Under the powers delegated to me by the Governance Committee on 30 January 2003, Ihave issued a Written Notice dated 3 September 2010 authorising the carrying out of the above development pursuant to Regulation 3 of the Town and Country Planning General Regulations 1992. Planning Permission is now granted. A copy of the Written Notice is attached hereto.
Therefore, in accordance with Regulation 3 would you please accept this letter in conjunction with the plans shown as formal notification of the development for the purpose of your Register of Planning Applications and Decisions.

TAKE NOTICE that under the powers delegated to me by the Governance Committee meeting held on 30 January 2003 I have authorised the development described in Schedule 1 hereto, pursuant to Regulation 3 of the Town and Country Planning General Regulations 1992, subject to the conditions set out in Schedule 2 hereto.
SCHEDULE 1
Remove part of the existing pergola, relocate summer house, adapt and enlarge the existing brick unroofed veranda into a partly covered play area with a new tensile fabric canopy. Nutley Primary School, High Street, Nutley (Within land edged red on applicants plan no. NUT2509-03)
SCHEDULE 2
1. The development hereby permitted shall be commenced before the expiration of three years from the date of this permission.
Reason: To comply with Section 91 of the Town and Country Planning Act 1990.
2. The development hereby permitted shall be carried out in accordance with the plans listed in the Schedule of Approved Plans.
Reason: For the avoidance of doubt and in the interests of proper planning.
3. No machinery shall be operated, no process shall be carried out and no deliveries taken or despatched from the site other than between the hours of 8.00 am and 6.oo pm on Mondays to Fridays and not at any time on Saturdays, Sundays, Bank and Public Holidays unless otherwise agreed first in writing by the Director of Transport and Environment.
Reason: To safeguard the amenities of the occupiers of properties in the vicinity of the site and to comply with Policy EN27 (2) of the Wealden Local Plan 1998.
4. The materials to be used in the construction of the external surfaces of the extension hereby permitted shall match those used in the existing building.
Reason: To ensure the appropriate appearance of the development in the High Weald Area of Outstanding Natural Beauty (AONB) in accordance with Policies EN27 and EN6 of the Wealden Local Plan 1998.
5. The glass block wall shown on Drawing No. NUT2509-02 Rev A shall not be constructed until full details of the glass blocks (including their colour) have been submitted to and approved in writing by the Director of Transport and Environment. The development shall be carried out in accordance with the approved details.
Reason: To ensure the appropriate appearance of the development in the High Weald Area of Outstanding Natural Beauty (AONB) in accordance with Policies EN27 and EN6 of the Wealden Local Plan 1998.
6. The development shall be implemented in accordance with the submitted Waste Minimisation Scheme, dated 21 June 2010.
Reason: To minimise the amount of construction waste to be removed from site for final disposal in accordance with Policy WLP11 of the East Sussex and Brighton and Hove Waste Local Plan 2006.

East Sussex and Brighton & Hove Waste Local Plan: Policy WLP11 (Reduction, Re-Use and Recycling during Demolition and Design, and construction of New Developments)
Reasons for approval
The proposal will provide an additional education facility for the Reception Class children at the School, which will be in-keeping with the architectural quality of the School building without compromising the character of the High Weald AONB and resulting in the loss of amenity to nearby residential properties. It is considered that the proposal complies with Policy EN27 and EN6 of the Wealden Local Plan 1998, Policies BE1, BE12 and NE5 of the Non-Statutory Wealden Local Plan 2005 and with Policy WLP11 of the East Sussex and Brighton & Hove Waste Local Plan 2006.
