Beach and Dock Association Rules and Regulations

Regulations by the individual beaches must not conflict with the rights and privileges of the members to use Club property as outlined in the By-Laws or as established by the rules and regulations of the Trustees.

Regulations by the individual beaches may not supersede or conflict with provisions of the LMCC By-Laws currently in effect.

  1. Name and Location

  3. Use of the beaches is restricted to members of the Club in good standing or guests of members by presentation or display of proper identification. Use of the docks is restricted to members of the Club in good standing who have also paid for use of a slip on that dock and their guests by presentation or display of proper identification.
  4. Each beach insofar as it is practicable shall be under the control of a Beach Committee organized by the members living within the area served by the beach or who regularly choose to patronize the beach.
  1. Membership
  1. Membership is open to LMCC residents wishing to frequent Beach 5.
  2. Donations to the Beach are welcomed and will be used to help support maintenance of the beach and the Kayak/Canoe rack repairs. Such maintenance as is necessary to keep safe the shed, grounds, swings, beach chairs, sand, and some basic amenities to enhance the appearance of the beach property.
  3. Members’ dues fees structure:
  4. Individual/Family membership = $30/season
  5. Kayak/Canoe rack rental= $35/per rack after dues are paid.
  6. All LMCC Members in good standing, and with LMCC ID, can enjoy Beach 5. Paid Members of Beach 5 may utilize the amenities of the tent, the shed, the picnic tables, the grill, and the canoe/kayak racks providing all dues/fees are paid up for the season.
  1. Officers and Elections
  1. The following Volunteer Officers will comprise the Beach 5 Board
  2. President
  3. Oversee beach activities and conduct meetings, as necessary
  4. Act as the Liaison between Beach 5 and LMCC
  5. Participate in PAC
  6. Coordinate the beach clean ups (Spring/Fall)
  7. Vice President
  8. Assist in the duties of the president
  9. Coordinate the Tent set up/take down (Spring/Fall)
  10. Treasurer
  11. Maintain beach funds and the Lakeland Bank account
  12. Collect all fees associated with beach activities
  13. Dues, kayak/canoe fees, Party reservations
  14. Record and disburse all reimbursements associated with beach activities.
  15. Submit Quarterly Financial Statements to LMCC
  16. Participate in PAC
  17. Secretary
  18. Coordinate the seasonal community flier mailing
  19. Submit papoose articles
  20. Kayak/Canoe Coordinator
  21. Maintain and coordinate the kayak/canoe rental slips
  22. Participate in PAC
  23. Qualifications for election
  24. Any Beach 5 member in good standing can run for office.
  25. Term of offices – each will be two (2) years.
  26. Term Limits
  27. Each officer shall be elected to a term oftwo years and may serve no more than six (6) consecutive full years. He/she shall not be eligible to run for office for a period of one (1) year (twelve months) after the end of his or her final term.
  28. Vacancies
  29. The officers may declare a vacancy in the event that the officer no longer meets the qualifications for election or if the member is no longer in good standing with LMCC. In the case of a vacancy, due to any cause, the remaining officers shall elect a successor to hold office until the next membership meeting when his/her successor shall be nominated and elected to fill the unexpired term.
  30. If no candidate runs for the position of the outgoing officer, including one whose full six (6) years is expiring the officers shall elect a new officer to fill the vacant position, or elect the outgoing officer to return to serve until the next membership meeting, at which time the 12 month ineligibility period will commence.
  1. Selection/election of officers: The President shall collect names of individuals wishing to hold an office at Beach 5. He/She will prepare a slate of officers (in March) and in the event that more than one individual is up for a position, will coordinate an election. The officers for the season will be announced in April.
  2. Frequency of meetings, requirements for notices of meetings and agendas:
  3. The President has the discretion to call any/all meetings.
  4. It is the responsibility of Board Members to bring to the President’s attention any topics for meeting agendas.
  5. And, solicitation of members’ concerns should also be addressed and incorporated.
  6. Any member of Beach 5 can contact a Board member with concerns/ideas/suggestions.
  7. A Roster shall be maintained by the President/Secretarycontaining the contact name/address/email and cell phone number of all Board Members and meeting notification will generally occur via email.
  1. Operations
  1. The Beach/Dock organization is required to operate their areas in a proper and safe manner: following the LMCC By-Laws;policies of the Board of Trustees; LMCC Marine Regulations; State, County, and local health ordinances.

Work with LMCC to maintain the facilities in safe operating condition and in good repair. Ensure access to Club employees and professionals to verify compliance with insurance requirements, safe conditions, and proper levels of maintenance.

Regulations are to be adopted to ensure proper and safe conduct by those using the beach facilities.

  1. Dock organizations are responsible for consistent, fair, and equitable assignment and control of docking facilities. (N/A). Beach 5 docks are a separate organization from the Beach. For information regarding the rules for the docks, please contact them directly.
  2. It is the responsibility of all Beach 5 members to keep the beach neat and orderly at all times. The 4 main picnic tables must remain under the tent and all debris/garbage must be removed. Beach chairs should be lined up orderly at the end of the day and toys/debris should not be left on the beach. Use of the propane grill is at the member’s discretion and should be cleaned after each use. We ask that everyone work together to leave the beach in better shape than you found it.
  3. The Beach/Dock Committee may purchase or recommend the purchase of equipment deemed necessary from funds allotted by the Trustees or otherwise obtained by the Committee. Any purchase over $2500.00 must be submitted to the PAC Committee for approval.
  4. All Beach/Dock organizations are required to manage their funds through the accounting system provided by LMCC.
  5. All permanent structures at each beach shall be owned by LMCC or an incorporated beach club.
  6. The Beach Committees shall have the opportunity to assist in the selection of a lifeguard for their beach and together with the Waterfront Director, Head Lifeguard, Lifeguarding staff, and Security Staff shall be responsible for the enforcement of rules and regulations applying to all beaches and special rules and regulations applying to one or more individual beaches.
  1. Changes to the Rules and Regulations
  1. Each year, under the direction of the President, the Board will review the rules and regulations of Beach 5 and vote on any changes. Approved changes will be incorporated into the master document and submitted to the LMCC.
