I.Subject
The subject of the agreement is a single ride on a motorcycle hire on a speed race track, vehicle and motorcycle racing track.
The owner of the motorcycle thereto rents a motorcycle to the user:

The user/borrower is entitled to use the motorcycle exclusively with the purpose of riding on racing track in an allocated time and racing track.
The owner lends the motorcycle to the borrower/user prior to the agreed time ( hand in details to be mutually agreed at this stage by such agreement.)
The borrower/user receives the motorcycle from the owner prior to the agreed time ( reception of the motorcycle is to be mutually agreed at this stage by the agreement)
The user/borrower is bound by the agreement to hand in the motorcycle immediately once the ride(s) have/has been completed to the owner followed by making a record of returning the motorcycle right after the ride/rides has/have been completed, alternatively the owner having seen any rendered damage on the motorcycle files charges due to be paid to the owner. The charges include the costs of spare parts and labour which is required to mend the motorcycle.
The user of the motorcycle is by no means allowed to use the motorcycle anywhere outside the designated area of a racing track or a padlock.
The user/borrower is not allowed to sublet ones motorcycle to any third party
The user must be clearly marked while riding.
The owner accepts, agrees and understands that there maybe other riders on a racking track riding simultaneously
The user/borrower of the motorcycle is bound hereby to act in accordance with all given rules relating to riding on a racing track on the premises of the racing track.
The borrower is not responsible for any changes on the racing track e.g. a sudden change in weather or weather conditions, accidents, earthquakes anything which is caused by phenomena which go beyond the reach of the the company/borrower.
II. Cost/Charges
The two contracted parties have agreed on charges with the motorcycle hire which is .... times .... minutes (at a cost of) .... Euro(s) excluding VAT alternatively a day hire (which is) at .... Euros excluding VAT according to price list of the owner.
Prior to motorcycle hire the borrower/user pays a down payment
of ………………… to the owner which (down payment) is due to be used in case of any damage rendered while riding or on a racing track.
An inevitable part of the agreement “Agreement on motorcycle hire” is an amendment containing the price list of all spare parts and potential labour connected with the motorcycle repair in case any damage.
Should the borrower/user ride not rendering any damage to the motorcycle the down payment will be redeemed to the borrower/user in full.
III. Rules of hire and riding.
The borrower/user of the motorcycle must have a valid identification card or a passport which one is obliged to present when/before initiating an agreement.
The borrower/user of the motorcycle must not use nor be under the influence of an alcoholic drink nor any illegal substances before and/or during the ride and must agree to any random check determining the presence of such substances in blood at any time during/while on the track. Random checks are carried out by breathing.
The borrower/user is aware of the fact that riding a motorcycle is at the borrowers/users own risk and that the company take no responsibility of any injury/ harm caused while riding.
The borrower/user is bound to ride ones motorcycle not acceding 30 kilometers per hour outside the racing track which entails for example areas of parking lots etc.
The borrower/user of the motorcycle is obliged to behave while using the motorcycle with the utmost discipline and must take into consideration other riders so that the safety of oneself is not at risk as well as other riders on the racing track and also outside the racing track, and the rider is furthermore obliged to adjust ones behaviour to the overall condition of the racing track, must also take into consideration the weather condition and ones own ability.
The borrower is obliged in the duration the hire in the testing ride examine the functioning of the motorcycle, the functioning of brakes, engine at the same time one must ride such way that one doesn’t damage the motorcycle. In case any damage is rendered and noticed upon the motorcycle the borrower/user is obliged to abandon the racing track and go the nearest designated lay-by lane as soon as this is possible.
The borrower/user is obliged to stop the motorcycle in a designated area(lay-by) immediately should any failure of the engine occur so that the other riders are not exposed to any potential danger while smoothly riding.
The borrower/user is aware of the fact that the owner of the motorcycle is entitled and will also use the down payment for which will be used for the repair of the damage on the motorcycle rendered by the borrower/user which was signed when the down payment agreement was made. Provided the down payment is not sufficient to cover the expenditure of the repair of the damage rendered by the borrower/user the owner is then entitled for the entire refund from the borrower/user of the motorcycle of all costs accumulated and connected with the repair of the motorcycle.
IV. Final establishment
The borrower/user by signing the “Motorcycle hire agreement” confirms that one has read the “Motorcycle hire agreement” in full and also that one fully and unquestionably understood and understands the agreement and that one agrees to comply the agreement in its full extent.
The “Motorcycle hire agreement” becomes effective once it has been signed and motorcycle hire as well as the down payment have been paid. Both sides hereby declare that they have signed the “Motorcycle hire agreement” with free will and have not been forced to sign it and that there was no confusion present when the agreement was signed. The two sides also hereby declare that they have read the agreement in its full extent and have also understood it in full and unquestionably.
