Bay Branch Villas – BOD Meeting

Minutes for January 23, 2018

  1. Meeting called to order by President, Patsy Fonseca at 6:40 pm. Roll Call – present were Patsy, Mr. Edward, Dick, Gloria and Rebecca.
  1. The Property Shop’s first financial report was submitted. Scott Huval was absent; however, he did email Patsy a financial report.Cash available as of January 23, is Smart Street $28,665.61 and PNC Bank $2,610.81. Board Members noted that we will have a Loss for this fiscal year, The loss isbecause of the costly expenditures of retention pond clean up ($17,000) and new fencing ($9,500).

  2. The Property Shop is verifying that our by-laws were recorded in public records by the legal firm that assisted us in the creation and adoption of the document--Stone Granade & Crosby PC
  3. The Property Shop has gotten all our data logged into their system. Homeowner Account Statements will be mailed out this week. Noted that over $20,000 is owed in past due accounts and late fees. Homeowners will have until Feb 28, 2018 to pay or make arrangements to pay these past dues or collection procedures will begin and will be enforced.
  4. Patsy told the board that The Property Shop has not charged Bay Branch Villas HOA any fees for work done thus far.
  5. VIOLATIONS…The Property Shop has started canvasing the neighborhood for violations of our CC&Rs. Over 50 Violation Notification Courtesy notices have already been mailed.
  6. New Business

A CORRECTED CC&R Violation Policy and Appeals Process was unanimously adopted by the board. Effective immediately

After $500 of Violation fees accrued a lien will be filed on the property.

in the case of fences being built, the property owner will have 60 days to complete the construction of the fence.

APPEAL OF VIOLATION PROCESS

A homeowner has the right to appeal a cited violation prior to any fine assessment. The violation must be in writing and can be emailed to ;or the appeal can be mailed to

The board will review the appeal and notify the homeowner. *** Once a fine is levied, the homeowner waives the right to appeal the violation. If the fine is levied and not paid, it will follow the adopted Violation Policy and be turned over for collection and lien as outlined in the Violation Policy guidelines.

Discussed possibly treating the new retention pond fences for weather and wear….boardmembers said that expenses this year were high and the matter may be discussed at a later date but no actions to be taken now.

A+ Lawn Care Service, LLC submitted a new lawn cutting contract to cover the period of February 1, 2018 until January 31, 2019. Cost of $575 per month. Cutting schedule to be biweekly March-September and monthly October through February.
