Development: Listed Building Application to demolish extension and dormer at the rear of No. 73, reinstatement of rear and side elevations and erect a 3 storey building at rear.

Ward: C 030 Poole Town

This application is brought before the Planning Committee because the works relate to a Grade II* Listed Building and are associated with an application for a redevelopment proposal which is on the Committee agenda.

Site Description

No. 73 is now used as a shop and offices.

The building was formerly known as the Bulls Head Inn and it originates from the early 16th Century. The much altered exterior conceals an interior with rare surviving 17th century plasterwork of considerable interest.

Current Proposal

This application seeks consent for works to the listed building which comprise:

·  A new shop front;

·  Demolition of rear dormer;

·  Alteration to circulation space within building;

·  Alteration to windows and doors; and

·  Works within the curtilage of/connected to the listed building.


REPRESENTATIONS

English Heritage - the listed building has been adversely affected by substantial twentieth century rear additions and inappropriate modern shop fronts. Generally supportive of revised scheme but raise a number of detailed design issues to assist with determining the application. Providing these issues (which include concerns about dormer design and window detailing) are addressed we recommend that the case should be determined in accordance with Government guidance, development plan policies and with the benefit of any further necessary conservation advice locally.

Planning Considerations

Officers from the Urban Design and Conservation Team met the representative from English Heritage on site and a historic building survey was carried out. This survey revealed the existence of a listed wall projecting to the rear of the building. The scheme has been modified to take account of this wall and to address the comments of English Heritage where appropriate.

Subject to a number of detailed conditions it is considered that this scheme will result in improvements to and an enhancement of the setting of the listed building and it is recommended that listed building consent be granted.

Human Rights Act

In coming to this recommendation/decision consideration has been given to the rights set out in Article 8 (Right to Privacy) and Article 1 of the First Protocol (Right to Peaceful Enjoyment of Possessions) of the European Convention on Human Rights.

RECOMMENDATION

GRANT

Subject to the following conditions

1 - Non Standard

The top floor of the listed building is to be used for light storage only and any changes to this part of the building or to its proposed use should be agreed in writing by the Local Planning Authority.

Reason -

In order to protect the delicate winder staircase and important ceiling within the listed building and in accordance with Policy BE12 of the Poole Local Plan First Alteration (Adopted 2004).


2 - Non Standard

External finishes to the listed wall projecting to the rear of the building are to be agreed in writing by the Local Planning Authority.

Reason -

In order to ensure that the wall is protected and not harmed by subsequent works to it and in accordance with Policy BE12 of the Poole Local Plan First Alteration (Adopted 2004).

3 - Non Standard

The chimney and coped wall dividing No. 71 and No. 73 is to be retained in the redevelopment.

Reason -

These details are not shown on the rear elevation and in order to clarify the extent of this consent.

4 - Non Standard

The internal wall of No. 73 to the Lane is to be rendered with a traditional smooth render finish and painted to a colour agreed by the Local Planning Authority.

Reason -

In order to enhance the appearance of this elevation and in accordance with Policy BE12 of the Poole Local Plan First Alteration (Adopted 2004).

5 - Non Standard

All mosaic tiles to front elevation of listed buidling to be removed and the exposed area to be rendered with traditional smooth render finish and painted white.

Reason -

In order to enhance the appearance of this elevation and in accordance with Policy BE12 of the Poole Local Plan First Alteration (Adopted 2004).

6 - Non Standard

Clay plain tiles are to be used on the roofs of the existing buildings and a clay redstock brick is to be used on the walls. Samples are to be submitted to and agreed in writing by the Local Planning Authority before any works commence on the existing buildings. The roof to the retained stone wall is to be lead.

Reason -

In order to enhance the appearance of this elevation and in accordance with Policy BE12 of the Poole Local Plan First Alteration (Adopted 2004).


7 - Non Standard

The following details are to be submitted for agreement in writing by the Local Planning Authority before the development commences:

·  Window openings to have arches with double headers and sills from reconstituted stone.

·  Dormer windows to have lead cheeks and roofs.

·  Rainwater goods to be metal - colour to be agreed.

Reason -

In order to enhance the appearance of the Listed building and in accordance with Policy BE12 of the Poole Local Plan First Alteration (Adopted 2004).

8 - Non Standard

Works in connection with the Purbeck stone infill under the arch are to be undertaken in consultation with the Conservation Officer at the Local Planning Authority. Detailed drwaings at 1:50 are to be provided to show existing and proposed infill.

Reason -

In order to enhance the appearance of this elevation and in accordance with Policy BE12 of the Poole Local Plan First Alteration (Adopted 2004).

The proposed development has been tested against the following policies of the Development Plan and, in the opinion of the Local Planning Authority, is not in conflict with the following policies:

Current Proposal

This application seeks consent for the demolition of flat roofed single and two storey buildings used for offices and warehousing at the rear of No. 73 High Street, and a two storey extension to the rear of No. 71.

REPRESENTATIONS

No objections have been received to the demolition of these buildings.

Planning Considerations

·  The main consideration in assessing this application is whether the loss of the existing buildings on the site would be harmful to the character of the High Street Conservation Area.

·  The existing buildings are of no architectural merit and have a negative impact on the character and appearance of the area. Subject to a condition stipulating that demolition should not take place until works have been agreed in connection with an approved redevelopment scheme, no objection is raised to this application for Conservation Area Consent.

In coming to this recommendation/decision consideration has been given to the rights set out in Article 8 (Right to Privacy) and Article 1 of the First Protocol (Right to Peaceful Enjoyment of Possessions) of the European Convention on Human Rights.

RECOMMENDATION

GRANT

Subject to the following condition

1 - HB110 (Demolition Delayed Until Contract Let for New Building)

The demolition hereby permitted shall not take place until a contract for the re-development permitted under the companion planning permission No 04/11287/22 has been let; the details of which shall be submitted to, and approved in writing by, the Local Planning Authority prior to any work whatsoever commencing on site.

Reason -

To prevent premature demolition of the building and the creation of a vacant site, detrimental to the character and appearance of the conservation area in accordance with current national advice and in accordance with Policy BE16 of the Poole Local Plan First Alteration (Adopted 2004).

This application is brought before the Planning Committee at the request of Councillor Wilson because of local concerns and the history of the site.

Site Description

The site is located on the corner of Sandecotes Road and De Redvers Road. It is a prominent site and is currently occupied by a detached Edwardian style dwelling of two stories on its Sandecotes Road elevation and three stories on its De Redvers Road elevation. The site contains three mature trees on its northern boundary that are visually prominent and contribute significantly to the street scene.

Relevant Planning History

1983, 1979, 1977 and 1971 - Refusals of consent to sever land and create a detached dwelling adjacent to No. 30 Sandecotes Road. An appeal against one of these decisions was dismissed in 1978.

1988 - Refusal of consent to demolish existing dwelling and erect thee town houses with double garages under.

1991 - Refusal of consent to demolish existing dwelling and erect a terrace of three town houses - Appeal Dismissed.
