The SAMSA surveyors do NOT replace the owners and crew in matters of safety and their main function is to ensure that the owner, master and crew are in fact making reasonable efforts to apply regulations and maintain safety standards.


To assist vessel owner/owners representative to manage safety aboard and to demonstrate that management is playing its part, the following checklist has been compiled for your assistance and guidance. (Please note that it is not a complete list but covers the main issues.)

FISHING VESSELS - CLASSX

(over 25 GT to 100 GT)

A fishing boat, sealing boat or whaling boat; or a vessel which is employed or owned for the purpose of fishing for financial gain or reward to which section 68(1)(a) of the Act applies.

LOCAL GENERAL SAFETY SURVEY

IMPORTANT NOTICE - SAFE ACCESS

1.DOCUMENTATION

STABILITY STATEMENT
(MSA Sect 226)
(S of N reg 7)
(M-Notice 6 of 2000) / Vessels coming on to the SA register after 01 April 1995 are required to have a SAMSA approved stability statement on board. Vessels registered prior to 1995 which are so altered to affect their stability are also required to have an approved stability statement on board. Any special operating instructions must be posted in the wheelhouse and in the engine room, if appropriate.
EXPIRY DATE : / COMPASS DEVIATION CARD/BOOK (MSA Sect 228 &
S of N Reg 13 & 14) / The validity of a deviation card is one year. A compass deviation book may be maintained in lieu of having the compass swung annually by a qualified compass adjuster.
NAUTICAL CHARTS AND PUBLICATIONS
(S of N reg 15) / The charts are to be corrected and up to date (if uncorrected < 5yrs old) for the area of operation. Valid tide tables must be on board as well as the SA Sailing Directions Volume I-IV (or BA pilotage books), a valid Almanac, a List of Lights and Radio signals for the area of operation and an International Code of Signals book.

(LSA Reg 25) / The annual inspection/service certificate needs to be on board and may be sighted by the surveyor.

(LSA Reg 118) / The annual inspection/service certificate needs to be on board and may be sighted by the surveyor. Servicing of appliances must be carried out by a SAMSA approved DOTFAS station.

(ConstReg 159) / If a gas stove is fitted, an annual service certificate must be on board and may be sighted by the surveyor.

(MOS Reg 5) / The surveyor may want to sight each crew members medical certificate. A current certificate of inspection (validity = 1 year) from a Doctor or Pharmacist on board as well as the Ship Captains Medical Book.

OCCUPATIONAL SAFETY
(MOS reg 4) / 4(a).Whereentryintoenclosedorconfinedspacesareallowed,anoxygen meter and gas detector, appropriate to the hazard likely to be encountered, must be on board thevessel.
4(b). Such testing devices must be maintained in good working order, regularly serviced and calibrated according to manufacturers’ requirements. (Where entry into confine spaces are not planned, no equipment is required and no enclosed space entry is allowed without prior testing of enclosed spaces)
OCCUPATIONAL SAFETY
(MOS 39A / 39A. (1) The owner shall, at intervals not exceeding three months, audit the arrangements for ensuring compliance with these regulations in respect of its vessels to ensure that they are implemented effectively.
-The record of each audit (for the last three years) to be onboardthe vessel.
-Owners audit reports, safety officer/appointee and official logbook records shouldmatch.
CREW LIST
(LSA Reg 46) / A list containing the name and address of each person on board the vessel must be kept on board. This list must be maintained up to date.
RECORD BOOK (MOS Reg 3a) / Accidents, near miss, investigations are to be recorded and SAMSA to be informed.
GARBAGE PLACARD
Reg.9 Annex 5 Marpol / Required on all vessels > 12m in overall length. A placard displayed in a prominent place, describing the garbage disposal requirements in force.
GARBAGE PLAN
Reg. 9 Annex 5 Marpol / Required on all vessels certified to carry 15 persons or more; there must be a designated person responsible for implementation.

(CollRegs Rule 26, 27, 30) / - 3 x black spheres able to be rigged to show vessel Not Under Command, At anchor or Aground (dmin = 400mm).
- 1 x fishing signal (2 cones - apexes together).
DEPTH (S of N Reg 59) / - An echo sounder or lead (min 7 lb) and line (min 45m) is required.
DIRECTION
(S of N Reg 13 & 14) / -1xmagneticcompasscapableoftakingterrestrialbearings.Ifthisisnotpossible,ahand bearing compass must beprovided.
-A compass deviation book should be maintained by the master. If this book is not maintained to the satisfaction of the surveyor or if the compass deviation is regarded as excessive,thecompassmustbeswungannuallybyaqualifiedcompassadjuster.

4.LIFE-SAVINGEQUIPMENT

-1 life buoy fitted with a light is to have a Dan buoyattached..

5.ANCHORS

6.ACCOMMODATION ANDGALLEY

(MSA Sect 161) / Adequate stowage for clothing and personal effects must be provided. Spares, stores, etc may not be stored in the crew accommodation spaces.

8.ENGINE ROOMREQUIREMENTS

(ConstReg 155) / - Exhaust pipes and silencers of internal combustion engines are to be efficiently cooled, lagged or installed in such a manner that they do
not create a fire hazard (Lagging, if used, must be impervious to oil or coated so that it is impervious to oil).
ROTATING PARTS
(ConstReg 155) / - Guards are to be provided for all rotating shafts and drive belts which could cause injury to crew under normal operating conditions.
VENTILATION
(ConstReg 165 & 170) / -Aminimumof2ventilatorsmustbeprovidedforenginerooms.
-Efficientclosingarrangements(flapsorplugs)mustbeprovidedfor theventilators.
-Remote(Outsideengineroom)stoppingarrangementsmustbe provided for any inlet/exhaust fansfitted.
HULL FITTINGS
(ConstReg 158) / - All suction and discharge pipes passing through the hull, below the weatherdeck, are to be fitted with accessible isolating valves located as close to the hull as possible (Not applicable for pump discharges of
38mmlocatedabovetheloadwaterlineandkeelcoolingsystems). Thesev/v’smustbedismantledevery2years,attheHullsurvey,and maybetestedinplacebythesurveyoronalternateyears.
FUEL TANKS / -If the tank capacity is greater than 100 litres, filling pipes must lead tothe
(ConstReg 157) / weatherdeck with screwed plug arrangements for closing. The minimum allowable filling pipe diameter = 38 mm.
-Aventpipeofatleastthesameinternaldiameterofthefillingpipemustbe provided.
-Means must be provided to ascertain the tanklevel.
-Vent pipes are to be fitted with anti-flashback gauze. dmax= 0.5mm of non-corrosivematerial.
-Shut-off cocks are to be provided at all tank outlets which can be closed locally and from a remote position (not required if suction line is not gravity fed).
STEERING GEAR
(ConstrReg 169 & 188) / -Anefficientsteeringandemergencysteeringarrangement,whichcan be rapidly brought into action, isrequired.
-By-passarrangementsaretobefittedonhydraulicsteeringsystemsto prevent hydraulic locks when the emergency steering arrangement is brought intooperation.
-Communicationbetweenthebridgeandsteeringflatmustbepossible.
BILGE PUMPING ARRANGEMENTS
(ConstReg 156) / -1 x Main Engine driven pump plus 1 x power driven or handoperated pump (must be power driven for pelagicvessels).
-Hand operated pumps are to be capable of being operated abovethe maindeck.
-TheMainEnginedrivenpumporhandpump(s)maybereplacedbyan independent powerpump.
-Bilge arrangements are to be provided for the draining of all watertightcompartments.
-Non-return or L-cocks are to be fitted in the bilge suction linesto prevent flooding from the sea into thevessel.
-Audible and visible bilge alarms for machinery spaces, which are not normallymanned,mustbeprovidedintheengineroomandwheelhouse

9.WATERTIGHTINTEGRITY

INTEGRITY
(S of N Reg 7) / Theas-designedwatertight/weathertightintegrityofallbulkheads,doorsand hatches must be maintained. The surveyor may require that the watertight integrity of doors or hatches be proven by hose test or other suitable means. WATER ON DECK
(ConstReg 164) / Adequate freeing ports and scuppers must be fitted to allow for the rapid clearingofwaterinallconditions.Freeingportarrangementsmustbesuchthat persons are not able to pass throughthem.
RAILINGS/ BULWARKS
(ConstReg 164) / Guard rails, stanchions and bulwarks must be in good condition and freeing ports must not have been welded closed.
DOOR SILLS
(ConstReg 163) / A minimum sill height of 305 mm is required on the main deck and 152 mm on the Superstructure decks.
SAMSA recommends a sill height of 600 mm for accesses on the main deck which lead below.
SIDE SCUTTLES
(ConstReg 163) / Sidescuttlessituatedbelowthemaindeckoronspaceswhichformpartofthe enclosedvolumeabovethemaindeck(eg1sttierofsuperstructure,focsle)are to be provided with efficientdeadlights.

10.ELECTRICAL

CREWS AGREEMENTS

Department of Labour endorsed Bargaining and Statutory Council agreements are accepted as alternatives if these agreements contain as a minimum the required information as per MSA sections amended.

ANNEXURE: CREW’S AGREEMENTS

Merchant Shipping (Amendment Act), 2015.

APPLICATION : (1) South African ship that is registered or licenced in the Republic.

Nature and duration of intended voyage or engagement, Particulars of deck lines or load lines –if applicable, number and description of crew, time the seafarer is to be on board and capacity on board.

Read with Sections 111A (leave and formula for calculation), Section 114 (right to repatriation) / Crew’s agreements to contain the following additional amended information:
Particulars of wages each seafarer is to receive, to include basic wages, leave, allowances, bonuses and commissions.
Amount of seafarer’s annual leave including formula used to calculate.
Health and social security benefits.
Right to repatriation.
Reference to any collective bargaining agreement.
Minimum notice periods.
MSA Section 102 (5)(b) / If there is a collective bargaining agreement on board a fishing vessel covering the wages and conditions of employment of a seafarer agreed to under a registered Bargaining Council or Statutory Council, then the terms of agreement shall apply to the seafarers an board.
MSA Section 121 / Crew’s payments to be received on a regular basis. Periods between payments not to exceed 45 days.
MSA Section 130 / Seafarers have the right to leave allotment notes ashore for payment of part of wages to be paid to a designated person ashore.
