TheSecretaryofStateforCommunitiesandLocalGovernment,inexerciseofthepowersconferredbysection240(2)and(7)oftheLocalismAct2011([a]),makesthefollowingOrder:

Citationandinterpretation

  1. —(1)ThisOrdermaybecitedastheLocalismAct2011(CommencementNo.6andTransitional,SavingsandTransitoryProvisions)Order2012.

(2)InthisOrder—

“theAct”meanstheLocalismAct2011;

“the2000Act”meanstheLocalGovernmentAct2000([b]);and

“policeauthority”meansapoliceauthority(inEnglandorinWales)establishedundersection3ofthePoliceAct1996([c]).

ProvisionscomingintoforceinrelationtoEnglandandWalesonthedayafterthedayonwhichthisOrderismade

  1. ThefollowingprovisionsoftheAct(sofarastheyarenotyetinforce)comeintoforceinrelationtoEnglandandWalesonthedayafterthedayonwhichthisOrderismade—

(a)section27,exceptparagraph(k)ofsubsection(6),sofarasitenablesarelevantauthoritytoadoptacodeofconductwhichwilltakeeffectonorafter1stJuly2012;

(b)section28sofarasitenablesarelevantauthoritytomakearrangementsunderwhichallegationscanbeinvestigatedonorafter1stJuly2012;

(c)section29sofarasitenablesamonitoringofficerofarelevantauthoritytopreparearegisterofinterestswhichwilltakeeffectonorafter1stJuly2012;

(d)section31(10)sofarasitenablesarelevantauthoritytomakestandingordersthatwilltakeeffectonorafter1stJuly2012;

Transitional,transitoryandsavingsprovisions

  1. Thefollowingtransitional,transitoryandsavingsprovisionshaveeffect.

Transitionaletcprovisions:standards

  1. —(1)Notwithstandingsection28(8)(b)oftheAct,apersonmaybeappointedbyarelevantauthorityastheindependentpersonundersection28(7)oftheAct,ifthatperson—

(a)isnotamemberorco-optedmemberofthestandardscommitteeoftherelevantauthorityon1stJuly2012;but

(b)hasheldsuchapostatanytimeduringthe5yearsendingon30thJune2012.

(2)Paragraph(1)onlyappliesinrelationtoappointmentsmadebefore1stJuly2013.

(3)Notwithstandingarticle5,theprovisionsofthe2000Act,andanyregulationsmadeunderthem,whicharerepealedoramendedbysections26and237of,andSchedule4andPart5ofSchedule25to,theActcontinuetohaveeffectforthepurposesof—

(a)thebringingofanappealunderregulation21oftheStandardsCommittee(England)Regulations2008([d]);

(b)proceedingsbeforetheFirst-tierTribunalonareferralundersection64(3)(b)or65(4)of the 2000 Act or under regulation 17 of the Standards Committee (England) Regulations 2008 oronanappealunderregulation21ofthose Regulations;or

(c)legalproceedingsassociatedwithproceedingsonareferraloranappeal,

whereproceedingswerecommencedbefore1stJuly2012orrelatetoadecisionbyastandardscommitteemadebefore1stJuly2012.

(4)This paragraph applies where, immediately before the commencement of the provisions referred to in article 5—

(a)an allegation or case that relates to a person who is a member or co-opted member of a relevant authority has been referred to the standards committee of the authority; and

(b)the standards committee has not made a finding in respect of that allegation or case.

(5)In paragraph (4), “standards committee”, “relevant authority”, “member” and “co-opted member” have the same meaning as in Part 3 of the 2000 Act.

(6)Where paragraph (4) applies, the allegation or case shallbe treated as having been made under Chapter 7 of Part 1 of the Act.

(7)Notwithstandingtheamendmentofsections49(6)and83ofthe2000ActbySchedule4totheAct,thosesectionsshallcontinuetohaveeffectintheirun-amendedformforthepurposesofthedefinitionof“relevantauthority”insections92and101ofthe2000Act.

Article2ofthisOrderbringsintoforce,onthedayafterthedayonwhichtheOrderismade,inrelationtoEnglandandWales,thefollowingprovisionsrelatingtostandardsforthepurposesofcertainpreparatorywork:sections27,28,29,31(10),33and35oftheLocalismAct2011, as well as paragraphs 13(1), (2) and 31 of Schedule 4 (repeals relating to standards).Italsobringsintoforceonthesameday,sofarasnotyetinforce,section153(socialhousing:relationshipbetweenschemesandstrategies)andPart31ofSchedule25(repealsrelatingtoLondon(housingandregeneration)).
