CSRA FOOD TRUCK FESTIVAL VENDOR AGREEMENT
Vendor Space Details
Each vendor will have a 10’ x 15’ or a 10’x20’ area. Please bring your own canopy, chairs, tables, tents, signage, generators, etc. The locations of the vendor booths will be located in various places throughout the venue. Electricity will be provided if needed at an additional fee. There are 110 power outlets available. There are also(5) five 220 power outlets available. Vendors must post their food service permit and/or alcohol permit so that it is visible.
Space
The Parties agree that we shall provide a 10’ x 15’ or a 10’x20’ ground space. The vendor is allowed to bring their own canopy (optional). Any additional structure need as a concession sale booth must be provided by the vendor, i.e. tables, chairs, tents, etc. Electricity can be requested at an additional fee. The parties agree that the vendor is responsible for removing all structures and for the clean-up of the immediate area around each concession booth.
Hours Which Concessions May Operate
Vendor may start to set up from 9 a.m. to 11:30 a.m. Vendor must be open and ready for business by 12 p.m. Vendor must be in operation from 12 p.m. to 6 p.m. Vendor will not be allowed to break-down before 6:00 pm.
Fire Extinguishers and Heating Devices
Only labeled heating devices shall be used. Fuel-fired heaters and their installation shall be approved by the authority having jurisdiction. Containers for liquefied petroleum gases shall be installed not less than 5 ft. (1.5m) from any tent and shall be in accordance with the provisions of NRPA 58, Liquefied Petroleum Gas Code. Tanks shall be secured in the upright position and protected from vehicular traffic.
Only labeled heaters shall be permitted. Heaters used inside a tent have to be approved. Heaters shall be connected to electricity by electric cable that is suitable for outside use and is of sufficient size to handle the electrical load.
A minimum of one 10lb. portable fire extinguisher shall be provided, when required by the authority having jurisdiction, for each concession stand in accordance with Section 7-6. Provide one portable Type K extinguisher if cooking. Fire extinguishers shall be provided for hazards where there is a potential for fires involving combustible cooking media (vegetable or animal oils and fats) Maximum travel distance shall not exceed 30 feet from the hazard to the extinguishers.
A minimum of one single station smoke alarm shall be located in all stock or equipment trailers when they are used for sleeping purposes. Electrical equipment and installations shall comply with Section 6.1. The authority having jurisdiction shall be permitted to regulate all outdoor events such as carnivals, and fairs as it pertains to access for emergency vehicles; access to fire protection equipment; placement of stands, concession booths, and exhibits; and the control of hazardous conditions dangerous to life and property.
The authority having jurisdiction shall be permitted to require standby fire personnel as well as EMS personnel when potentially hazardous conditions exist, due to the type of performance, display, exhibit, or activity, or the number of person present.
For safety purposes, all (cooking) food vendors must be inspected and approved by a Fire Inspector before the opening of the event. All cookers will be required to have a working fire extinguisher available within the cooking areas that comply with Augusta Richmond County Fire Regulations. Charcoal Cookers are not allowed.
Tents
Tents shall be permitted only on a temporary basis. Tents shall be erected to cover not more than 75 percent of the premises, unless otherwise approved by the authority having jurisdiction. All tent fabric shall be flame resistant in accordance with 10.31.1 in the Augusta Georgia Special Events Guidelines. One of the following shall serve as evidence that the tent fabric materials have the required flame resistance:
- The authority having jurisdiction shall require a certificate or other evidence of acceptance by an organization acceptable to the authority having jurisdiction.
- The authority having jurisdiction shall require a report of tests made by other inspection authorities or organizations acceptable to the authority having jurisdiction.
Where required by the authority having jurisdictions, confirmatory field tests shall be conducted using test specimens from the original material, which shall have been affixed the time manufacture to the exterior of the tent. There shall be a minimum of 10 ft. (3m) between stake lines.
Adjacent tents shall be spaced to provide an area to be used as a means of emergency egress. Where 10ft. (3m) between stake lines does not meet the requirements to means of egress, the distance necessary for means of egress shall govern.
The ground enclosed by any tent and the ground for a reasonable distance but for not less than 10 ft. (3m) outside of such a tent (s), shall be cleared of all flammable or combustible material or vegetation. This shall be accomplished to the satisfaction of the authority having jurisdiction prior to the erection of such a tent(s). The premises shall be kept free from such flammable or combustible materials during the period for which the premises are used by the public:
- Exception: Removal of flammable or combustible material shall not apply to areas used for necessary support equipment
Where prohibited by the authority having jurisdiction, smoking shall not be permitted in any tent. Portable fire extinguishing equipment of approved types shall be furnished and maintained in tents in such quality and in such locations as directed by the authority having jurisdictions.
Insurance
All vendors are required to provide a copy of their insurance.
Parking
There is NO parking of any sort behind the Augusta Common Service Center. i.e. personal vehicles, service trucks, service equipment, etc. Also, there is absolutely no parking or driving of vehicles, trailers, and/or equipment on the grass in the Augusta Common.
Compliance
The parties agree that the vendor shall comply with all federal, state, and local laws, rules and regulations, including the vendor rules and regulations for the CSRA Food Truck Festival and Augusta, Georgia Special Events. All food vendors must comply with guidelines established by Richmond County Health Department; 1001 Bailie Drive (10); Augusta, GA 30910 Environmental Health (706) 724-8802. Inspectors may visit each event and have the right to close booths operating outside of health regulations.
Indemnity Agreement
The vendor agrees to defend, indemnify and hold harmless Euphoric Celebrations, LLC. from any loss or damage to persons or property arising out of vendor participation in the Food Truck Fest. Vendor understand that Euphoric Celebrations, LLC. has the exclusive right to cancel the event due to inclement weather and agrees Euphoric Celebrations, LLC. will not be liable for any direct or indirect damage the vendor suffers as a result of such a decision.The vendor agrees to defend, indemnify and hold harmless Augusta, GA Special Events Office from any loss or damageand will not be liable for any direct or indirect damage.
CSRA Food Truck Festival event staff has the right to deny any vendor(s) due to: 1) duplication of products from other vendor(s), 2) past concerns or problems with vendors/exhibitors, 3) vendors exhibiting/selling items that are not approved or appropriate for this event.
__ Vendor fee are non-refundable.
__ If an event is post-posted or cancelled, vendors will be notified but refunds will not be given.
__ All vendors must have a current business license and all food vendors must contact the Richmond County Health Department to ensure compliance with the Georgia Department of Public Health Rules and Regulations for Food Service and obtain a permit for the event.
__ Vendor must supply their own setup (tents, tables, chairs, power cords/generators,etc.)
__ No vehicles are allowed in the event area (parked or in motion) during event hours. After unloading quickly move vehicles to a parking lot.
__ The CSRA Food Truck Festival event staff reserves the right to reject or charge additional fee(s) for any item(s) found not to be in compliance with submitted application.
__ Booths must be staffed and “Open for Business” at all times during event hours. Vendors may open once set up is complete.
__ Booth spaces cannot be sublet to another vendor without prior approval by the CSRA Food Truck Festival event staff.
__ Merchandise or set up cannot block aisles; encroach on other vendor spots, or public walking areas. Any vendor violating this will be asked to relocate their materials.
__ Food vendors using tents must comply with Richmond County Fire Department regulations of having a fire retardant tent and a K -Type Fire Extinguisher. If the on-site Fire Marshall denies your equipment for non-compliance, you will be asked to remove any item(s) they request.
__ We are not responsible for stolen, lost, or damaged items.
__ Food vendors using grease are responsible for disposal in a safe and environmentally sound manner. The dumping of grease or waste water on the premises is strictly prohibited.
__ Vendors must cease all sales and begin dismantling set up promptly at the end of the event.
__ Dumping of any sort is prohibited.
__ CSRA Food Truck Festival Event Staff have the authority to uphold and enforce all rules and guidelines listed above and may terminate your contract at anytime.
__ A copy of your food service permit and/or alcohol permit must be submitted to the event staff prior to participating in the event.
