The review petition has come up for hearing finally on 27-02-2016 in the presence of Sri. T. Vizhay Baabu, learned counsel representing Sri. Challa Gunaranjan, learned counsel for the petitioner and Sri P. Shiva Rao, learned Standing Counsel for the respondents. After carefully considering the material available on record and after hearing the arguments of parties present, the Commission passed the following:
O R D E R
Heard Sri S.V.S.S. Siva Ram, learned counsel representing Sri Challa Gunaranjan, learned counsel for the petitioner and Sri P. Shiva Rao, learned Standing Counsel for the respondents. The Hon’ble High Court in orders in a batch of Writ Petitions on 27-04-2016 set aside the orders of this Commission dated 15-04-2015 in O.P.No.8 of 2015 determining the Cross Subsidy Surcharge and Additional Surcharge for FY 2015-16. In view of the setting aside the orders, proceedings have already been initiated for re-determination of Cross Subsidy Surcharge and Additional Surcharge for FY 2015-16 in accordance with law. As the order which is sought to be reviewed is set aside and ceases to exist, nothing survives in this review petition to be adjudicated by this Commission. Hence, this petition is dismissed without costs as infructuous.
This order is corrected and signed on this the 4th day of June, 2016.
