NOTICE IS HEREBY GIVEN that the City of Rigby’s Planning and Zoning Commission has made a “to approve” recommendation to the city of Rigby on the application requesting: 1) An amended plat, combining four individual lots into a single lot; 2) approval of the principle of the preliminary development plan (PUD); and 3) abandonment of a planned cul-de-sac road in the Rigby Town Square Development per Idaho Code 50-311. The property is currently zoned commercial (C-1) and no change in zoning is being requested.
Per city code 10-3-2(c) and 10-3-5: Action by Board, the City of Rigby city council hereby gives notice that the Rigby City Council will hold a public hearing on the application it received from the planning and zoning commission of the proposed project. Any person within 300 feet of the area is to be notified of the proposed project.
General Location: 497 North Pleasant Country Lane, City of Rigby, Jefferson County, Idaho.
Legal Description: Lot 10, Block 7 of Rigby Town Square Development #6; Lot 7, Block 7 of Rigby Town Square Development #6; and south 45 feet of Lot 7, Block 7 of Rigby Town Square Development #6 Section 18 TWP 4; North Range 39 East Boise Median; City Annex. Purpose: The original plat calls for a cul-de-sac road approx. 45 feet wide by 244 feet long entering off of Pleasant County Lane. The applicants want to have the city vacate the cul-de-sac and deed the property contained within the cul-de-sac to the applicants. The cul-de-sac will be replaced with a private drive. The planned project is for the construction of twelve (12) townhouse style multi-family housing units to be constructed under the city code pertaining to Planned Unit Development (PUD) (10-10-1 through 19).
The property is an undeveloped parcel of land of approximately 4.64 acres which is currently zoned Commercial (C-1). The property is boarded by an existing commercial building, multi-family housing (4-plex) and single family housing. See preliminary plat design attached.
The council will be discussing 1) the principle of the preliminary development plan according to city code 10-11-15 subject to submission by the applicant of the final development plan; 2) abandonment of cul-de-sac; 3) amending the plat.
The property is currently owned by Fox Investing, LLC whose ownership consists of Bo Porter, Kris Stowell, and Jake Shumway. Project information and a complete copy of the application is available for review at the office of Rigby City office located at 158 W Fremont, Rigby, ID during normal business hours (9:00– 5:00) Mon-Fri.
The public hearing will be held Thursday, February 15, 2018 at 7:00pm at the Rigby City Hall located at 158 W Fremont, Rigby, ID verbal and written comments will be accepted up to and at the hearing. The public is invited to attend this meeting. Be advised that there will be a five (5) minute time limit for anyone providing oral testimony. Mailed comments will be accepted through US Postal Service or emailed or hand delivered to if received before 5:00pm Thursday, February 15, 2018.
