Tenant Utility Agreement

Marical Brothers Real Estate in accordance with the lease agreement pays all of the utility bills. However, all customers are required to sign our utility agreement which states the following: If tenant utility bill is 10% over the average of all of the presiding tenants, the customer will be required to pay the overage. Here’s an example: The monthly average of all tenants in the Golden Acres Cottages is $100 but your unit had a $150 electric bill, MBRE will bill you $50. This amount will be due by the 5th of the following month. Failure to pay by that date will incur a late fee of $10. If the amount is not paid by the 10th of the month, an additional $10 late fee will be added.

Community Rules and Regulations

Parking

•Timbers Residents will park in their respective garages or driveways and their guests can park on the curb when necessary.

•Golden Acres Cottages residents should park in resident garages or driveways. According to city regulation there is no parking allowed on Leo Street; however it is acceptable for overflow parking onto Wiley Street. Parking on the interior of the complex (except within the lines of driveways) is not allowed. Parking in these interiors side streets can and will incur the towing of your vehicle.

All community equipment is reserved for residents and their respective guests only. Trespassers will be prosecuted.

Safe Room Procedures

In the event of an emergency, please calmly go to the Golden Acres Cottages Safe Room. The code is 12345 and here are some helpful tips to make these procedures more comfortable and smooth for all residents:

  • Bring food, water and blankets for personal comfort
  • In the case of residents that have pets (dogs, cats) please put your animal in a kennel or container for the safety of other residents and their pets. Animals that are contained will tend to remain calm and less stressed in an enclosed environment.
  • If you know of a neighbor that has a handicap or may need assistance with getting to the safe room pleaseoffer assistance or call local authority to assist.

Trash Pick-up

Central Disposal will pick up Bulky Waste once a month, on the same day as your residential trash and yard waste pick up. Just place your Bulky Waste at your curb before the day of your pick up. You can dispose of old appliances, couches, and other large items. For details on restrictions please visit

Recycling within the Community

TheShawnee Municipal Authority and Central Disposalpromote the recycling of all types of paper, plastics, aluminum beverage cans, glass, and steel food cans. The community recycling drop offlocationsare locatedonthe south side of the parking lot of the Homeland grocery store at 600 W Independence St (Kickapoo and Independence). The second location is at Central Disposal located at 700 E. 45th Street.
All Plastics should have any food residue washed out of them. Containers are clearly marked for each recyclable item. You can empty your sacks/bags of recyclable materials into the containers.

Pet Policy

MBRE will allow 1 pet per unit under 25 lbs. and requires an additional $50 per month rental increase to cover the pet deposit expense. The pet deposit is non-refundable, no exceptions. More than 1 pet will need management approval and may be subject to additional fees.

Leasing Policy

Extending or early termination of lease policy

Leasing Extension: MBRE will allow tenants to renew their lease and will require a 30 day notice along with a 6 month lease agreement (a month to month agreement will need management approval and is subject to denial). The deposit will be held until the lease obligations and deposit policies are met. The lessee will have full rights and access to the property as agreed in the contract agreement. In turn, once the lessee has completed his/her term, the landlord has the full right to regain total access and rights to the property. If the lessee does not render the property in the time allotted, the landlord may take further legal action to regain access and recover damages.

Leasing Early Termination: Early termination is subject to state law requirements and management approval. IF lessee meets these qualifications, MBRE requires a 30 day notice for early termination of leasing contracts. The deposit will be held until the lease obligations under Oklahoma law and deposit policies are met. The lessee will have full rights and access to the property as agreed in the contract agreement. In turn, once the lessee has completed his/her term, the landlord has the full right to regain total access and rights to the property. If the lessee does not render the property in the time allotted, the landlord may take further legal action to regain access and recover damages.

Termination of the Lease

Once the lease has been established, there are conditions where the lease can be terminated.

1. Failure of the tenant to pay rent
2. Safety violations on the part of the landlord or tenant
3. Failure to comply with the agreements of the contract, such as occupancy requirements 4. Unclean and/or not properly caring for rental unit

Under these circumstances, the landlord may be granted the right to evict the tenant. In the last two circumstances, if the landlord is at fault, the lessee may be allowed by law to break the lease.

Late Fees & Other Charges

Rent is due no later than the 1st of the month. Any rent received after the due date will be considered delinquent and will be subject to late fees. Rent may be paid at: 16759 County Road 3520, Ada, OK 74820 by personal check or money order payable to Marical Brothers Real Estate, LLC. A $35 will be charged if rent is not paid in full by 5pm on the 5th of the month. An additional charge of $50 will be charged if rent is not paid in full by 5pm on the 10th of the month. A $25 is charged for each check returned by the bank for ANY reason. Late fees will apply if your check is returned by your bank.

Use of Property:

Tenant agrees that the property shall be used and occupied as a residence for Tenants, and for no other purpose.

Deposit Policy

A deposit is required for each tenant (please see page 3 for specific pet deposit requirements). The deposit is an assurance that the landlord can recover possible damages to the property. The deposit is to be used for damages to the property and unpaid rent upon the completion of the term. Renters must request the deposit in writing within six months of the end of the lease and provide a forwarding address for the refund. The landlord has up to 30 days to release the remaining deposit.

Maintenance Requests FAQs

All maintenance requests must be submitted online at maricalbrothers.com. If a technician is sent to your property for something covered in this section, you could be charged a maintenance fee.

  • Light bulb replacement
  • Unclogging sinks and toilets - If you are experiencing slow or drains backing up- always try to use plunger on particular drain first in order to free up any local blockage in the drain line.
  • MBRE is not liable for electricity outages
  • Garage Door Opener -If you are having issues with garage door not wanting to close all the way- check to see if you have the safety-eye sensors at the bottom of each rail. These sometimes get dirty, blocked by leaves or knocked out of alignment. Once the sensors are readjusted – the opener should function properly.Should that not take care of it – most garage door openers can be disengaged and door operated manually. On the garage door opener railing, there is a carriage and usually has a rope attached to it, simply pull down on the rope in order to disengage the garage door opener carriage from the rail in order to put the garage door into manual operation.
  • Smoke Detector - There are several different types of smoke detectors, most which have a 9 volt battery power source or back-up. If your smoke detector chirps occasionally by itself – then most likely the battery needs changed out. DO NOT JUST REMOVE THE BATTERY FROM THESE DEVICES – THE LIFE YOU SAVE WOULD BE YOUR OWN!
  • Garbage Disposal -Garbage disposals can at times hang themselves up and quit working, sometimes by lack of use and a very simple thing to correct. If you turn on your disposal switch – then hear a humming sound – turn off the switch – the motor is hung up. Disposals come with an allen-wrench tool that fits in a hole in the center of the underside of disposal. This will allow the motor to be turned and un-hung. If the allen-wrench tool is not under the sink, you can obtain one at most hardware stores. Another option is to use something sturdy enough down the top of disposal in order to get the motor to turn, not just the disposal grinding blades. Once the motor is free and turning, you can again turn on the power switch to see if disposal will run again.If the disposal is not responding at all to the power switch, then it has tripped the internal motor reset, which is also located on the bottom side of disposal. Simply press the switch in to reset and try power switch again.
  • Bugs/Pests/Rodents - Pest Control is Tenant responsibility.
  • A/C or Heat - Dirty air filters are the leading cause of a/c or heat issues- restriction of air flow puts increase strain on these systems, which in turn increases your utility bills. MBRE will be entering your unit the first Wednesday of every month to replace your air filter and to perform unit inspections.
  • Hotel – MBRE will not be responsible for placement or payment for any hotel services rendered due to maintenance concerns.
