O R D E R

The Delhi Medical Council through its Executive Committee examined a complaint of Ms. Jyoti r/o. G-165, Dr. Ambedkar Nagar, Sector-5, New Delhi – 110062, forwarded by Directorate of Health Services, alleging medical negligence on the part of Dr. Parvez Khan of Batra Hospital, in the treatment administered to complainant’s mother Ms. Anjala Hans at Batra Hospital & Medical Research Centre, 1, Tughlakabad Institutional Area, Mehrauli Badarpur Road, New Delhi - 110062.

The Order of the Executive Committee dated 19th February, 2014 is reproducedhereinbelow:-

“The Executive Committee of Delhi Medical Council examined a complaint of Ms. Jyoti r/o. G-165, Dr. Ambedkar Nagar, Sector-5, New Delhi – 110062 (referred hereinafter as the complainant), forwarded by Directorate of Health Services, alleging medical negligence on the part of Dr. Parvez Khan of Batra Hospital, in the treatment administered to complainant’s mother Ms. Anjala Hans (referred hereinafter as the patient) at Batra Hospital & Medical Research Centre (referred hereinafter as the said Hospital), 1, Tughlakabad Institutional Area, Mehrauli Badarpur Road, New Delhi - 110062.

The Executive Committee perused the complaint, joint written statement of Dr. Pervez A. Khan, Sr. Consultant Neurosurgery and Dr. (Brig.) Y.K. Arora, Medical Director, Batra Hospital, made to Directorate of Health Services, copy of medical records of Batra Hospital, as supplied by Directorate of Health Services and other documents on record.

The Executive Committee notes that the patient, late Anjala Hans, was admitted at the said Hospital on 1.12.2012 and diagnosed with right MCA stroke with left Hemiparesis. The patient was taken up for emergency thrombectomy and intra arterial TPA. Subsequently the patient also underwent decompressive craniectomy. The patient required ventilator support. As per progress notes and doctor’s orders of the said Hospital dated 7.2.2013 patient was weaned off ventilator and on 8.2.2013 was shifted to ward after discussing the possibility of ICU acquired infection. On 9.2.2013 the patient was discharged from the said Hospital.

The Executive Committee observes that since before being discharge the patient had been off ventilator for 72 hours, on room air, with stable vitals and neurological status also being stable, prognosis of patient explained to the family, the patient’s discharge on 9.2.2013 was justified.

In view of the observations made hereinabove, it is the decision of the Executive Committee, prima facie no case of medical negligence is made out in the treatment administered to Smt. Anjala Hans at Batra Hospital & Medical Research Centre.

Complaint stands disposed.”
