RESOLUTION NO. 2014 -
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF HALLANDALE BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO RETAIN THE CONSULTING FIRM OF GREENWOOD AND STREICHER, LLC TO CONDUCT AN INDEPENDENT USE OF FORCE REVIEW OF THE HALLANDALE BEACH POLICE DEPARTMENT FOR AN AMOUNT NOT TO EXCEED FIFTY SEVEN THOUSAND ($57,000.00) DOLLARS; AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE WRITTEN ENGAGEMENT LETTER IN SUBSTANTIALLY THE SAME FORM AS ATTACHED AS EXHIBIT 2; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Hallandale Beach Police Department wishes to take a proactive posture in assuring that its policies and procedures for the use of force demonstrate the best practices available; and
WHEREAS, the City Administration has been engaged in discussion with the consulting firm of Greenwood & Streicher, LLC regarding conducting an independent review of the City’s use of force policies and procedures for an assessment in comparison against state law and national best practices; and
WHEREAS, Scott Greenwood is a constitutional rights attorney based in Cincinnati, Ohio whose practice emphasizes enhanced accountability, transparency, and legitimacy in best-practices law enforcement; and
WHEREAS, Attorney Greenwood also serves as general counsel for the American Civil Liberties Union and is a member of its national board; and
WHEREAS, Tom Streicher is the former Police Chief for the Cincinnati, Ohio Police Department where he oversaw the implementation of the most ambitious police/community reform effort in the country, working together with the African-American community, the ACLU, the Black United Front, the Police Department and the FOP; and
WHEREAS, the collaborative approach ensured effective and fully constitutional policing which transformed the community and turned it into a model for other cities; and
WHEREAS, the City Administration is recommending the retention of the consulting firm Greenwood & Streicher, LLC to conduct the independent review of the City’s use of force policies and procedures, and such a review is anticipated to take approximately six (6) months and the consultant has committed to presenting its findings and recommendations not only to the City Manager but also with a presentation before the City Commission and the public; and
WHEREAS, the independent review will include interviews of current Hallandale Beach Police Department members; interviews of other City employees, stakeholders, and citizens served by the agency; a review of policies, procedures, and past assessments of agency use of force; a determination of current practices within the agency; and comparison of those findings against state law and national best practices; and
WHEREAS, the City Administration recommends that the Mayor and City Commission authorize the City Manager to retain Greenwood & Streicher, LLC to conduct the independent use of force review of the Hallandale Beach Police Department in an amount not to exceed fifty seven thousand ($57,000.00) dollars and authorize the City Manager to execute the written engagement letter in substantially the same form as attached hereto as Exhibit 2.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF HALLANDALE BEACH, FLORIDA:
SECTION 1. a. City Manager’s Authorization. The Mayor and City Commission hereby authorize the City Manager to retain Greenwood & Streicher, LLC and execute the engagement letter in substantially the same form as attached as Exhibit 2 for an independent use of force review of the Hallandale Beach Police Department in an amount not to exceed fifty seven thousand ($57,000.00) dollars, inclusive of an initial payment of twenty thousand ($20,000) dollars as a retainer.
SECTION 2. Effective Date. This Resolution shall take effect immediately upon its passage and adoption.
