VILLAGE OF OAKFIELD BOARD OF TRUSTEES
SPECIAL MEETING
January 25, 2012
A Special meeting of the Village of Oakfield Board of Trustees was called to order at 5:30 p.m. by Mayor Rick Pastecki followed by the pledge and prayer. The following Trustees were present: Shelly D’Alba, Dean Joslyn and Joan Stevens.
Others present: Clerk/Treasurer Joyce Grazioplene, Attorney Reid Whiting, Town Justice Tom Graham, Michele Graham, Town Clerk Melissa Haacke, Jeremy Yasses, Town Supervisor Mike Cianfrini, Diane Skelton, Kevin Skelton.
Mayor Pastecki stated that he was advised by our attorney to go into executive session to discuss pending litigation.
A motion was made by Trustee Dean Joslyn, seconded by Trustee Shelly D’Alba and carried by vote of 3-1 to go into Executive Session at 6:40 p.m. to discuss proposed purchase of property and pending litigation. Trustee Joan Stevens voted no.
Supervisor Cianfrini said this was an illegal executive session. The meeting was set for the discussion of purchase of land. Mr. Yasses said he was not leaving. Mayor Pastecki asked on two occasions for those in attendance to please leave. Attorney Reid Whiting said depending on what the Board resolves, there may be information at the end of the meeting. Mr. Yasses said this was not fair to the citizens. All those attending did leave the room.
A motion was made by Trustee Joan Stevens, seconded by Trustee Shelly D’Alba and carried by unanimous vote to close Executive Session at 6:00 p.m.
A motion was made by Trustee Joan Stevens, seconded by Trustee Dean Joslyn and carried by unanimous vote to disengage in any further negotiations with Nathaniel Development and secure a release from Mr. Capwell.
Prior to the vote Attorney Whiting explained to the public that the Board could be facing possible litigation regarding the purchase of property. When they became aware of a developer interested in the property, they began negotiations. At this point, it appears there is no reason for the Village to negotiate with Nathaniel Development – they can negotiate with Mr. Capwell directly. This could eliminate concerns of litigation, and keep the Village out of duel transactions. A development would be beneficial to the Village in increased tax revenue and water customers.
Mr. Yasses apologized to the Board for being rude. He felt they were being left in the dark. Supervisor Cianfrini thanked the Board for doing the right thing.
Having no further business to come before the Board the meeting was adjourned at 6:15 p.m. on motion by Trustee Joan Stevens, seconded by Trustee Shelly D’Alba and carried by unanimous vote.
