Puffing Advertisement

Misrepresentation in advertisements can sometimes lead to violations by the FTCA. When determining these violations opinions can often be overlooked and considered “puffing,” which is when the advertisement claims that the product is “the best” and exaggerates the value of the product. In an online Dick’s Sporting Goods advertisement for the Callaway Big Bertha 454 Driver, they claim, “The World’s Longest Driver.” Although some people may hit the ball longer with this driver, it is a hard characteristic to compare without testing it against other drivers. In this case, although this may be an opinion that this driver is the longest it would probably be overlooked and considered an example of puffing by the FTCA.
