Employers can post job openings which will go on the Career Center site and can be viewed nationally. U.S. Secretary of Labor Withdraws Joint Employer, Independent Contractor Informal Guidance
In line with AGC's regulatoryrecommendations, on June 7, U.S. Secretary of Labor Alexander Acostaannouncedthe withdrawal of the U.S. Department of Labor's (DOL) 2015 and 2016 informal guidance on joint employment and independent contractors. Both pieces of guidance together took an expansive interpretation of employment and threatened the traditional relationship between contractors and their partners. AGC and its members were concerned that these interpretations would make compliance more complicated, leading to unnecessary enforcement efforts and increased costs to projects.ReadMore

U.S. EPA, Army Corps Move to Rescind 2015 WOTUS Rule
The U.S. Environmental Protection Agency and the U.S. Army Corps of Engineers announced the pre-publication version of a proposed rule to rescind the Obama-era 2015 "Waters of the United States" (WOTUS) rule that defines what streams, wetlands and other wet areas are controlled by the federal government and subject to the permitting requirements of the Clean Water Act.This action is the first step in a comprehensive, two-step process intended to review and revise the definition of WOTUS consistent withPresident Trump's Executive Orderon "Restoring the Rule of Law, Federalism, and Economic Growth by Reviewing the 'Waters of the United States' Rule."ReadMore

OSHA Issues Proposal to Extend July 1 Deadline for Submitting Electronic Injury and Illness Records
On June 28, 2017, the Occupational Safety and Health Administration (OSHA) formally proposed a rule to extend the original deadline for contractors to electronically submit their 2016 injury and illness data (Form 300A) from July 1, 2017, to December 1, 2017. OSHA now expects to launch the electronic data collection system by August 1, 2017, allowing contractors four months to familiarize themselves with the new system. AGC will submit comments—due July 13, 2017—in favor of the extension.

2017 Annual Convention – Grand Forks – Call for Seminar Topics
Hey, members it’s that time. We are working on this year’s annual convention and we are completely out of ideas for seminar topics. So, we are asking for your help. If you have an idea for a good topic please let Mark know and if you also know a presenter for that topic (not a requisite for sharing an idea) all the better. We’d like to have your ideas by the end of July to allow time to find speakers and get the convention brochure ready for publishing. So, if there is something you’re interested in or have been wanting to know more about in construction or business let us know.

EPA Extends Deadline for States to Meet Ozone NAAQS
Last week, the U.S. Environmental Protection Agency (EPA) Administrator Scott Pruitt announced a one-year delay of EPA’s final designation of counties that are not attaining the 2015 ozone national ambient air quality standard (NAAQS). The 2015 standard tightened the existing 2008 standard from 75 parts per billion (ppb) to 70 ppb. Designations for the 2015 standard were originally due by this October. EPA is taking this additional time to review and re-evaluate many of the complicated issues that AGC raised in its comments on the proposed version of the 2015 rule. ReadMore

Announces Intent to Review Controversial Recordkeeping Rule Covering Drug Testing
OSHA also announced its intension to issue a separate proposal to reconsider, revise, or remove other provisions of the controversial May 2016 injury and illness recordkeeping final rule. The provisions under future consideration could include the anti-retaliation provisionthat focuses on post-incident drug testing, disciplinary policies, and safety incentive programs. OSHA will seek comment on those provisions in that separate proposal and AGC will again detail its concerns, as it did with the head of OSHA last year.
