I.PURPOSE: Thepurposeofthispolicyistooutlinethemandatesofthisjailwithrespect tothesearches ofarresteesandinmates withinthejail facility bothatintake and throughouttheirincarceration.

II.POLICY: Itisthepolicyofthisjailtobalancethesafetyandsecurityofthelock-up facilitywiththeConstitutionalRightsofpersonswhoare placedinaholding cell or held withinthegeneralpopulation ofthejail.

III. DEFINITIONS:

A.StripSearch:Are-arrangementofclothingwhichallows forthevisualobservation of genitals, buttocks,or breastofawoman.

B.PatorFrisk:Meansamanualsearchofaclothedpersonandincludesavisual inspectionoftheopenmouth.

C.Cross-gender strip-search: The strip search of a person by a member of the oppositegender.

D.Arrestee: Any newly arrested person who, prior to the moment of arrest, was unaware thatthey would beplacedinaholdingfacility or jail.

E.Contraband:Anyitemwhichisprohibitedfrompossessioninthejailirrespectiveof whether theitemwould beconsideredillegal for possessioninapublic environment, i.e.cigarettes,lighter,matchesetc.

F.Change-outProcess:Theprocessbywhichanarresteechangesfromtheirclothing toauniformprovidedbythefacility

G.HygienicShower:Asanitaryshowerrequiredbythearresteebeforebeingplaced intogeneral population

H.Reasonable suspicion: facts andcircumstancesbaseduponobservationsor information,shortofprobablecause,but,basedonarticulablefactsthatwouldlead

areasonableofficer/correctionalofficertobelievethatthepersontobesearched was concealingcontrabandandthatthestripsearch wouldreveal thatitem.

I.ExigentCircumstance:anemergencyconditionwhichifnotimmediatelyattendedto may jeopardizethehealthandsafety ofpersonsinthefacility including arrestees, inmates,andstaff

J.Body-CavitySearch:meansamanualorinstrumentsearchofaperson’soral,anal,

vaginalor other bodycavity, performedbymedical personnel.

IV. PROCEDURE:

A.Arrestees shall onlybestrippedsearchedwhenthere is reasonablesuspicionto believe thattheyare concealingcontrabandor weapons that would berevealed by conductingastripsearch.Reasonablesuspicionmustbebasedupon the existence ofobjectiveinformation thatmaypredictthelikelihood ofthepresences ofa weapon, drugs, or other itemsofcontrabandconcealedontheparticular prisoner.

a.Stripsearching ofallarrestees is strictlyprohibited.

b.ReasonableSuspicionmaybesupportedby one ormoreofthefollowing:

i.Currentoffensefor whichtheyhave been broughtinon:

(a)Arrestfor adrugrelatedcharge

(b)Crimefor whichtheyare arrested generallyinvolves weapons or contraband

(c)Fugitive Statuswhenthechargefor whichthe prisoner is a fugitivesupports reasonablesuspicioni.e.drugcharge or where therehasbeenatransfer ofcustodysupportingastripsearch.

(d)FelonyViolence

(e)Historyofparticular arresteeknown tojailstaffthatsupports subjectbeingin possessionofcontraband,i.e.recent arrestsfor weapons ordrugs;

(f)InstitutionalBehavior, reliableinformationor historythatindicates possession ormanufacturing ofcontraband,therefusal tosubmit toaclothedpat-downsearch ortheclothed pat-downsearch revealedthepossessionofcontraband.

(g)Conductofindividual thatwouldindicatetheyare concealing something;

(h)Itemsfeltduringpat-down or indicatedduringelectronicdetection

(i.e.metaldetector)search;

(i)Informationfrom areliablesource.

B.MannerofAll Searches:Stripsearches,asallsearches,mustbeconductedina professionalmanner.

a.Cross-gender stripsearches areprohibitedunless exigentcircumstances exist whichwould notallowthedelayofthesearchuntil anofficer/employeeofthe same gender arrives.

b.Allstripsearches are to beconductedinadiscretemanner whichprovides for theprivacyoftheindividualbeingsearched:

i.Arrestees shall notbestripsearchedingroups, arrestees shallbestrip searchedoneatatimein anareawhichis notexposedtotheviewof otherarrestees.

ii.Onlypersonnel that are necessarytoperformingthestripsearch shallbe present while thestripsearch is takingplace.

c.Allstripsearches shalltakeplaceinapre-designated areawhichmeets sanitaryconditions.

d.At notimeshallpersonnel touchaninmatewhois beingstripsearchedunless exigentcircumstancesexist.

C.Documentation: Allstripsearches of arresteesshallbe properlydocumented.

Thedocumentationshallincludethefollowing:

a.Facts andcircumstances thatled tothereasonablesuspicion thatjustifiedthestrip search;

b.Thechargefor whichthepersonistobeheld; c.The placewhere thesearch was conducted; d. Thepersonspresentduringthesearch;

e.Thedeputyjailer/employeewhoconductedthesearch;

f.The timethesearchbegan andthe timethesearch concluded;

g.A detaileddescription ofitems recovered duringthesearch.

D.Strip Searchesofinmates who havehadexposureto thepublic withknowledge that they will return tothefacility.I.e.work-releaseinmates;weekenders;court returns, andself-reporters.

a.Whereareturningprisonerhas hadoutsidecontact(area of publicaccess)with knowledge thatthey willbereturningtothejail, thatinmatemaybestrip searcheduponreturnto preventthesmugglingofcontrabandintothegeneral population ofthejail.

b.Prisonersmaybestripsearchedincases where thecourthasordered commitmenttocustodyafterarraignment,conviction,sentencing or other court appearance,andthe prisoner was notincustodypriortothecourt appearance. Noteprisoners returningfromcourt shallnotbestripsearchediftheyare returningtobeprocessedout ofthejail per order ofthecourt.

c.Stripsearches of prisoners maybeconductedwhere theprisoner has had contactwith the publicbyacontactvisit,courtappearancethattakesplacein an areatowhichthe public mayhave access, or after transportfromor through an areatowhichthe public mayhave access.

E.BodyCavitysearches:

a.Bodycavitysearches shallbedonepursuantto probablecauseandwith the authorizationoftheJailer.

b.Bodycavitysearches shallnot beconductedwithoutasearch warrantunless thereare exigentcircumstances.

c.Bodycavitysearches shallonlybeconductedbymedicalpersonnel ina sanitaryenvironment.

F.A prisoner shall besearchedinaccordancewith thispolicyif enteringor leavingthe securityperimeter.

G.Isolatedsecurityspotchecks shallbeconductedfor contrabanddaily.
