MONTHLY MEETING MINUTES

MAY 15, 2017

Be it remembered that the Cumberland County Commission met in monthly session on Monday, May 15, 2017 at the courthouse in Crossville, Tennessee. Deputy Sheriff Koby Wilson called the meeting to order at 6:00 o’clock P.M. Present and presiding was Commission Chairman, County Mayor Kenneth Carey, Jr. who invited Minister Clyde Webb from the Cumberland Worship Center to give the Invocation and Members of the Young Marines were asked by the Mayor to lead the Pledge of Allegiance to the Flag of the United States of America. Also present at the meeting were County Clerk Jule Bryson, County Attorney Randal Boston, Finance Director Nathan Brock, Assessor of Property David Simcox, Election Administrator Jill Davis, Emergency Medical Services Director Chris Miller and the following County Commissioners:

A quorum being present, the Cumberland County Commission was opened in due form of law and the following proceedings were had to wit:

1. MINUTES OF APRIL 17, 2017 QUARTERLY MONTHLY CUMBERLAND COUNTY COMMISSION

MEETING:

On motion of Commissioner Rimmer, second by Commissioner Claflin, moved the minutes of the April 17, 2017 Monthly Commission Meeting be approved, treat same as read, made a matter of record, and filed.

The motion to approve the Quarterly Meeting Minutes carried by a roll vote of 15 ayes from the Commission present with Commissioner Stone passing on the vote.

COMMENTS:

Crossville citizen Craig Clark appeared before the Board to express his gratitude to Commissioner Rebecca Stone for sponsoring resolution 11-2016-6 that encouraged the Tennessee General Assembly to pass legislation regarding the impact of large industrial turbines and he went on to thank the full Commission for listening to the concerns of Cumberland County Citizens and passing the resolution. Mr. Clark also voiced his appreciation to Mayor Carey and County Attorney Boston along with Senator Paul Baily and State Representative Cameron Sexton for their work to formulate a successful bill that would put a moratorium on any wind turbine projects in the State of Tennessee until July 2018 allowing time for a legislative study committee to evaluate the health, safety and economic impact associated with industrial wind turbines and to establish reasonable comprehensive regulations for wind energy facilities throughout the State.

2. RESOLUTION 05-2017-1-TO APPOINT RICK WILLIAMS TO SERVE AS THE CUMBERLAND COUNTY

EMERGENCY MANAGEMENT AGENCY DIRECTOR:

On motion of Commissioner Rimmer, second by Commissioner Hassler, moved to adopt resolution 05-2017-1.

The motion to adopt resolution 05-2017-1, accepting the recommendation of the County Mayor and the County

Technical Assistance Service (CTAS) to appoint Rick Williams as Emergency Management Director for

Cumberland County, carried by a roll call vote of 15 ayes from the Commission present with Commissioner Claflin

voting no. Mayor Carey introduced Rick Williams to Board Members and when questioned by Commissioner Hyder

about his county of residence, Mr. Williams stated he would soon be relocating from White County to Cumberland

County.

3. RESOLUTION 05-2017-2-TO APPOINT NANCY HYDER AND BOBBY RHEA TO SERVE AS MEMBERS

ON THE CUMBERLAND COUNTY HEALTH AND SAFETY STANDARDS BOARD FOR TERMS TO

EXPIRE MAY 15, 2021:

On motion of Commissioner Wilson, second by Commissioner Hassler, moved to adopt resolution 05-2017-2.

The motion to adopt resolution 05-2017-2, appointing Kenny Rosser and Nick Hedgecoth to serve as members on the Cumberland County Health and Safety Standards Board for four (4) year terms expiring May 15, 2019, carried by a roll call vote of 15 ayes from the Commission present with Commissioner Hyder abstaining from the vote.

4. RESOLUTION 05-2017-3-TO APPOINT MARSHA POLSON (TERM EXPIRES AUGUST 31, 2017),

KENNETH CAREY (TERM EXPIRE AUGUST 31, 2018), DR. DANNY HALL, DR. LARRY REED, DR.

RANDALL CROWDER, JIM PETTYAND BECKI HILLIS (TERMS EXPIRE MAY 31, 2017) TO THE

CUMBERLAND COUNTY BOARD OF HEALTH WITH DR. DON GRISHAM AND MINDY DOYLE TO

SERVE AS EX OFFICIO MEMBERS TO THE BOARD OF HEALTH:

On motion of Commissioner York, second by Commissioner Hyder, moved to adopt resolution 05-2017-3.

The motion to adopt resolution 05-2017-3, appointing Marsha Polson, Kenneth Carey, Dr. Danny Hall, Dr. Larry

Reed, Dr. Randall Crowder, Jim Petty, Becki Hillis, Dr. Don Grisham, and Mindy Doyle as members to the

Cumberland County Board of Health, carried by a roll call vote of 16 ayes from the Commission present.

5. RESOLUTION 05-2017-4-AUTHORIZING SUBMISSION OF AN APPLICATION FOR A LITTER AND

TRASH COLLECTING GRANT FOR FISCAL YEAR 2017-2018 FROM THE TENNESSEE DEPARTMENT

OF TRANSPORTATION AND AUTHORIZING THE ACCEPTANCE OF SAID GRANT:

On motion of Commissioner Hassler, second by Commissioner Gibson, moved to adopt resolution 05-2017-4.

The motion to adopt resolution 05-2017-4, authorizing the County Mayor to apply for a 2017-2018 Fiscal Year Litter and Trash Collecting Grant from the Tennessee Department of Transportation and should that application be approved the County Mayor is authorized to execute the necessary documents to accept the Litter and Trash Collecting Grant, carried by a roll call vote of 16 ayes from the Commission present.

6. RESOLUTION 05-2017-5-DECLARING CARDIAC MONITORS NO LONGER UTILIZED BY

EMERGENCY MEDICAL SERVICES AS SURPLUS PROPERTY AND TO BE DONATED TO THE CITY

OF CROSSVILLE, TENNESSEE:

On motion of Commissioner Foster, second by Commissioner Isham, moved to adopt resolution 05-2017-5.

The motion to adopt resolution 05-2017-5, declaring three (3) Zoll E Series Cardiac Monitors as surplus county

property to be donated to the City of Crossville, Tennessee, carried by a roll call vote of 16 ayes from the

Commission present.

7. RESOLUTION 05-2017-6-TO REVISE RATES FOR ELECTION OFFICIALS:

On motion of Commissioner Gibson, second by Commissioner York, moved to adopt resolution 05-2017-6.

The motion to adopt resolution 05-2017-6, revising Election Officials pay rates, carried by a roll call vote of 16 ayes

from the Commission present.

8. RESOLUTION 05-2017-7-AUTHORIZING A DONATION TO THE CUMBERLAND COUNTY VETERANS

ASSISTANCE COUNCIL, GENERAL FUND, $9,126.00:

On motion of Commissioner Foster, second by Commissioner Hyder, moved to adopt resolution 05-2017-7.

The motion to adopt resolution 05-2017-7, a budget amendment approving restitution proceeds are contributed to the Cumberland County Veterans Assistance Council, carried by a roll call vote of 16 ayes from the Commission present.

9. RESOLUTION 05-2017-8-BUDGET AMENDMENT, GENERAL FUND, LIBRARY, $320.00:

On motion of Commissioner Hassler, second by Commissioner Patterson, moved to adopt resolution 05-2017-8.

The motion to adopt resolution 05-2017-8, a budget amendment designating donations from private citizens and civic

organizations for the use and benefit of the Art Circle Public Library, carried by a roll call vote of 16 ayes from the

Commission present.

10. RESOLUTION 05-2017-9-BUDGET AMENDMENT, GENERAL FUND, COMMUNITY COMPLEX, PARKS

AND FAIR BOARDS, $6,600.00:

On motion of Commissioner Wilson, second by Commissioner Carter, moved to adopt resolution 05-2017-9.

The motion to adopt resolution 05-2017-9, a budget amendment for repair and replacement of heating, ventilation

and air conditioning equipment (HVAC) at the Community Complex, carried by a roll call vote of 15 ayes from

the Commission present with Commissioner Geisler passing on the vote.

11. RESOLUTION 05-2017-10-BUDGET AMENDMENT, GENERAL FUND, PROPERTY ASSESSOR,

$11,465.00:

On motion of Commissioner York, second by Commissioner Patterson, moved to adopt resolution 05-2017-10.

The motion to adopt resolution 05-2017-10, a budget amendment reallocating monies for part-time employees

expenditures for a replacement motor vehicle for the Property Assessor Department, carried by a roll call vote of 16

ayes from the Commission present.

12. RESOLUTION 05-2017-11-BUDGET AMENDMENT, GENERAL FUND, OTHER GENERAL

ADMINISTRATION, VEHICLE MAINTENANCE, $21,000.00:

On motion of Commissioner Gibson, second by Commissioner Hyder, moved to adopt resolution 05-2017-11.

The motion to adopt resolution 05-2017-11, a budget amendment for repair and replacement of the roofing system at

the Vehicle Maintenance facility, carried by a roll call vote of 16 ayes from the Commission present.

13. RESOLUTION 05-2017-12-BUDGET AMENDMENT, SANITATION FUND, RECYCLING CENTER,

$19,000.00:

On motion of Commissioner Rimmer, second by Commissioner Claflin, moved to adopt resolution 05-2017-12.

The motion to adopt resolution 05-2017-12, a budget amendment to facilitate Waste Tire Surcharge revenue and

Recycle Center tipping fees, carried by a roll call vote of 16 ayes from the Commission present.

FINANCE DIRECTOR REPORT:

The April 2017 financial statistics for funds received from property taxes, hotel/motel taxes, ambulance service fees, prisoner boarding and sales taxes were provided by Finance Director Brock.

COUNTY ATTORNEY REPORT:

In his monthly report, County Attorney Boston informed the Board that the Taylor vs Cumberland County Case was set to be tried on June 2, 2017, the Family Dollar Case was to be heard on June 7, 2017 and a Motion to Dismiss Hearing was scheduled with Spirit Broadband, LLC on June 9, 2017.

14. ELECTION OF NOTARIES:

On motion of Commissioner Gibson, second by Commissioner Foster, moved that Rhonda M. Devore, Jo M. Faubert, Sheila K. Gupta, Judy Fern Hicks, Nancy J. Hyder, Rita L. Kitchens, Claudia Manning, Amanda Newcome, Tiffany M. Norris, Melissa E. Pelfrey, Wendy M. Persinger, Teresa Raymond, Marie Lynn Stephens, Jason Tollett and Carrie Vandever are elected as Notary Publics for the State of Tennessee.

The motion to approve the notaries carried by a roll call vote of 15 ayes from the Commission present with Commissioner Nancy Hyder abstaining from the vote.

ANNOUNCEMENTS:

Beer Board Chairman, Tom Isham advised the Cumberland County Beer Board had summoned nine (9) permit holders charged with the illegal sale of alcohol to a minor to a Special Call Session on May 24, 2017. Also Sue York informed the Board that she had recently attended the fourteenth annual “Attendance is the Key to Success” presentation sponsored by Dave Kirk Automotive. She stated she was most impressed by the concept of the program designed to motivate high school students to keep up their school attendance in order to be eligible to qualify for a drawing to receive a new car.

15. ADJOURNMENT:

On motion of Commissioner Carter, second by Commissioner Claflin, moved the May 16, 2017 Monthly Commission Meeting be adjourned at 6:25 o’clock P.M.

The motion to adjourn the meeting carried by voice vote from the Commission present.
