PETITION FOR ADJUDICATION OF
DEPENDENT CHILD

COMES NOW, the Office of the Chief Prosecutor by and through their Presenting Officer, to petition the Court for an “Order Adjudication of Dependent Children” in the above docketed matter pursuant to 9 N.N.C. § 1002 (O) and in support of this, states the following:

1. This Court has exclusive original jurisdiction over the subject matter and parties of these proceedings pursuant to 9 N.N.C. § 1055 Jurisdiction of the Children’s Court (1985 supp.) at (A) and (D) Territorial Jurisdiction (1985 supp.) and 7 N.N.C. § 252 Family Court (1989).

The minor children was taken into Division of Social Services’ custody on ______, 2010.

5. That the parent, [Name of parent from caption], is in violation of 9 NNC §1002 (O), (2), for NEGLECT, A “DEPENDENT CHILD means a child:

“Who is without proper parental care and control, or whose subsistence, education, medical, or other care or control necessary for his or her well-being is inadequate because of the faults or habits of his parents, guardian or custodian or their neglect or refusal, when able to do so, to provide them,”

6. All reasonable efforts were made to prevent removal of the child from the home, and continued placement in the home would be contrary to the child’s welfare, well-being, and protection.

7. It is in the best interest of the minor child that [Name of minor child], be removed from the home and placed in an appropriate facility or foster home pending further order of the court.

WHEREFORE, Petitioner prays the Court:

1. Adjudicate the minor child as a dependent child under the Navajo Nation Children’s Code;

2. Enter an Order to promote the best interest and future welfare of the minor child.

3. Grant and vest legal and physical custody with the Division of Social Services with protective supervision, pending the issuance of the Order for Temporary Legal and Physical Custody and/or relative placement.

4. Enter any other relief deemed just and proper.
