CONTRACT FOR BURIAL SERVICES

United Hebrew Brotherhood, a Minnesota nonprofit corporation, acting by and through its Board of Trustees, hereinafter called “CEMETERY” hereby agrees to provide, and the undersigned purchaser (the “PURCHASER”) agrees to purchase, burial services for ______

(the “GRANTEE” DECEASED), in the United Hebrew Brotherhood Cemetery, 2605 W. 70 ½ Street, in the City of Richfield in the County of Hennepin for the State of Minnesota, for the total sum of $______representing:

Foundation installation$

Monument maintenance fee$

Payment is due at time of service. PAYABLE: UNITED HEBREW BROTHERHOOD.

Burial services include opening and closing the grave, preparing the gravesite following burial, and for the perpetual care of the gravesite and CEMETERY property. These charges are in addition to and separate from charges made by a funeral director, and CEMETERY charges for a Grant of Burial (purchase of right to burial in a lot).

  1. ACCEPTANCE. This agreement shall not be binding upon the CEMETERY until an authorized representative of the CEMETERY signs it. The CEMETERY will not accept this agreement unless the PURCHASER or another party has also purchased, by separate agreement, a Grant of Burial for the GRANTEE(S) in a plot on CEMETERY property. This agreement shall be binding upon the PURCHASER and the estate, executors, administrators, and heirs of the GRANTEE(S).
  1. RULES AND REGULATIONS. This Contract for Burial Services is subject to all conditions and restrictions now and hereafter provided in the CEMETERY’S By-Laws or other rules or regulations. Among these restrictions is that CEMETERY lots shall be used exclusively for the burial of persons of the Jewish religion and that all burials must be in accordance with Jewish Law, including kosher wooden casket, “tahara” (ritual washing) and “tachrichim” (ritual shroud). Burial of non-Jewish spouses may be permitted in an area designated as the Interfaith Section.
  1. OUTER BURIAL CONTAINER. According to CEMETERY By-Laws, each burial must include a grave liner or vault. The PURCHASER acknowledges that the PURCHASER is responsible for providing the grave liner or vault, and the cost of the grave liner or vault is not included with the Contract for Burial Services.
  2. MONUMENTS/MEMORIALIZATION. A permanent memorial (monument, marker or bench) is required to be set at the grave within one year of burial. Memorial designs must be submitted to CEMETERY for approval.The PURCHASER understands and acknowledges that under this Contract and/or the CEMETERY By-Laws, no existing memorials already on the Cemetery grounds may be left,or new memorial placed,or additional engravings done until a Grant of Burial Agreement and the Contract for Burial Services are signed, and all outstanding Cemetery charges have been paid in full. Such memorials are considered non-conforming. All memorials are the property and responsibility of the Purchaser, including maintenance of same.Cemetery is not responsible for damage to memorials. Any non-conforming memorial set anywhere in the cemetery by any person may be removed and stored with no liability to the cemetery. PURCHASER agrees to not contest this stipulation, and is responsible for all costs incurred due to non-conforming memorials.
  1. NON-PAYMENT BY PURCHASER. The CEMETERY reserves all rights and remedies that may be available to it should the PURCHASER fail to pay for this Contract for Burial Services as agreed herein. The PURCHASER further agrees to reimburse and indemnify the CEMETERY for all costs and attorney fees incurred by the CEMETERY in seeking enforcement of this agreement as to the PURCHASER, or the estate, executors, administrators or heirs of any GRANTEE(S). The CEMETERY’S legal rights and remedies include, but are not limited to, the right of the CEMETERY, pursuant to the CEMETERY’S By-Laws, to remove any form of memorialization placed upon a grave prior to payment in full. Time is of the essence in this contract.

  1. LIMITATION OF LIABILITY. The CEMETERY expressly reserves the right and option any time that it finds itself unable to fulfill any part of this agreement owing to invasion, war, riot, order of court or any other unforeseen contingency, or because of mistake, fraud or misrepresentation by any person, to return to the PURCHASER all monies paid for the Grant of Burial, or substitute a burial space in the CEMETERY’S property that reasonably compares in character and location as then available to the lot selected. The CEMETERY shall not be responsible for damages of any kind other than what it agrees to in this Contract for Burial Services. The PURCHASER agrees to be limited to these remedies.
  2. ENTIRE AGREEMENT. This contract contains all the agreements between the PURCHASER and the CEMETERY relating to this Contract for Burial Services. The PURCHASER understands and agrees that no official or other representative of the CEMETERY or funeral director or counselor has any authority to make any oral or written statements or binding agreements not contained in this contract.
