) must be made exclusively from the Producer’s catch. Dairy products (except butter) eggs, and produce used in prepared foods must come from the Region. Farm sources of purchased ingredients must be displayed at Market. Minor ingredients (e.g. spices) may be purchased from outside the Region.
9. Beverages. The Producer must press, mix, and mature drinks including tea, wine, beer, and fruit and vegetable juices from ingredients the Producer grows. Minor ingredients (e.g. spices) may be purchased from outside the Region. On request, Producers may use an outside press for cider and juice made exclusively from the Producer’s fruit. You must be able to show that the cider you sell is pressed exclusively from the fruit you grow.
10. Plants and Flowers. Producers must grow or legally gather plants (cut or potted) for decorative, culinary, or medicinal use.
11. Baked Goods. Bakers must make baked goods from scratch. Meat, dairy products (except butter), eggs, and produce in baked goods must come from the Region. Farm sources of purchased ingredients must be displayed at Market. Minor ingredients (e.g. spices) may be purchased from outside the Region.
12. Preserves, Pickles, and Chutneys. Secondary Producers must make preserves and other approved products from scratch. Major ingredients, such as raspberries for jam, must come from the Region. Farm sources of purchased ingredients must be displayed at Market. Minor ingredients (e.g. spices) may be purchased from outside the Region.
13. Prohibited Ingredients. Products may not contain MSG, hydrogenated fats or oils, high fructose corn syrup, or artificial flavors and colors.
14. The Manager will determine what products are permitted. Items not listed here are prohibited except by explicit permission of the Manager. Items not listed on the Producer’s application are prohibited except by permission of the Manager.
15. Producers shall not sell before or after Market hours.
16. Producers agree to accept WIC and Senior FMNP coupons, $1 EBT tokens and $5 Market tokens. Other incentive program tokens may be introduced. Mount Pleasant Farmers’ Market promises to reimburse farmers promptly for tokens.
17. Each Producer is responsible for complying with all laws and regulations regarding the production, preparation, labeling, display, storage, and sale of goods. Producers shall provide copies of all relevant inspection reports.
18. Each stall shall be tidy and attractive. Producers must bring a broom and dust-pan to Market, clean thoroughly, and take all Market waste and unsold produce home. Producers may not use public trash cans for any purpose. Producers will be liable for clean-up costs.
19. Each stall will be safe and secure. Tables will be solid and sturdy. Shade structures, pop-ups, shelters will be weighted at each leg with a minimum of 25 lbs, or lashed securely to immoveable structure.
20. Producers shall post clear, legible, and visible signs with the following information:
a) Farm or business name & location
b) Product names & prices
c) Information about methods of production
d) Farm sources of purchased regional ingredients
21. Producers shall not smoke or play the radio or music on the Market site during Market hours.
22. Mount Pleasant Farmers’ Market may make unannounced and scheduled visits to places of production to verify compliance with the Producer-only rule. Refusal to permit reasonable visits to a property will result in suspension or expulsion from the Market.
23. Failure to attend Market without adequate notice will result in a $50 fine. Repeated unexplained absences may result in suspension or expulsion.
24. Each Producer must hold liability insurance with coverage of at least $1 million per occurrence and $2 million in aggregate. Each Producer agrees to defend, hold harmless and indemnify Mount Pleasant Farmers’ Market and its agents against any and all claims, losses, damage, injury, costs, charges, liability, or exposure arising from the Producer’s participation in the Market.
25. Producers shall report gross sales accurately and pay Market fees promptly on request. Producers shall email or mail sales figures weekly after each Market, and pay 7% Market Stall Fee, (Capped at $140), weekly or monthly.
26. The Manager’s decision on these rules and all other matters concerning the Market is final.
