186th Minutes of NRC held from 8th to 10th August 2011

The 186th Meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held from 8th August 2011 to 10 August, 2011 at NRC, Jaipur.

In pursuance of the Gazette Notification No.213 dated 25.08.2010, NRC has been terminated under Section 21(2)(a) of NCTE Act, 1993 and the powers and duties on behalf of the Northern Regional Committee are being exercised and performed under Section 21(2)(b) by Shri Hasib Ahmad, former Member Secretary, NCTE.

The following member and convener were present:-

AGENDA ITEM:--186.01.CONSIDERATION OF CASES IN THE LIGHT OF COURT ORDER

The institution on 7th June 2011, submitted a fresh application on the ground that its earlier application dated 22.10.2009 was refused on 7th March, 2009 and as such its application needs to be considered in the light of the judgment of the Hon’ble Court on 30.5.2011.
2. The matter has been examined, the case of the institution is similar to those covered under the orders of the Hon’ble Court in Dau Baba T. T. College Vs. NCTE (D.B.Civil Spl. Appeal No.890/2009). As such the institution is entitled to same relief as given in case of those institutions covered in the above said case.
NRC decided that the, recommendation of the State Govt. may be awaited as the institution itself wrote to the State Govt. on 7.6.2011 for conveying its recommendation to the proposal.
2. / RJ- / Adarsh Teacher Training School, Khasara No.370, By Pass Road, Village-Aanidhi, Jamva Ramgarh, Jaipur, Rajasthan / S.T.C / The institution on 25.6.2011, submitted a fresh application on the ground that its earlier application dated 30.10.2008, was returned on 8th March 2009 and as such its application needs to be considered in the light of the judgment made by the Hon’ble Court on 30.5.2011.
2.The matter has been examined, the case of the institution is similar to those covered under the order of the Hon’ble Court in Dau Baba T. T. College Vs. NCTE (D.B..Civil Spl. Appeal No.8901 2011). As such the institution is entitled to same relief as given in case of those institutions covered in the above said case.
NRC decided that recommendation of the State Govt. may be obtained/awaited .
3. / RJ-1256 / A.P.S. Shikshan Prashikshan Mahavidyalaya, B-173-174, Vinobha Bhave Nagar, Nursery Circle, Vaishali Nagar, Jaipur, Rajasthan / B.Ed. / This institution vide its letter dated 15.6.11 replied to the Show Cause Notice dated 3.6.2011. The institution termed the issue of Show Cause Notice as contemptuous inter alia on following grounds.
i.  The application was rejected only on the ground of land being on lease for less than 30 years and hence no other ground can be taken at this stage.
2.The contention of the institution that the application of the institution was refused only on one ground, and therefore no other reason can be cited in the Show Cause Notice now cannot be accepted; as the NRC was entitled to issue Show Cause Notice, even after formal recognition, in case it was found that the institution was violating any of the Regulation/Norms of NCTE. In this case the NRC did not go into merits of the case, once it found that the institution was not even eligible to apply . The Appellate Authority, in its order, however did mention many other discrepancies in the institution’s application, which were not in accordance with the Regulation. As such, NRC was totally under its jurisdiction to issue the Show Cause Notice and the action was in accordance with the orders of the Hon’ble High Court of Jaipur which directed that the ‘application be examined afresh; in accordance with the law.
As such, the reply of the institution to the Show Cause Notice be submitted to the Appellate Authority for further consideration, as per decision taken in the NRC’s Meeting dated April 20-22, 2011.
4. / RJ-763 / Seth Moti Lal Teachers Education College, Jhunjhunu, In front of Rani Sati Mandir, Jhunjhunu-330001, Rajasthan / B.Ed. / The reply of the institution dated 4.7.2011 w.r.to the Show Cause Notice dated 7.6.2011 has been considered, and has not been found satisfactory on the following grounds:
i.  The institution’s recognition was withdrawn on 8.2.2010 on the basis of a complaint forwarded by NCTE Hqrs. on 26.11.2007. Another complaint was forwarded by Central Vigilance Commission on 2.11.2007. The complaints were essentially about conducting the course in violation of the NCTE Regulations/Norms. The inspection of the institution was considered on 10.06.2009 under section 17 of the NCTE Act 1993 and it was on the basis of the inspection that recognition of the institution was withdrawn on 8.2.2010. The Hon’ble High Court of Delhi, however, set aside the order, on the consideration that the withdrawal order was not speaking. Hence, fresh Show Cause Notice was issued.
ii.  In its reply to the Show Cause Notice institution has tried to assure that its laboratories, library are as per NCTE Norms. However, the documents submitted regarding purchase of equipments are for ET labs. dated 11.11.2009, 10.6.2010, 23.6.2011. Similarly, purchase for psychology lab are dated 20.6.2011, 28.7.09 and for language lab are totally undated. The corresponding entries in the Stock Register for these equipment were also totally undated.
iii.  Bulk of purchases in the library are on 2.6.2011, 25.7.2009. The institution did produce photocopies of the Accession Register but then it does not convey anything about the books available in the library, as purchased from time to time with details of entry in the Accession Register.
iv.  The reply of the institution regarding appointment of Faculty/Staff is thoroughly unsatisfactory, as it failed to clearly establish that it continued to have required staff as per norms, ever since recognition was given to the course. The fresh Selection Committee held in June 2011 and initiation of process of obtaining approval of the University at this stage is not relevant to the case. Rather it , establishes the fact that the institution has been conducting its B.Ed. and B.S.T.C Courses, without adequate Faculty and their proper appointment with the approval of the University. Approval of the University for the fresh appointments in June 2011 is yet to be received.
As such NRC decided that a show cause notice be issued to the institution under section 17 of the NCTE Act 1993 as to why recognition, to the institution for the B.Ed. and B.S.T.C course may not be withdrawn from the forthcoming academic session, on the above grounds.
5. / RJ-1705 / Kanhaiya Lal Agarwal Memorial College, Near RAC Line, Sarmathura, Beseri, Dholpur-328026, Rajasthan / B.Ed. / The institution on 15.06.2011, submitted a fresh application on the ground that its earlier application dated 31.12.2007 was refused and its application needs to be considered in the light of the judgment made by Hon’ble Court on 30.5.2011.
2.The matter has been examined, the case of the institution is not similar to other cases on the following grounds:
i.  The institution has not given any details about its earlier application, particularly a copy of the letter through which its application was returned by NRC, as in case of other institution.
ii.  The institution has not given any document to establish that it at all submitted an application for B.Ed. course earlier.
iii.  The relevance of many documents related to appointment of Faculty has not been understood, as there is no paper to suggest that any letter was issued by NRC to this institution .
iv.  The institution did not submit the required fee and other relevant documents related to built up area, CLU etc.
Hence, the application was liable to be summarily rejected. However NRC decided a Show Cause Notice to the institution be issued on the the above grounds.
6. / RJ-2206 / Rao Sandeep T. T. College, Plot No.578/58, Near Govt. Sr. Sec. School, College Road, Village-Ekrotia, Tehsil-Kotkasim, Alwar-301702, Rajasthan / B.Ed. / 1. The institution on 10.06. 2011, submitted a fresh application on the ground that its earlier application dated 10.09.2008 was returned on 9th March 2009 and as such, its application needs to be considered in the light of the judgment made by Hon’ble Court on 30.5.2011.
2. The matter has been examined, the case of the institution is similar to those covered under the Hon’ble Court in Dau Baba T. T. College. V.S. NCTE (D.B. Civil Spl. Appeal 890/2009). As such the institution is entitled to same relief as given in case of those institutions governed in the above said case.
3. The institution’s application has been considered again and following observation made:
i.  The institution did not submit required fee of Rs.40,000/- for consideration of its application.
ii.  The institution did not apply to the State Govt. for their comments/recommendation as per Courts order dated 26.5.11 for obtaining NOC within 15 days.
In view of the above, the application cannot be processed further and is liable to be summarily rejected . However ,NRC decided that the institution be issued a Show Cause Notice for not considering their application further on the above grounds.
7.. / RJ-2034 / Jagan Shikshak Pashikshan Sansthan, Plot/Khasara No.350/1907, 350/1906, 350/1905, Aloda, Khatushamji, Tehsil-Danta Ramgarh, Distt. Sikar-332602, Rajasthan / STC / The institution’s application dated 23.5.2011 has been considered and following observation made:
i.  The applicant institution is not one of the 32 Petitioner of D.B. Civil Special Appeals 890/2009. Dau Baba T. T. College Vs. NCTE. The institution also did not obtain any other Court Order, specific to its case.
NRC decided to reject the application and return the Bank Draft of Rs.40,000/- submitted by the institution.
8.. / RJ- / Shrikalyan Teacher’s Training College, Plot No.26/1, Hathoj, Kalwad Road, Jaipur-302012, Rajasthan / Shiksha Shastri / The institution on 4th June 2011, submitted a fresh application on the ground that its earlier application dated 24.10.2008 was refused on 9th March 2009 and as such, its application needs to be considered in the light of the judgment made by Hon’ble Court on 30.5.2011.
2. The matter has been examined, the case of the institution is similar to those covered under the Hon’ble Court in Dau Baba T. T. College. V.S. NCTE (D.B. Civil Spl. Appeal 890/2009). As such the institution is entitled to same relief as given in case of those institutions governed in the above said case. As such, applications was considered and following observations made:-
Institution did not obtain the approval/recommendation of the State Govt. of Rajasthan, as per Court direction dated 26.5.2011 for obtaining NOC within 15 days.
NRC decided to issue a Show Cause Notice to the institution as to why its application may not be rejected in view of above.
9. / RJ- / Mahatma Gandhi Shikshak Prashikshan Mahavidyalaya, Plot No-242, Sugriv Colony, Near Jain Mandi, Sewar Road, Bharatpur, Sewar, PO-Bharatpur-321001, Rajasthan / B.Ed. (Addl. Intake)
STC (Addl. Intake) / The reply dated 12.7.2011 of the institution w.r. to the Show Cause Notice dated 7.7.2011 has been considered. The reply has not been found satisfactory on the following grounds:
i.  The deficiencies pointed out in its 184th Meeting was in continuation to the decision taken in 182nd Meeting to issue a letter of deficiency.
ii.  The deficiency in the application about non-eligibility for additional course has not been replied properly. The institution has only now completed three years, since it was sanctioned M.Ed. course. The institution was however entitled to apply only after completion of 3 academic sessions for it M.Ed course for applying for any additional course. .
NRC therefore, decided not to consider his application further and close the file .
10. / RJ / B. D. Memorial Kalian Sansthan, D-1K, Krishna Colony, Jharkhand More, Khatipura Road, Jaipur, Rajasthan / STC / 1. The institution on 25.04. 2011, submitted a fresh application on the ground that its earlier application dated 31.10.2008 was refused on 8th March 2009 and as such, its application needs to be considered in the light of the judgment made by Hon’ble Court on 30.5.2011.
2. The matter has been examined, the case of the institution is similar to those covered under the Hon’ble Court in Dau Baba T. T. College. V.S. NCTE (D.B. Civil Spl. Appeal No.890/2011). As such the institution is entitled to same relief as given in case of those institutions governed in the above said case.
3. The application of the institution has been considered again and following observations made:
i.  The institution did not apply to the State Government for their recommendation/NOC, as per Court order dated 26.5.11.
ii.  In case of other such institutions the State Govt.is of the view that no further D.EL.Ed. Course need to be recognized in District Jaipur, as there are already 46 such institutions with 2600 intake in the District of Jaipur.
