A. Reading of November 16, 2010 Commission meeting minutes
B. Update – On October 26, 2010 Mr. Charles Benoit d/b/a Southern Mobile Transport came in front of the commission to appeal 2 fines he received. At that time the Commission voted that IC1001857 needed to be correctly installed or moved within 30 days. On December 7, 2010 this home was re-inspected and it is still not set to code. He has a fine of $750.00. On IC1002267 the Commission voted to impose this fine of $2,600.00. Mr. Benoit stated he could pay the fine within 30 days. On December 2, 2010 Mr. Benoit came in to pay on his fine because he was unable to pay the full amount. Advised the Commission would have to approve this payment arrangement. On the same day $800.00 was paid on this fine by check and it did not clear.
Also, Mr. Benoit installed a home 60 inches in height (IC1002834) without engineer or architect plans that he was fined for on October 19, 2010. He had until December 13, 2010 to correct this home. As of today the home is still not corrected. Asked to reschedule appeal.
C. Update – Ron Eddy d/b/a Eddy’s Mobile Home Movers ($8,400.00)
D. License Issue – The installer license of Justin Spell was originally denied due to questions the Commission had concerning Mr. Spell’s business association with Patrick Townzen. The Commission requested that Mr. Spell come before them to answer these concerns. Mr. Spell did not appear. At the December LMHA Continuing Education course, Mr. Spell asked what he needed to do to obtain his license. He was told to come before the Commission to answer some questions.

1. Charles Benoit d/b/a Southern Mobile Transport ($500.00) IC1002446 On September 10, 2010 investigator Ruven St. Pierre inspected this home stemming from a complaint. The investigator found the home was not set to code. On September 16, 2010 a fine letter in the amount of $500.00 was mailed certified and 1st class to Mr. Benoit. The letter was returned unclaimed. On October 15, 2010 a second demand letter was mailed by 1st class mail. On November 9, 2010 a third and final demand letter was mailed out by 1st class mail. November 15, 2010 the set up inspection report was faxed to the office indicating the home was ready for re-inspection. On November 19, 2010 Mr. Benoit faxed an appeal letter. Asked to reschedule appeal.
2. William J. Eddy d/b/a Pelican Mobile Home Transport ($3,600.00) On August 20, 2010 a letter from Iberville Parish Council was received into LMHC offices stating a very large Mobile Home Park had closed and they wanted to schedule a meeting to discuss adequate laws for new and used mobile homes. On August 23, 2010 another letter was received with the address of 3 homes that were installed on Castro St. On September 22, 2010 Investigator Sammy Hoover inspected these 3 homes and found they were not set to code and had no permit sticker. At that time the homeowners advised Mr. Hoover Pelican Mobile Home Transport was the installer. On October 7, 2010 Mr. Eddy was fined $600.00 for each home by certified letter. On November 5, 2010 an appeal letter was received into LMHC offices. The homeowners were subpoenaed to appear.

a. Herbert & Catherine Eitenne gave Affordable Housing of Baton Rouge a down payment of $20,000 to purchase a home in 2007. They have not received a home or their money back. Affordable Housing of Baton Rouge went out of business in 2009 and the owner is now a licensed salesperson with another company.
b. Rick Breen d/b/a Northwood H/P was fined $500.00 for no site preparation. He would like the fine rescinded based on he was not aware this needed to be done.
