Definition of Certain Terms & Conditions
When used by La Bella Baskets in any context these terms shall mean:
Active - an LBB Consultant, or other member, that has not been terminated or cancelled.
Bonus - Commission payment, from time to time, for achieving specific sales goals or amount of sales.
Bonus Override Sales Commission - the percentage Commission payable to qualifying Gift Directors based on Sales Group Monthly Revenue.
Business on the Books - money actually received from Active members and/or consultants upon which an Active Consultant/Gift Director receives recurring Commissions.
Cancellation - the voluntary or involuntary termination of the LBB Agreement.
Commission - encompasses all performance based compensation, including but not limited to, residuals, overrides, bonuses and contest winnings, payable to Consultants/Gift Directors.
Contest Winnings - compensation payable upon the occurrence of a specified event.
La Bella Baskets Consultant (“LBB Consultant”)- any person who has signed an LBB CONSULTANT Agreement and it is Active.
Consultant Manual - the most current version of the LBB CONSULTANT Policies and Procedures Manual as published from time to time.
Personal Sales Group - the members and/or consultants personally signed up by a gift director.
Residual Commission- A commission paid on actual receipt of money from recurring sales
Gift Director Agreement- the contract between La Bella Baskets and a qualifying Consultant.
Consultant/Member AgreementsPayment Methods
· Drafting
All consultants must pay their membership fees by credit card (no pre-paid cards). Such fees will be automatically charged on the day of enrollment and then on the same day every month thereafter.
· Cash Transactions
La Bella Baskets does not accept cash for any payments. La Bella Baskets is not responsible for lost cash.
· Pre-Paid Cards
Pre-paid credit cards are not accepted by La Bella Baskets for any initial payment or any recurring drafting for members or consultants.
· LBB CONSULTANT Identification Number
Consultants must have their consultant identification number ready and available when calling consultant support.
TerminationEffect of Cancellation
Notice of cancellation of a consultant and/or Gift Sales Director Agreement, whether voluntary or involuntary, will result in the immediate termination of all obligations of La Bella Baskets to pay commissions or provide any benefits.
When a La Bella Baskets consultant wishes to terminate their monthly membership with the company, or has failed to resolve a declined membership payment within 30 days, their account status is changed to Cancelled.
Voluntary Termination
You may terminate your LBB consultant agreement at any time by stating your termination request by emailing: . A confirmation that your request has been fulfilled will be emailed to you. La Bella Baskets will not accept termination from anyone other than the terminating consultant, and attempts to terminate by phone will not be accepted.
Voluntary termination of a LBB consultant agreement in it’s entirety and , consequently, terminates any related gift sales director agreement as well as any other agreement that may exist between gift sales directors and La Bella Baskets. When a Gift Director LBB agreement is terminated, the Gift Director knowingly forfeits ALL rights to any future commissions, including but not limit to, advances, residuals, bonuses, and contest winning arising from any agreement between Gift Directors and La Bella Baskets. In the event of a voluntary Termination, the Members and Gift Directors enrolled by or down line to the Terminated Gift Directors shall roll-up to their upline.
Termination by La Bella Baskets
La Bella Baskets reserves the right to terminate any agreement with Gift Directors with or without cause. Should La Bella Baskets exercise its right to terminate it’s agreement with Gift Directors, All obligations to pay future commission including but not limited to, advance, residuals, bonuses, and contest winning arising from the terminated Gift Consultant Agreement(s) cease immediately. In the event of Termination by La Bella Baskets, the Members and Gift Directors enrolled by or down line to the Terminated Gift Directors shall roll-up to their upline.
Refund of Voluntary Terminations
Any consultant may terminate their LBB Consultant Agreement and receive a full refund if La Bella Baskets receives a written request within 72 hours of enrollment. Notifications may be sent by email only by the LBB CONSULTANT desiring to terminate their consultant membership. Account termination and refund requests must be emailed to and must include consultant’s name and ID#.
Reinstatements
A member or LBB CONSULTANT who wishes to reinstate their Membership after termination may do so by notifying La Bella Baskets by phone or email. The reinstated consultant membership is effective from the date received by La Bella Baskets and remains with the original sponsoring consultant if they wish to.
To reinstate after a Gift Director agreement termination, that Member or Gift Director must submit a new LBB application along with all fees, including registration and initial monthly fee.
An LBB consultant that has terminated their agreement and has desires to reinstate must do so as a new consultant and must re-qualify for each management level. Their original sales group cannot be reinstated.
Change of AddressChanging Address

BillingCredit Card Declines
If the consultant fee is declined, an email is sent to the consultant requesting new credit card information.
When the payment does not process successfully, the system automatically changes your account status to "Inactive". This means that access to your back office is turned off and any commissions earned during the period of inactivity will be forfeited.
We will make one more attempt to re-process the payment 30 days from the original date that your payment declined. If it is processed successfully, your account status will be set back to active automatically.
If the re-process declines that second time, your La Bella Baskets membership will be automatically terminated.

If a Gift Consultant is inactive due to a declined credit card, any direct commission due on new business during the inactive period is forfeited.
Change of Payment Information
If a Member or Gift Consultant wishes to change their payment information, they must send an email request to for instructions on how to do so.

AdvertisingInternet Advertising
The only approved Internet member advertising websites are www.LaBellaBaskets.com and all consultants replicated marketing sites. These web sites are approved in all states, in which La Bella Baskets® conducts business. All other websites must submitted for approval at:
Corporate Approval
La Bella Baskets must approve in writing all advertising copy including, but not limited to, using the La Bella Baskets name, trademark or
logo for any media including newspapers, posters, flyers, promotional items, etc. It is each LBB CONSULTANT’s individual responsibility to obtain
approval from La Bella Baskets for any advertisement to be used. NO CONSULTANT SHOULD ACCEPT AD COPY FROM ANYONE AND ASSUME IT HAS BEEN APPROVED.
FAILURE TO OBTAIN WRITTEN APPROVAL CAN RESULT IN TERMINATION OF THE CONSULTANT AGREEMENT. Requests for approval are submitted by email to . Once approved, La Bella Baskets notifies the consultant by phone, fax or e-mail.
Company Names, Trademarks Logos
Company Names, Trademarks & Logos
La Bella Baskets employee names, corporate names, trademarks, and logos are proprietary and cannot be used in any manner, including reproduction of literature or in any advertisement without prior written approval from La Bella Baskets . Any approved use of
such corporate names, trademarks or logos must indicate that the LBB CONSULTANT is Gift Director of La Bella Baskets .
Advertisements to attract LBB CONSULTANT or business opportunity advertising must be run blind, i.e. without reference to La Bella Baskets unless approved by La Bella Baskets . La Bella Baskets strictly prohibits the use of its corporate name, logo or trademark or any statements with respect to La Bella Baskets business or operations in any banking activity by an La Bella Baskets LBB CONSULTANT. VIOLATION OF THIS POLICY COULD RESULT IN THE TERMINATION OF THE BASIC LBB CONSULTANTS AGREEMENT.
Public or Electronic Advertising Media
LBB CONSULTANT use of the following media is prohibited: telephone book, billboards, park benches, etc. All radio, publications, television and other electronic
media must be approved by La Bella Baskets in writing.
Pop-up or banner advertising on the Internet is allowed only AFTER final advertising copy is approved by La Bella Baskets . Pop-up advertising must not appear on ANY official La Bella Baskets websites (see listing under website section below). In most cases LBB CONSULTANTs
using pop-up advertising employ the services of a third party vendor to make sure the pop-up ad appears on as many websites as possible.
LBB CONSULTANTs using pop-up advertising must provide a list of official La Bella Baskets websites to the vendor. It is the LBB CONSULTANT’s responsibility to
ensure that the vendor takes the appropriate steps to prevent the pop-up ad from appearing on ANY official La Bella Baskets website.
LBB CONSULTANTs whose pop-up ads appear on ANY official La Bella Baskets website are subject to Termination of the Basic LBB CONSULTANTs Agreement.

LBB CONSULTANTS MUST CHECK THEIR LBB CONSULTANT BACK OFFICE TO REVIEW ANY AND ALL UPDATES, INCLUDING, BUT NOT LIMITED TO, FUTURE AMENDMENTS TO THE LBB CONSULTANT POLICY AND PROCEDURE MANUAL.
Alternate Websites
La Bella Baskets recognizes the significant role the Internet may play in building an LBB CONSULTANT’s business and needs to ensure that this resource accurately promotes La Bella Baskets, the LBB CONSULTANT’s relationship with the company and the La Bella Baskets marketing philosophy.
La Bella Baskets Corporate or Corporate-approved alternate websites are the only websites on the Internet that may use the La Bella Baskets Trademarks and/or Copyrighted materials including, but not limited to, names, slogans, logos, service marks and/or trade names.
An alternate website is any website used by a La Bella Baskets LBB CONSULTANT to promote La Bella Baskets other than the La Bella Baskets Corporate sites.
In order for La Bella Baskets to comply with regulation requirements, La Bella Baskets will order non-compliant sites to adhere to its published policies or be removed from the Internet. La Bella Baskets will enforce this policy by taking legal steps to protect the use of its intellectual property.
For this reason La Bella Baskets has issued the following guidelines regarding alternate websites to protect the La Bella Baskets professional image, promote consistency in the La Bella Baskets message and ensure that it is protected from unauthorized, untruthful, or exaggerated claims.
LBB CONSULTANTs who use alternate websites, URLs, redirecting URLs and/or Meta tags which promote their business over the Internet through the use of trademarks of other companies, are solely liable for any infringement of such trademark. In addition, the LBB CONSULTANT may be subject to termination. Website registration does not constitute approval of any trademark infringement. Also, if you are using images from an La Bella Baskets corporate website, please be aware that such images have not been authorized for third party (your) use. In the event your use of such images causes damages or claims to La Bella Baskets , you agree to hold La Bella Baskets harmless and indemnify it from any damages and liabilities resulting from your use of the images.
La Bella Baskets reserves the right to refuse any site.
Any unauthorized site changes or violations of policy is cause for withdrawal of the approval.
