Terms and Conditions of Tree Service Contract

Performance by Molina’s tree service LLC

Work crews shall arrive at the job site unannounced unless otherwise noted herein. Molina’s tree service LLC shall attempt to meet all performance dates (weather permitting) but shall not be liable for damages due to delays from inclement weather or other causes beyond our control.

Workmanship

All work will be performed in a professional manner by experienced personnel outfitted with the appropriate tools and equipment to complete the job properly.

Unless otherwise indicated herein, Molina’s tree service LLC will remove wood, brush and debris incidental to the work.

Insurance

Molina’s tree service LLC is insured for liability resulting from injury to persons or property.

Ownership

The customer warrants that all trees, plant material and property upon which work is to be performed are either owned by him/her or that permission for the work has been obtained from the owner Molina’s tree service LLC is to be held harmless from all claims for damages resulting from the customer’s failure to obtain such permission, also will not be responsible for any damage due to the use of heavy equipment on the property, unless otherwise noted.

Terms of Payment

All accounts are net payable upon receipt of invoice. A service charge of 1.5% will be added to accounts not fully paid 7 days subsequent to the invoice date.

If outside assistance is used to collect the account, the customer is responsible for all costs associated with the collection, including, but not limited to, attorney fees and court costs.

Cancellation Fee

Molina’s tree service, LLC kindly requests that the authorizing party provide at least 24 hours advance notice of any full or partial work cancellation. Client agrees to pay a 20% fee of the total proposal if cancellation notice is not received before the requested time.

Acceptance of proposal.

The above prices, specifications and conditions are satisfactory and hereby accepted.

Molina’s tree service LLC is authorized to do the work as specified. Payment of 40% is required prior starting the job, amount due upon completion, unless otherwise noted.

Addendum A

Trees to be removed, including stump grinding:

  • Oak in the front yard
  • Cypress on the west side of the property
  • Two (and only) river birches
  • Tree in far southeast corner of property near the fence
  • Dead elm tree behind the poplar
  • Giant poplar

Trees to try to keep. These trees will be removed as part of this agreement without any additional cost should they be deemed damaged enough to be unsightly or unsafe by either party.

  • Cypress on the east side of the property
  • Maple that wraps the cypress.

Pruning will be done on the maple at the owners discretion.

In addition to normal liabilities, Molina Tree Service, LLC assumes the liability of the driveway at 512 Pace St. If any activity related to the execution of this agreement results in damage to the driveway at 512 Pace St, the damage will be the responsibility of Molina Tree Service, LLC to rectify with the owners of 512 Pace St. A separate signed agreement with the owners of 512 Pace St is attached to this agreement. Under no circumstance will the owners of 510 Pace St be responsible for the property at 512 Pace St or any other surrounding property as it relates to the work executed by this agreement.

Any fencing or property that is moved, removed or modified to complete the work in this agreement, on any property, will be returned or replaced in the same or better quality as it was prior to executing the work in this agreement.
