UNDERSTANDING EMERGENCY DETENTION

& CIVIL COMMITMENT OF MINORS IN OKLAHOMA

Program Purpose

This training focuses on developing a better understanding of statutory and constitutional requirements for civil commitment, and provides a summary of Emergency Detention (ED) and involuntary commitment processes for children.

This is an excellent basics or refresher course for ODMHSAS staff, law enforcement officials, providers of behavioral health care and domestic violence and sexual assault services, criminal justice entities, attorneys who handle mental health cases, consumers, their families, and advocates.

Program Objectives

Upon completion of the program, the participant shall be able to:

1.  Identify the primary sources of commitment law and discuss

2.  Discuss the criteria for emergency detention of children.

3.  Explain an understanding of the constitutional and statutory constraints surrounding emergency detention and involuntary commitment.

4.  Examine the dilemmas facing mental health treatment providers and law enforcement when determining whether to involuntary confine an individual.

5.  Learn the emergency detention process for children.

6.  Demonstrate ways to avoid liability exposure.

7.  Restate and discuss recent legislative changes impacting mental health law.

Continuing Education Credits

The Oklahoma Department of Mental Health and Substance Abuse Services, Institute for Mental Health and Substance Abuse Education and Training, is accredited by the Oklahoma State Medical Association (OSMA) Council on Medical Education to sponsor continuing medical education for physicians.

The DMHSAS Institute for Mental Health and Substance Abuse Education and Training has applied for 3 credit hours in Category I of the Physician’s Recognition Award of the American Medical Association for this medical education activity.

Continuing education credit hours have also been applied for through the Oklahoma State Board of Licensed Social Workers, the Licensed Professional Counselors Committee, Council on Law Enforcement Education and Training, and the Oklahoma Board of Examiners of Psychologists. This training qualifies for supervisory training for management staff. Participant evaluation forms must be submitted in order to receive continuing education credit and a certificate of attendance.

Date and Location

The workshop will be held at 1:30 p.m. on March 10, 2005. It will be held in the in the A-B room at the Norman Public Library.

How to Receive Your Certificate of Attendance

Certificates of attendance will be distributed at the end of the workshop. If you are unable to complete the workshop, you may pick up a certificate before you leave which will reflect the actual hours you were in attendance.

Faculty

Durand H. Crosby is General Counsel for the Department of Mental Health and Substance Abuse Services. He graduated in 1992 from the University of Oklahoma College of Law. Mr. Crosby has drafted several legislative bills affecting Oklahoma’s mental health law, including amended changes to the Mental Health treatment of Children’s Act. In addition, he has authored articles and manuals concerning emergency detention, civil commitment, treatment for individuals incompetent to stand trial and confidentiality of behavioral health records.

Dewayne Moore is Deputy General Counsel for the Oklahoma Department of Mental Health and Substance Abuse Services. He graduated from the University of Oklahoma College of Law in 1994. Mr. Moore began his career as an Assistant District Attorney for Oklahoma County. He currently teaches the mental health block for the Oklahoma Council of Law Enforcement Education and Training and has trained law enforcement officers throughout Oklahoma and at the FBI academy in Quantico, Virginia.

Mr. Moore and Mr. Crosby recently had published their article Emergency Detention and Civil Commitment of Children in Oklahoma.
