Swimming Pool Rules & Regulations

SAFETY:

1.  Safety is first & utmost! Obey the lifeguard(s) at all times.

2.  No glass of any kind is allowed at any time. This rule will be strictly enforced.

3.  No diving is allowed at any time. This rule will be strictly enforced.

4.  No paddleboat type rafts or toys allowed. Baby floats and water balls are allowed at the discretion of the lifeguard(s). This will be determined by the occupancy of the pool along with the behavior of play from the patrons.

5.  No weapons of any kind (guns, knives, etc.) are allowed in the pool area, clubhouse, or common grounds surrounding the pool.

REGISTRATION & GUESTS:

6.  ALL PERSONS ENTERING THE POOL AREA MUST SIGN-IN WITH THE LIFEGUARD UPON ENTRY. Pool tags must be visible at all times. Members will be held responsible for the actions of their guests. Members may be charged for any damage.

7.  The inviting residents must accompany all guests both to the sign-in and while using the pool. Each family is allowed to have a maximum of four (4) guests per household unless prior approval is obtained by the pool committee and subsequently approved by the Board of Directors.

CHILDREN:

8.  No one under the age of fourteen (14) is allowed at the pool without an adult, 18 years or older, who will accompany the child at all times in the pool and pool area & is directly responsible for that child.

9.  Children 14 years and older may use the pool without adult supervision, and can have a maximum of 2 guests. (THIS DOES NOT INCLUDE THE LIFEGUARD). These guests must be 14 years or older.

POOL OPERATION:

10.  Dates of Operation - The pool will be open on the following days:

·  Saturday, May 29, 2010 through Monday, September 6, 2010

11.  Hours of Operation - The pool will be open during the following hours:

*Monday - Friday 11:00 a.m. to 9:00 p.m.

Saturday 11:00 a.m. to 9:00 p.m.

Sunday 12:00 noon to 8:00 p.m.

*NOTE: On days when Public School is in session in May, June and August,

the pool will only be open from 4:00 p.m. until 8:00 p.m. (Weekdays only)

HEALTH & CLEANLINESS:

12.  Encourage your children to use the bathroom provided at the pool area so as to avoid toilet “accidents” and contamination of swimming pool water. Due to health and safety reasons, this rule will be strictly enforced and can lead to suspension of tags.

13.  Babies and toddlers who are not potty trained must wear a swim diaper.

14.  No rocks, debris, gum, spitting or sunflower seeds will be allowed in the pool and pool area.

15.  No person will be allowed in the pool while wearing street clothes….bathing suits only. Absolutely no cut-offs permitted. Showering before entering the pool is recommended.

16.  No pets in the pool area.

17.  Smoking will NOT be permitted in the pool area OR inside the clubhouse.

FOOD & DRINKS:

18.  Food consumption will be permitted in the designated eating area only (Cabana). All liquids must be in plastic cups or aluminum cans for safety reasons. NO GLASS CONTAINERS. Cleaning up your trash and consumed items is REQUIRED.

19.  NO ALCOHOLIC BEVERAGES WILL BE ALLOWED IN THE POOL OR CLUBHOUSE AREAS, except during private parties. Persons under the influence of intoxicants will be denied entrance into the pool.

POOL EQUIPMENT:

20.  Under no circumstances is any person to play with the cleaning implements. Pool furniture may not be removed from the pool area at any time nor placed in the pool.

NOISE:

21.  With due regard to the close proximity of some homes to the pool area, the noise level must be kept to a minimum. Radios and TVs are permitted with the use of earphones.

22.  No profanity will be permitted in the pool area and in common areas of the community. Lifeguards may send swimmers home for obscene language and can further lead to pool suspension.

UTILIZATION:

23.  By North Carolina State Law, no person will be permitted to be in the pool or pool area without a lifeguard present.

Pool passes will be issued to each member of Kendrick Farm who is current with their HOA dues. Residents should sign in on a table near the lifeguard stand – no exceptions. Pool passes must be present and shown upon request. Pool passes will be issued to residents by the pool committee free of charge to Kendrick Farm residents. HOA dues that are payable in July must be paid prior to August 1 to prevent revocation of pool privileges. Pool privileges will be reinstated upon payment in full of these dues.

LIFEGUARDS:

24.  NO ONE IS PERMITTED IN THE POOL AREA AFTER POOL HOURS OF OPERATION. ALL TRESPASSERS WILL BE PROSECUTED TO THE FULLEST EXTENT OF THE LAW.

25.  The lifeguard is responsible for the enforcement of rules. Any person who does not follow all of the above rules can be expelled for the day at the discretion of the lifeguard. Two daily expulsions will result in a letter from the board. Three daily expulsions will result in expulsion for the remainder of the pool season. An appeal can be made to the board and will be further reviewed.

26.  According to the Covenants, Conditions and Restrictions for Kendrick Farm, as a legally filed document, the Kendrick Farm Board of Directors has the authority to suspend privileges or fine any person(s), or those responsible for persons (i.e., guests), that break these rules or acts in an extreme or obscene manner which causes obtrusive infringement, or safety to other persons on this facility.

PRIVATE PARTIES:

27.  Arrangements for private parties during or after normal pool hours must be made through the Clubhouse Coordinator, by e-mailing . If the Private Party will require pool usage, the resident must also contact Charlotte Swim Club Management directly to request a lifeguard(s) at 704-766-2726. No private party is granted exclusive rights to the pool during normal pool hours. Private parties are limited to 3 hours during or after pool hours.

28.  Private Party Guests are limited to 25 during pool hours. All private parties must pay a fee for the use of the pool area even if the cabana is not intended to be used. The cabana will remain “reserved” for the duration of the party.

29.  The following scale should be used for appropriate pricing:

1 – 25 $75.00

26-51 $ 125.00

51-76 $175.00

76 – over $ 50.00 additional for each 25 people

30.  Arrangements to use ONLY the clubhouse area must be made by the resident directly through the Clubhouse Coordinator. The clubhouse may not be available during certain winter months that freeze may occur. Any rentals during the winter will only be offered when the pool is covered otherwise the resident must hire a life guard according to the scale below. Available dates are subject to change. A rental fee and deposit will apply. Please contact the Clubhouse Coordinator, at for more information.

ADDITIONAL LIFEGUARDS:

31. Lifeguards will be provided for special events and after-hours private parties. Contact the Charlotte Swim Club Management for pricing.

No lifeguard shall be provided beyond the hour of 12:00 am.

For parties or special events, for with Charlotte Swim Club Management is to provide lifeguards, the customer is responsible for giving 7 days prior written notice as to:

a.  The time & date of the party

b.  The number of people who are scheduled to attend

c.  The general age group of the people scheduled to attend

d.  Whether alcoholic beverages will be permitted at the party

e.  Any special instructions

f.  How many lifeguards requested

The following scale must be used to determine the number of lifeguards for an event:

Over 100 One additional for each 40 people

One additional lifeguard shall be required for any teenage party, college age party, or for any party involving alcoholic beverages. One adult chaperone must be provided for each ten (10) people at a teenage or college age party. No lifeguards will be provided for fraternity parties.
