EWC STANDING SEAM METAL ROOFS REPLACEMENT PROJECT

Eastern Wyoming College will receive sealed proposals for the EWC STANDING SEAM METAL ROOFS REPLACEMENT PROJECT. Sealed proposals should be delivered to Mr. Clyde Woods, Director for Procurement and Contracts, Eastern Wyoming College, 3200 West C Street, Torrington, Wyoming 82240. No faxed or emailed proposals will be accepted.

Project Description:

The scope of work is generally defined as follows –

1.  Remove all damaged standing seam metal roofing from the Fine Arts North Wing, the Fine Arts South Lobby Area and the Student Center Sunroom;

2.  Dispose of material in accordance with local laws;

3.  Replace with new standing seam metal roofing in the appropriate colors;

4.  All work shall be accomplished in a workmanship-like manner.

Proposal Opening:

Proposals will be received until 2:00 PM, local area time, Tuesday January 7, 2014 in the Eastern Wyoming College Business Office, Room T236, located in the Tebbet Classroom Building. Proposals will be opened and recorded at 2:05 PM, that same day, in the Dolores Kaufman Boardroom, Room T274, located in the Tebbet Classroom Building.

Mandatory Site Visit:

Contractors are responsible for field verification of all measurements and site conditions. Interested contractors MUST attend a site inspection meeting conducted by Mr. Keith Jarvis, Director for Physical Plant. You may contact Mr. Jarvis at 307-532-8255 or by email at , to schedule a meeting.

Project Start Date:

Work for the EWC STANDING SEAM METAL ROOFS REPLACEMENT PROJECT shall commence no earlier than May 12, 2014.

Project Completion Date:

The project must be completed by May 30, 2014.

Request for Proposal (RFP) Documents:

Clarification and Interpretation of RFP Documents:

Project Site Access:

Access to the site will be provided between 8:00 AM and 4:00 PM, local area time, to verify field measurements. Appointments are required and may be scheduled by contacting Mr. Keith Jarvis as indicated above.

Bid Security:

For total bids in excess of $15,000.00, bid security in the amount of five percent (5%) of the base bid will be required in the form of a Bid Bond payable to Eastern Wyoming College. Security will be returned to unsuccessful bidders. The bid security will be retained by the college as liquidated damages if the successful bidder refuses or fails to enter into a contract within ten (10) days after same is let to him, or fails at the time of contract execution to furnish all post-bid submittals including bonds covering the faithful performance of the contract and payment of all obligations arising hereunder.

Addenda:

Each bidder shall verify prior to submitting a bid that the bidder has received all addenda issued, and the bidder will acknowledge their receipt on the bid form. Addenda will be delivered to all who are known by the Project Manager to have received bidding documents.

Submission of Bids:

Bids will be submitted on the bid form shown on pages one and two of this document. Bids will be signed by the prime bidder. Bids by corporations must be signed with the legal name of the corporation followed by the name of the state of incorporation and the signature of an officer of the corporation or person authorized to bind the corporation in the matter. The name of the person signing will be typed or printed below the signature. Any type of erasure, alteration, or change on the bid form must be initialed by the person signing the bid.

Bid forms, and any other documents required to be submitted with the bid will be enclosed in a sealed, opaque envelope and will be clearly marked as follows:

Bids may be mailed, delivered by courier, or delivered in person. No emailed, phone or faxed bids will be accepted. Late bids will be returned unopened to the bidder.

Modification or Withdrawal of Bids:

Bids which modify any of the provisions of the bidding or contract documents will not be considered. A bid that is in the possession of the college may be altered by letter or fax bearing the name and signature of the person authorized for bidding, provided it is received prior to the bid opening time. The letter or fax should not reveal the bid price, but should indicate the addition, subtraction, or alteration of the bid. The modification will be attached to the sealed bid for review at the bid opening. A bid in the possession of the college may be withdrawn at any time prior to the bid opening. After the bid opening, bids may not be modified, withdrawn, or canceled until 30 days after acted upon by EWC.

Consideration of Bids:

Eastern Wyoming College reserves the right to reject any and all bids, waive any informality, and is not bound by the lowest bid, but the bid determined by the College Board of Trustees to be in the best interest of the College. Submission of a bid constitutes agreement to these terms.

The college reserves the right to reject as incomplete, any bid not containing the following information—

Tax Exempt Status:

As a political subdivision of the State of Wyoming, Eastern Wyoming College is exempt from the direct payment of Wyoming sales and use taxes. However, contractors are potentially subject to sales and use taxes when purchasing materials for this project. Sales and use taxes paid by the contractor shall be included within the bid price and shall not be billed separately to the College as an addition to the bid price. Eastern Wyoming College, by this document, offers no advice on the taxable status of a bidder. Each bidder must determine the taxes to which it is subject.

Resident Contractors Preference:

Per Wyoming Statute 16-6-102(a), a preference of up to five percent (5%) of the total bid price will be applied to a resident contractor's bid as compared to a non-resident contractor's bid.

Per Wyoming Statutes 16-6-106 and 16-6-107, "preference is hereby given to materials, supplies, agricultural products, equipment, machinery and provisions produced, manufactured, supplied or grown in Wyoming, quality being equal to articles offered by the competitors outside of the state."

Non -Discrimination Statement:

Eastern Wyoming College prohibits discrimination against its customers, employees, contractors/bidders and applicants for employment on the bases of race, color, national origin, age, disability, sex, gender identity, religion, reprisal, and where applicable, political beliefs, marital status, familial or parental status, sexual orientation, where all or part of an individual’s income is derived from any public assistance program. Performance Bond:

Per Wyoming Statute 16-6-112, should the contract price exceed seven thousand five hundred dollars ($7,500.00), the successful bidder must provide a Performance Bond and a Materials and Labor Payment Bond equal to fifty percent (50%) of the amount of the bid with the Request for Proposal form.

Liability Insurance/Unemployment and Worker's Compensation Insurance:

The successful bidder must provide proof of liability insurance and completed operations coverage at a minimum level of one million dollars ($1,000,000.00) per occurrence naming Eastern Wyoming College as an additional insured.

The successful bidder must provide Certificates of good standing from the Wyoming Department of Workforce Services for Unemployment Insurance and Workers’ Compensation Insurance.

Drug, Alcohol, and Tobacco Policy:

Eastern Wyoming College prohibits the use of drugs and alcohol anywhere on the campus. Smoking is prohibited inside any building and permitted only in designated areas.

Award of Bid and Pre-Construction Conference:

Eastern Wyoming College reserves the right to award contract of base and alternate (if any) on an individual basis; however base and alternate (if any) will not be awarded to different contractors.

A pre-construction conference will be held after award of bids and prior to the start of any demolition or construction. The contractor must provide a definite schedule of work for the project.

The successful bidder will be required to comply with terms and conditions of the bidding instructions, plans, specifications, and contractor’s bid document (RFP submission form). All parties should understand that the terms and specifications contained in these bidding instructions are binding and become a part of the future agreement.

Termination of Contract and Correction of Work:

If the contractor defaults or persistently fails or neglects to carry out the work in accordance with the contract specifications, the college may, after seven (7) days written notice to the contractor, make good such deficiencies and may deduct the cost thereof from final payment due the contractor; or, may terminate the contract and take possession of the site and all materials, equipment, tools, etc, owned by the contractor and finish the work by whatever method the college deems expedient.

The contractor will promptly correct any work rejected by the college as defective or failing to conform to the contract specifications, at any time prior to final payment to the contractor.

Progress Payments:

If the contract price exceeds seven thousand five hundred dollars ($7,500.00), then ten percent (10%) of each progress payment shall be withheld by the college as construction retainage. The retainage will be released to the successful bidder forty-one (41) days after the first date of publication that the project is substantially complete. The contractor is responsible for notifying the Project Manager when the work is substantially complete. Per Wyoming Statute 16-6-704, if the total contract price exceeds twenty five thousands dollars ($25,000.00), the contractor may require the retainage to be paid into an interest bearing account.

Building Permit:

The City of Torrington may require a building permit; therefore, the bid should include the cost of a building permit, if applicable.

Legal Compliance:

The contractor shall comply with all applicable federal, state, and local laws. Note this project is NOT federally funded.

The Bidder hereby certifies that all persons employed by their firm, their affiliates, and subsidiaries of holding companies are treated equally by their firm without regard to or because of race, religion, ancestry, national origin or sex as required by Federal and State anti-discrimination laws. The Bidder further certifies and agrees that it will deal with subcontractors, bidders or vendors without regard to or because of race, religion, ancestry, national origin or sex. Violation of their certification may constitute a material breach of contract upon which the Owner may determine to cancel, terminate or suspend the contract.
