MINOR PARTICIPANT’S WAIVER OF LIABILITY

I hereby acknowledge that there is an element of risk involved in situations involving children outside direct parental control and away from home. I further acknowledge that there are various risks specific to the above event, including, but not limited to, physical injuries caused by moderate indoor and outdoor physical activity, physical injuries due to accidents involving motor vehicles, physical injuries due to participation in an outdoor bonfire, the risk of injury or harm due to the potential that other participants may not abide by the rules and regulations set forth for participants by WILS, and the risk that third parties not under the control or supervision of WILS may act negligently, recklessly, or intentionally and cause the user injury or harm while participating in the Event. As a parent or guardian signing on behalf of a minor participant, I also acknowledge the risk that my own child or minor ward may not abide by the rules and regulations set forth for participants by WILS.
Therefore, I, the undersigned participant, or the minor participant’s parent or guardian, assume all risk and responsibility for the above-named minor’s participation in the WILS Event, including responsibility for all accidental or negligent acts of WILS and its volunteers and directors, but I do not assume risk or waive liability for the reckless or intentional acts or omissions of WILS or for any other acts, omissions, or events which Wisconsin Statutes and/or controlling common law do not allow waiver of liability.
Therefore, I agree to waive all claims of liability and agree to hold harmless WILS and its officers, directors, employees, and volunteers, for any and all of the items listed above for which I have assumed risk and/or waived liability.
I have considered that if this waiver of liability was not as broad as it is, the cost for my child to participate in the Event would be considerably higher, and as I do not wish to pay a considerably higher cost, I waive the right to bargain for different waiver of liability terms.
I understand that, in lieu of signing this document and waiving claims for liability against WILS, I may contact WILS and pay a fee of $1,000.00 to cover the higher insurance and program costs resulting from not assuming risk and waiving liability. By signing this form, I irrevocably state that I do not wish to pay an extra fee and instead wish to pay nothing and assume risk and waive liability as stated above.
