Deliveries or Performances

F-1 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK

A.  The Contractor shall prosecute all work diligently, begin performance within Ten (10) calendar days after receipt of Notice to Proceed, and complete the entire work ready for use no later than Two Hundred Forty (240) calendar days after receipt of Notice to Proceed.

Notice to Proceed shall not be issued until the Fluor Federal Petroleum Operations LLC (FFPO) Subcontract Manager has received and approved the Performance and Payment Bonds and the Insurance Certificate(s). Upon receipt and approval of the bonds and insurance certificate(s), the Subcontract Manager may issue the Notice to Proceed to the Contractor, officially commencing the Contract Period of Performance. However, the Contractor shall not commence with any on-site mobilization or physical construction work, until the FFPO Subcontract Manager has approved the Contractor's Project Safety and Health Plan, the Contractor's proposed Safety Personnel, and the Contractor’s right to commence with on-site mobilization and physical construction work.

B. All work under this contract shall be scheduled in a manner that will minimize interruptions to any operations system. If any interruptions become necessary, the Contractor shall submit, to the SMTR, a request for such outage, in writing, at least 7 days in advance. The Contractor should note these outages on his Progress Schedule(s), allowing for SPR site operations to plan accordingly.

C. Throughout this solicitation and in any resulting contract, unless otherwise stated, the term "days" is to be interpreted as meaning "calendar days."

D. OTHER CONTRACTS:

FFPO may undertake or award other contracts for additional work at or near the site of the work under this contract. Neither the Contractor nor his employees and lower-tier subcontractors shall not commit any act that will interfere with the performance of work by any other contractor or by Government employees.

F-2 FAR 52.211-12 LIQUIDATED DAMAGES - CONSTRUCTION

(Applicable if the blank in paragraph (A) below is completed with a dollar value.)

A. If the Contractor fails to complete the work within the time specified in the contract, or any extension, the Contractor shall pay the FFPO as liquidated damages the sum of $____N/A______for each day of delay.

B. If FFPO terminates the Contractor's right to proceed, the resulting damages will consist of liquidated damages until such reasonable time as may be required for final completion of the work together with any increased costs occasioned by FFPO in completing the work.

C. If FFPO does not terminate the Contractor's right to proceed, the resulting damage will consist of liquidated damages until the work is completed or accepted.

F-3 ADDITIONAL SCHEDULE CONSTRAINTS

A. The Contractor will not be permitted to block roads that have only a single access without specific approval via the Site Safe Work Permit (Section J, Attachment J-2, Paragraph 3).

When the daily work permit approves blocking roads, the Contractor shall keep one lane open to the maximum extent practical and provide traffic control signs, barricades, cones, and flagmen.

B. When the Contractor must tie into, block, or interfere with any critical system that would prevent the SPR from accomplishing its overall mission of leaching caverns, filling caverns with crude oil, protecting stored crude oil, and being capable of withdrawing crude oil, the Contractor shall plan and execute his work in a manner that all critical systems can be made fully operational within thirteen (13) calendar days after notification that subject systems are again needed. The critical systems include the crude oil, raw water, brine, firewater, electrical power, security, fire protection alarm, and instrumentation and control systems.

C. Off-Site Facilities

1. The Contractor will not be permitted to block private roads without specific written approval by the landowner. A copy of the written agreement shall be submitted to the SMTR prior to commencing work.

2. The Contractor shall not shut off private companies from any operating facilities without prior written agreements with the companies involved. A copy of the written agreement shall be submitted to the SMTR prior to commencement of the work.
