ORDINANCE NO. 280

AN ORDINANCE OF THE CITY OF VALLEY SPRINGS, SOUTH DAKOTA, AMENDING THE ZONING REGULATIONS OF THE CITY OF VALLEY SPRINGS, SOUTH DAKOTA.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF VALLEY SPRINGS, SOUTH DAKOTA, THAT SECTION 3.01.03 ACCESSORY BUILDINGS BE AMENDED TO READ AS FOLLOW:

3.01.03Accessory Buildings

Accessory Buildings. An accessory building is a structure which may be considered customarily incident and similar to the character of uses in residential districts, and which in no way is objectionable or detrimental to the character, intent and purpose of the district. Special requirements for accessory buildings are as follows:

Detached accessory buildings, where permitted by this ordinance may be located in a rear yard, (in the case of corner or through lots, the side yard), but may not occupy, along with other structures, a total of more than 50% of the buildable area, less required yards, and may not exceed 600 square feet in total size. Such accessory buildings may be located no closer than five (5) feet from side lot lines and no closer than five (5) feet from the rear yard line, provided that such buildings are located at least ten (10) feet beyond the rear line of the principal structure. The height shall not exceed twelve (12) feet for buildings three hundred (300) square feet or less and sixteen (16) feet for buildings more than three hundred (300) square feet to six hundred (600) square feet.

The use of siding and roofing materials similar to the primary structure shall be utilized in the construction of accessory structures.

Permits for accessory buildings shall not be issued unless the principal structure has been erected.

Any accessory building which covers more than 144 square feet shall be secured to the ground to prevent the structure from being moved or damaged by winds.

Accessory buildings may not be used for dwelling purposes.

In any district, more than one structure housing a permitted use may be erected on a single lot, provided that yard and other requirements of this ordinance shall be met for each structure as though it were on an individual lot.

All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed. This ordinance shall be in full force and effect from and after its approval, adoption and publication as provided by law.
