- 8 facilities have 7 applications in
- 13 EGUs, 7 non EGUs
- In the process of doing the reviews. Have not completed the determinations yet
- Some sources are proposing presumptive some are not
- Using presumptive limits as a guide
- North Dakota
- 7 EGUs. All the analyses have been received
- Have SO2 and Particulate
- Must consider control equipment better than BART
- Industry indicates that SCR will not work.
- Comments from EPA
- Utah nothing to EPA yet
- Oregon – only one source in determination stage
- Number of sources close to 0.5 threshold. Are other states looking at cumulative for exemption modeling?
- Wyoming has not looked at cumulative analyses. Don’t have many sources located closely.
- How are states handling the 5 factors
- North Dakota – looking at all 5 factors. Many are not really issues and it’s coming down to visibility vs. cost of compliance. The weight will be mostly on cost.
- Wyoming – When looking at what’s reasonable are states using BACT?. ND – WRAP is looking at what is reasonable. We are looking at the guidelines and EPA pointed to the WRAP annex i.e. over $3000 and adjusted for inflation is around $3700/ton. Industry is arguing the value for the presumptive levels.
- Wyoming is looking more at BACT but still early in the process.

- Courts vacated boiler and Brick mact – what does that do?
- Should be a call soon to address this issue
- There is a flexible permitting rule in the works
- Proposal coming end of August or first of Sept for PM 2.5 increment.
- Final rule on PM 2.5 implementation at OMB based on proposal of November 2005. May be first of year before it is released.
- Proposed rule on fugitive emissions. EPA was asked to reconsider how fugitive emissions should be included to determine whether a modification has occurred.
- Wyoming – Interpreting visibility results for BART – number of days over 0.5 dv how do you factor in the $/dv or $/# days over 0.5
- ND – reason why put heavy weight on cost rather than visibility
- CO – stayed away from the $/dv issue
- Oregon – had proposed similar metrics but has not gotten far. May have only one source subject to BART. Would be interested in how Wyoming is applying this.
